MINUTES OF THE LAFAYETTE COMMON COUNCIL October 1, 2012 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday October 1, 2012 at 7:00 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Meyer called the meeting to order at 7:00 pm. The Pledge of Allegiance was given to the flag of our Country. The following members were present: Present: Heide, Klinker, Reynolds, Campbell, Brown, Ahlersmeyer, Downing and Weast-Williamson, and Meyer City Clerk Cindy Murray and City Attorney Ed Chosnek were present The City Clerk stated that there was a quorum present. Councilman Campbell moved to for recess for a public hearing, Councilman Brown seconded, on the following Ordinances: Ordinance 2012-18 (2013 Budget Ordinance, an Ordinance Appropriating Money for the Purpose of Defraying the Expenses of Several Departments of the City Government of the City of Lafayette, Indiana for the Fiscal year Beginning January 1, 2013 and Ending December 31, 2013, Including the Outstanding Claims and Obligations and Fixing a Time When the Same Shall Take Effect) Ordinance 2012-19 (An Ordinance Fixing the Salaries of the Elected Officials of the City of Lafayette, Indiana for the Year 2013) Ordinance 2012-20 (An Ordinance Fixing the Salaries of the Appointed Officers and Employees of the City of Lafayette, Indiana, for the Year 2013, Excluding the Sworn Protective Occupation and Law Enforcement Members of the Police and Fire Departments) Ordinance 2012-21 (An Ordinance Fixing the Salaries of the Sworn Protective Occupation and Law Enforcement (POLE) Members of the Police and Fire Departments of the City of Lafayette, Indiana for the Year 2013). . No public comment was heard. Councilman Campbell moved to reconvene the regular meeting, Councilwoman Ahlersmeyer seconded. The motion passed by unanimous voice vote. Councilman Downing moved to set a Special City Council Meeting for Oct 22, 2012 for second reading and final adoption for the Ordinances listed above at 5:00pm in the City Council Chambers Councilwoman Williamson seconded. The motion passed by unanimous voice vote. Councilman Campbell moved to approve the minutes of September 10, 2012 meeting, Councilwoman Ahlersmeyer seconded. There were no additions or corrections. Minutes approved by unanimous voice vote. The Clerk stated there were no Claims, Petitions or Communications. The Clerk stated the following reports are available in the City Clerk’s Office and on the City Website. Clerk’s Office Monthly-August Water Works Department Monthly-August Water Pollution Control Department Monthly-August Fleet Maintenance/Motor Vehicle Department Monthly-August Ordinances for Second Reading: The Clerk read Ordinance 2012-10 (An Ordinance Annexing Certain Lands into the City of Lafayette, Indiana-Lafayette Annexation 2012-Area 1) by title only on second and final reading. Councilwoman Ahlersmeyer moved for passage, Councilwoman Weast-Williamson seconded. Mayor Roswarski spoke regarding the Annexation ordinances. Ordinance 2012-10 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2012-11 (An Ordinance Annexing Certain Lands into the City of Lafayette, Indiana-Lafayette Annexation 2012-Area 2) by title only on second and final reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Ordinance 2012-11 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2012-12 (An Ordinance Annexing Certain Lands into the City of Lafayette, Indiana-Lafayette Annexation 2012-Area 3) by title only on second and final reading. Councilman Klinker moved for passage, Councilman Heide seconded. Ordinance 2012-12 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2012-17 (An Amendment to Ordinance No. 95-22 Inclusion of Certain Property in the Local Ninth Street Hill Historic District in the City of Lafayette, Indiana) by title only on second and final reading. Councilwoman Ahlersmeyer moved for passage, Councilman Downing seconded. Brian Bugajski spoke regarding this voluntary request for 609 South 9th Street to be included in Ninth Street Hill Historic District. Ordinance 2012-17 passed 8-0 on a roll call vote on second and reading. The Clerk read Ordinance 2012-22 (An Ordinance to Amend Ordinance 2011-19-An Ordinance Fixing the Salaries of the Sworn Protective Occupation and Law Enforcement (POLE) Members of the Police and Fire Departments of the City of Lafayette, Indiana, for the Year 2012) by title only on second and final reading. Councilman Heide moved for passage, Councilman Reynolds seconded. Mayor Roswarski spoke regarding the amendment. Ordinance 2012-22 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2012-23 (An Ordinance to Amend Amended Ordinance 2011-18-An Ordinance Fixing the Salaries of the Appointed Officers and Employees of the City of Lafayette, Indiana for the Year 2012, Excluding the Sworn Protective Occupation and Law Enforcement members of the Police and Fire Departments.) by title only on second and final reading. Councilman Downing moved for passage, Councilwoman Weast-Williamson seconded. Ordinance 2012-23 passed 8-0 on a roll call vote on second and final reading. Ordinances for First Reading: Councilman Meyer stated he would not be present for the next three Ordinances due to Conflict of Interest with his law firm. He left the meeting at 7:20 pm. President Pro-tem Campbell presided over the meeting. The Clerk read Ordinance 2012-24 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County to Rezone Certain Real Estate from R2 to MRU), St. Anthony Healthcare, Petitioner,1205 N 14th Street) by title only on first and final reading. Councilman Brown moved for passage, Councilman Downing seconded. Councilman Klinker stated that he would be abstaining from the vote. Joe Bumbleburg, Attorney for petitioner spoke on behalf of them. They were unable to attend due to an unexpected health issue. Ordinance 2012-24 passed 7-0 with one abstention on a roll call vote as follows on first and final reading. Ayes: Heide, Reynolds, Brown, Ahlersmeyer, Weast-Williamson, Downing and Campbell Nays: none Abstention: Klinker The Clerk read Ordinance 2012-25 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County to Rezone Certain Real Estate from R1 to NB), Owenmarie, LLC, Petitioner, 3512 Union Street by title only on first and final reading. Councilman Downing moved for passage, Councilwoman Weast- Williamson seconded. Pro-Tem Councilman Campbell read a letter into the minutes that the petitioner requested to table this Ordinance until the Nov.5, 2012 regular council meeting. Councilman Klinker moved to table until Nov.5, 2012 Councilwoman Ahlersmeyer seconded, passed by unanimous voice vote. The Clerk read Ordinance 2012-26 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County to Rezone Certain Real Estate from R2 to NBU), Larry Mathew, Petitioner, 901 South Street by title only on first and final reading. Councilman Klinker moved for passage, Councilman Reynolds seconded. Larry Mathew, petitioner spoke regarding the Ordinance and the commitments that were attached to the Ordinance. Sandy Lahr, 820 Kossuth spoke in favor the rezone. Sallie Fahey, Area Plan Commission also spoke and explained the commitments along with City Attorney Ed Chosnek. Mrs. Fahey requested the City Clerk send a certification with the letter of commitment. Ordinance 2012-26 passed 8-0 on a roll call vote on first and final reading. Councilman Meyer returned to the meeting at 7:36 pm. The Clerk read Ordinance 2012-27 (An Ordinance to Amend Section 2.01.260 of the Lafayette Municipal Code-Council Districts) by title only on first reading. Councilwoman Weast-Williamson moved for passage, Councilwoman Ahlersmeyer seconded. President Meyer spoke regarding the changes needed after the updated 2010 census was completed. The goal was to equal the districts by population and avoid splint precincts. Councilman Reynolds questioned some areas of change. Sallie Fahey, Area Plan Commission spoke regarding why certain areas were changed. Christa Coffey, Tippecanoe County Clerk, thanked the council for making things easier for the voters. Perry Barbee, 3700 Redbud, spoke regarding the ordinance. Ordinance 2012-27 passed 7-1 on a roll call vote as follows on first reading. Ayes: Heide, Klinker, Campbell, Brown, Ahlersmeyer, Weast-Williamson and Downing Nays: Reynolds The Clerk read Ordinance 2012-28 (An Ordinance of the Common Council of the City of Lafayette, Indiana, Authorizing the Issuance of the City of Lafayette, Indiana Economic Development Revenue Bonds, Series 2012 (Metro Fibernet Project), and the Use of the Proceeds Thereof to Support Metro Fibernet Projects, and Authorizing and Approving Other Actions in Respect Thereto) by title only on first reading. Councilman Campbell moved for passage, Councilman Klinker seconded. Mayor Roswarski spoke regarding the positive effects this project will have on our community. Richard Starkey, Bond Council, Barnes and Thornburg explained the bonding process to the council and answered questions. Steve Biggerstaff, Metro Fibernet answered council questions regarding the benefits for homeowners. Ordinance 2012-28 passed 8-0 on a roll call vote on first reading. There were no Resolutions. There were no Reports of Standing Committees. No Reports of Special Committees. Report by the Mayor: Mayor Roswarski announced the retirement of Police Chief Don Roush and thanked him for his years of service. Chief Roush thanked the Mayor and the City Council for having the opportunity to serve. There was no Miscellaneous and New Business: There were no Reports of Council. There was no public comment. Councilman Campbell moved to adjourn Councilman Klinker seconded.
