MINUTES OF THE LAFAYETTE COMMON COUNCIL Monday October 22, 2012 SPECIAL MEETING The Common Council of the City of Lafayette, Indiana met in special session on Monday, October 22, 2012 at 5:00 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Meyer called the meeting to order at 5:00 pm. The Pledge of Allegiance was given to the flag of our Country The following members were present: Present: Heide, Klinker, Reynolds, Campbell, Brown, Ahlersmeyer, Weast-Williamson, Downing and Meyer The City Clerk stated that there was a quorum present. City Clerk Cindy Murray and City Attorney Ed Chosnek were present. Ordinances for second reading: The Clerk read Ordinance 2012-18 (2013 Budget Ordinance, an Ordinance Appropriating Money for the Purpose of Defraying the Expenses of Several Departments of the City Government of the City of Lafayette, Indiana for the Fiscal year Beginning January 1, 2013 and Ending December 31, 2013, Including the Outstanding Claims and Obligations and Fixing a Time When the Same Shall Take Effect) by title only on second and final reading. Councilman Brown moved for passage, Councilwoman Weast- Williamson seconded. Mayor Roswarski spoke regarding the Budget and requested to amend the Ordinance in its entirety with a new exhibit A. Councilman Campbell moved to Amend, Councilman Klinker seconded. The motion to amend passed 8-0 on a roll call vote. Ordinance 2012-18amended passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2012-19 (An Ordinance Fixing the Salaries of the Elected Officials of the City of Lafayette, Indiana for the Year 2013) by title only on second and final reading. Councilman Campbell moved for passage, Councilman Heide seconded. Perry Barbee, 3700 Redbud spoke in opposition to the ordinance. Ordinance 2012-19 passed 5-3 on a roll call vote as follows on second and final reading. Ayes: Heide, Campbell, Ahlersmeyer, Weast-Williamson, and Downing Nays: Klinker, Reynolds and Brown The Clerk read Ordinance 2012-20 (An Ordinance Fixing the Salaries of the Appointed Officers and Employees of the City of Lafayette, Indiana, for the Year 2013, Excluding the Sworn Protective Occupation and Law Enforcement Members of the Police and Fire Departments) by title only on second and final reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Ordinance 2012-20 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2012-21 (An Ordinance Fixing the Salaries of the Sworn Protective Occupation and Law Enforcement (POLE) Members of the Police and Fire Departments of the City of Lafayette, Indiana for the Year 2013) by title only on second and final reading. Councilman Heide moved for passage, Councilman Reynolds seconded. Ordinance 2012-21 passed 7-0 with one abstention on a roll call vote as follows on second and final reading. Ayes: Heide, Klinker, Reynolds, Campbell, Brown, Ahlersmeyer and Downing Abstention: Weast-Williamson. The Clerk read Ordinance 2012-28 (An Ordinance of the Common Council of the City of Lafayette, Indiana, Authorizing the Issuance of the City of Lafayette, Indiana Economic Development Revenue Bonds, Series 2012 (Metro Fibernet Project), and the Use of the Proceeds Thereof to Support Metro Fibernet Projects, and Authorizing and Approving Other Actions in Respect Thereto) by title only on second and final reading. Councilman Klinker moved for passage, Councilman Campbell seconded. Mayor Roswarski spoke regarding the project and the positive affect it will have on the community. Ordinance 2012-28 passed 8-0 on a roll call vote on second and final reading. Resolutions: The Clerk read Resolution 2012-25 (A Resolution of the Common Council of the city of Lafayette, Indiana Approving Certain Matters in Connection with the Formation of a Certain Development Area) by title only on first and final reading. Councilman Campbell moved for passage, Councilman Klinker seconded. Ed Chosnek, City Attorney spoke regarding the Resolution. Resolution 2012-25 passed 8-0 on a roll call vote on first and final reading. No public comment was heard. Councilman Campbell moved to adjourn and reconvene for a public meeting regarding Durkees Run and Earl Avenue CSO Councilman Klinker seconded.
