MINUTES OF THE LAFAYETTE COMMON COUNCIL December 3, 2012 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday December 3, 2012 at 7:00 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Meyer called the meeting to order at 7:00 pm. The Pledge of Allegiance was given to the flag of our Country with the assistance of Boy Scout Troop #343 from Buck Creek. The following members were present: Present: Heide, Klinker, Reynolds, Campbell, Brown, Downing and Weast-Williamson, and Meyer Absent: Ahlersmeyer City Clerk Cindy Murray and Deputy City Attorney Jacque Chosnek were present. The City Clerk stated that there was a quorum present. Councilman Campbell moved to recess for public hearing on Ordinance 2012-32 (Amendment to Ordinance No. 85-12, as Last Amended by Ordinance 2006-01, Concerning Charges for Sewerage Services) Councilman Klinker seconded. Christine Hoggett, 834 Red Oaks Lane questioned the rate, Mayor Roswarski spoke answering her questions about the rate, which did not affect her. No other public comment was heard. Councilman Campbell moved to reconvene the regular meeting. Councilman Klinker seconded. The motion passed by unanimous voice vote. Councilman Campbell moved to recess for public hearing of Ordinance 2012-33 (an Ordinance for an Appropriation of Local Roads and Street funds). Councilman Klinker seconded. No public comment was heard. Councilman Campbell moved to reconvene to regular meeting, Councilwoman Weast-Williamson seconded. The motion passed by unanimous voice vote. Councilman Campbell moved to approve the minutes of November 5, 2012 meeting. Councilman Brown seconded. There were no additions or corrections. Minutes approved by unanimous voice vote. Councilman Heide moved for passage, Councilman Klinker seconded. Mayor Roswarski spoke regarding the ordinance. Ordinance 2012-30 passed 7-0 on a roll vote on second and final reading. The Clerk read Ordinance 2012-31 (An Ordinance Authorizing the Acquisition, Construction, Installation and Equipping by the City of Lafayette, Indiana of Certain Improvements and Extensions to the Sewage Works of the City, the Issuance and Sale of Revenue Bonds to Provide Funds for the Payment of the Costs Thereof, the Issuance and Sale of Bond Anticipation Notes in Anticipation of the Issuance and Sale of Such Bonds, and the Collection Segregation and Distributions of the Revenue of Such Sewage Works, the Safeguarding of the Interests of the Owners of the Revenue Bonds, and Other Related Matters, Including Repealing Ordinances Inconsistent Herewith) by title only on second and final reading. Councilman Downing moved for passage, Councilwoman Weast-Williamson seconded. Mayor Roswarski spoke regarding the ordinance. Ordinance 2012-31 passed 7-0 on a roll call vote on second and final reading. Ordinance 2012-33 passed 7-0 on a roll call vote on second and final reading. Ordinances for First Reading: The Clerk read Ordinance 2012-34 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County to Rezone Certain Real Estate from R1B to R1U-City of Lafayette Petitioner, 2040 Monon Avenue) by title only on first and final reading. Councilman Downing moved for passage, Councilman Brown seconded. Dennis Carson, Director Economic Development spoke regarding this ordinance. Ordinance 2012-34 passed 7-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2012-35 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County to Rezone Certain Real Estate from R2 to R2U-City of Lafayette Petitioner, 628 N 18th Street) by title only on first and final reading. Councilman Klinker moved for passage, Councilman Heide seconded. Dennis Carson, Director Economic Development spoke regarding this ordinance. Ordinance 2012-35 passed 7-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2012-36 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County to Rezone Certain Real Estate from R2 to R2U-City of Lafayette Petitioner, 1319 North 18th Street) by title only on first and final reading. Councilman Klinker moved for passage, Councilman Heide seconded. Ordinance 2012-36 passed 7-0 on a roll call vote on first and final reading. Resolutions: The Clerk read Resolution 2012-28 (A Resolution Approving the Lafayette Master Trails Plan) by title only on first and final reading. Councilman Campbell moved for passage, Councilman Weast-Williamson seconded. Cindy Murray, City Clerk spoke regarding the Resolution. Travis Butts, 4004 Penny Packers Mill Rd. spoke in support of the Master Trail Plan. Resolution 2012- 28 passed 7-0 on a roll call vote on first and final reading. The Clerk read Resolution 2012-29 (A Resolution Adopting a Comprehensive Plan Amendment for Historic Centennial Neighborhood Land Use Plan) by title only on first and final reading. Councilman Campbell moved for passage, Councilman Brown seconded. Ryan O’Gara, Area Plan Commission, Jackie Turner and Ben Ross, Ratio Architects gave a brief presentation of the Comprehensive Plan. Resolution 2012-29 passed 7-0 on a roll call vote on first and final reading. The following citizens spoke in support of the Plan Michael Hunt, 602 N 5th Street Stuart Frescas, 421 Brown Street Perry Barbee, 3700 Redbud The Clerk read Resolution 2012-30 (A Resolution of the Common Council of the City of Lafayette, Indiana, Authorizing the Participation of Said City in the Motor Fuel Budgeting Program of the Indiana Bond Bank for the 2013 Budget Year, the Execution of the Qualifying Entity Reimbursement Agreement in Connection Therewith and Other Related Matters) by title only on first and final reading. Councilman Downing moved for passage, Councilwoman Weast- Williamson seconded. Mike Jones, Controller spoke regarding the resolution. Resolution 2012- 30 passed 7-0 on a roll call vote on first and final reading. There were no Reports of Standing Committees. There were no Reports of Special Committees. There was no comment by the Mayor. Miscellaneous and New Business: President Meyer thanked the Street, Police and Fire Departments for their assistance in coordinating the Lafayette Christmas Parade on Sunday. There were no Reports of Council. There was no public comment. Councilman Campbell moved to adjourn Councilman Klinker seconded.
