MINUTES OF THE LAFAYETTE COMMON COUNCIL November 5, 2012 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday November 5, 2012 at 7:00 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Meyer called the meeting to order at 7:00 pm. The Pledge of Allegiance was given to the flag of our Country. The following members were present: Present: Heide, Klinker, Reynolds, Campbell, Brown, Ahlersmeyer, Downing and Weast-Williamson, and Meyer City Clerk Cindy Murray and City Attorney Ed Chosnek were present The City Clerk stated that there was a quorum present. Councilman Campbell moved to approve the minutes of October 1, 2012 meeting and the October 22, 2012 Special meeting. Councilman Reynolds seconded. There were no additions or corrections. Minutes approved by unanimous voice vote. The Clerk stated there were no Claims, Petitions or Communications. The Clerk stated the following reports are available in the City Clerk’s Office and on the City Website. Clerk’s Office Monthly-September Water Works Department Monthly-September Water Pollution Control Department Monthly-September Fleet Maintenance/Motor Vehicle Department Monthly-September Ordinances for Second Reading: President Meyer announced that Ordinance 2012-25 had been tabled from October 1, 2012 regular council meeting along with a letter that was sent to the City Clerk requesting to withdraw their request. Councilman Campbell moved to remove Ordinance 2012-25 from the table Councilman Brown seconded. A roll call vote was taken to remove from the table. The Clerk read Ordinance 2012-25 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County to Rezone Certain Real Estate from R1 to NB), Owenmarie, LLC, Petitioner, 3512 Union Street by title only on second and final reading. Councilman Campbell moved for passage, Councilwoman Weast-Williamson seconded. Ordinance 2012-25 Failed 0-8. The Clerk read Ordinance 2012-27 (An Ordinance to Amend Section 2.01.260 of the Lafayette Municipal Code-Council Districts) by title only on second and final reading. Councilwoman Ahlersmeyer moved for passage, Councilwoman Weast-Williamson seconded. Ordinance 2012-27 passed 7-1 on a roll call as follows vote on second and final reading. Ayes: Heide, Klinker, Campbell, Brown, Ahlersmeyer, Weast-Williamson and Downing Nays: Reynolds Ordinances for First Reading: The Clerk read Ordinance 2012-29 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana-UZO Amendment #74-Farm Drainage Title Contractor) by title only on first and final reading. Councilman Klinker moved for passage, Councilman Heide seconded. Ed Chosnek, City Attorney spoke regarding the Ordinance and the changes. Ordinance 2012-29 passed 8-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2012-30 (An Ordinance of the Common Council of the City of Lafayette, Indiana Approving the Issuance of Park District Refunding Bonds) by title only on first reading. Councilman Heide moved for passage, Councilwoman Weast-Williamson seconded. Mayor Roswarski spoke regarding the Ordinance. Loren Matthes, H.J Umbaugh, Financial Advisor spoke regarding the rate changes and the cost savings for the city. Julie Boling, Krieg/Devault, Bond Council explained the legal process of refinancing the bonds. Ordinance 2012-30 passed 8-0 on a roll vote on first reading. The Clerk read Ordinance 2012-31 (An Ordinance Authorizing the Acquisition, Construction, Installation and Equipping by the City of Lafayette, Indiana of Certain Improvements and Extensions to the Sewage Works of the City, the Issuance and Sale of Revenue Bonds to Provide Funds for the Payment of the Costs Thereof, the Issuance and Sale of Bond Anticipation Notes in Anticipation of the Issuance and Sale of Such Bonds, and the Collection Segregation and Distributions of the Revenue of Such Sewage Works, the Safeguarding of the Interests of the Owners of the Revenue Bonds, and Other Related Matters, Including Repealing Ordinances Inconsistent Herewith) by title only on first reading. Councilwoman Ahlersmeyer moved for passage, Councilman Brown seconded. Mayor Roswarski spoke regarding the Ordinance. Jenny Miller, City engineer, presented a detailed report of the project. Hans Steck, Bingham Greenebaum and Doll, explained the purchase and process of issuing Revenue Bonds. Ordinance 2012- 31 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2012-32 (Amendment to Ordinance No. 85-12, as Last Amended by Ordinances 2006-01, Concerning Charges for Sewerage Services) by title only on first reading. Councilman Campbell moved for passage, Councilman Reynolds seconded. Mayor Roswarski spoke regarding the rates changes required for the issuance of the Sewage Works Revenue Bonds. John Skomp, Crowe Howarth, Financial Advisor explained the rate increases and how they were determined. Rita Holman 3874 Rome Drive spoke in opposition to the rate increases. Perry Barbee, 3700 Redbud spoke in opposition to the Ordinance. Ordinance 2012-32 passed 8-0 on a roll call vote on first reading. Councilman Campbell moved to set a Public Hearing on Ordinance 2012-32 on Monday December 3, 2012 at 7:01 PM, Councilman Brown seconded. The motion passed by unanimous voice vote. The Clerk read Ordinance 2012-33 (An Ordinance for An Additional Appropriation of Local Roads and Streets Funds) by title only on first reading. Councilman Campbell moved for passage, Councilman Klinker seconded. Mike Jones, Controller spoke regarding the Ordinance. Ordinance 2012-33 passed 8-0 on a roll call vote on first reading. Resolutions: The Clerk read Resolution 2012-26 (2013 Common Council Calendar of Meetings) by title only on first and final reading. Councilwoman Weast-Williamson moved for passage, Councilwoman Ahlersmeyer seconded. Cindy Murray, City Clerk spoke regarding the Resolution. Resolution 2012-26 passed 8-0 on a roll call vote on first and final reading. The Clerk read Resolution 2012-27 (Resolution of the Common Council of the City of Lafayette, Indiana Approving Issuance of Lafayette Redevelopment District Refunding Bonds for 2012) by title only on first and final reading. Councilwoman Ahlersmeyer moved for passage, Councilman Downing seconded. Mayor Roswarski spoke regarding the Resolution. Resolution 2012-27 passed 8-0 on a roll call vote on first and final reading. There were no Reports of Standing Committees. There were no Reports of Special Committees. There was no comment by the Mayor. President Meyer recognized the new Police Chief Patrick Flannelly and congratulated him on behalf of the Council. Miscellaneous and New Business: Kristen Clawson, Purdue University Student spoke regarding a Purdue Dance Marathon taking place on November 17th through November 18th to raise funds for Riley Hospital for Children. There were no Reports of Council. Public comment: Earl Stanton. 1013 Elizabeth Street questioned future uses for Market Square. Cindy Murray, City Clerk and the Mayor’s Youth Council along with Ryan Smith and Sharon Blackwell of Butler, Fairman and Siefert presented an overview of the Master Trail Plan. Members of the Youth Council spoke of how they created some of the names for the trails. Councilman Heide moved to adjourn Councilman Klinker seconded.
