MINUTES OF THE LAFAYETTE COMMON COUNCIL March 4, 2013 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday March 4, 2013 at 7:00 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Campbell called the meeting to order at 7:00 pm. The Pledge of Allegiance was given to the flag of our Country led by Will Jones, currently working on his Eagle Scout Badge. The following members were present: Present: Heide, Klinker, Meyer, Reynolds, Brown, Ahlersmeyer, Weast-Williamson, Downing and Campbell. City Clerk Cindy Murray and City Attorney Ed Chosnek were present. The City Clerk stated that there was a quorum present. Councilman Meyer moved to approve the minutes of February 4, 2013 common council meeting Councilman Klinker seconded. There were no additions or corrections. Minutes approved by unanimous voice vote. The Clerk stated there were no Claims, Petitions or Communications. The Clerk stated the following reports are available in the City Clerk’s Office: Clerk’s Office Monthly-January Water Works Department Monthly-January Water Pollution Control Department Monthly-January Fleet Maintenance/Motor Vehicle Department Monthly-January Police Department Monthly-January Lafayette Redevelopment Commission Annual Report-2012 Lafayette Fire Department Annual Report 2012 Lafayette Parks and Recreation Department Annual Report-2012 There are Ordinances for Second Reading Ordinances for First Reading The Clerk read Ordinance 2013-04 (An Ordinance of the City of Lafayette Common Council, Approving an Amended and Restated Lease Between the Lafayette Redevelopment Authority and the Lafayette Redevelopment Commission, Pledging the City’s Share of the Economic Development Income Tax, and Related Matters-Brady Lane Project) by title only on first and final reading. Councilman Klinker moved for passage, Councilman Brown seconded. Kostas Poulakidas, partner with Krieg DeVault presented the bonds that are being considered for refinancing to obtain a lower interest rate, and explained that the savings over the life of the bonds are significant enough to warrant refunding. Jason Semler, Principal with H. J. Umbaugh explained the financial savings and the amortization schedule. Mr. Semler stated that with this refinancing the city would save $75,000.00 per year. Councilman Meyer requested clarification on the property tax backup for these bonds. Mr. Semler responded the 2003 series B does have a tax backup, the 2004 does not. Umbaugh is proposing a property tax backup on both bonds to allow for better interest rates. Ordinance 2013-04 passed 8-0 on a roll call vote on first reading. Mayor Roswarski requested the suspension of the rules to hear the Ordinances 2013-04 and 2013-05 for second reading to allow the bonds to get to market, to obtain and have the ability to lock into a lower interest rate. Councilman Meyer moved to suspend the rules to hear this Ordinance for second reading, Councilman Heide seconded. The motion passed 8-0 on a roll call vote. Councilman Meyer moved for passage of Ordinance 2013-04 on second and final reading, Councilman Reynolds seconded. Ordinance 2013-04 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2013-05 (An Ordinance of the City of Lafayette, Indiana Common Council, Approving an Amended and Restated Lease Between the Lafayette Redevelopment Authority and the Redevelopment Commission-Creasy Treece Project) by title only on first reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Jason Semler, Principal H.J. Umbaugh spoke regarding the savings with the refinancing of these bonds. President Campbell asked what the annual savings would be with this refinancing. Mr. Semler responded $115,000.00 per year. Ordinance 2013-05 passed 8-0 on a roll call vote on first reading. Councilman Meyer moved to suspend the rules to hear this Ordinance for second reading, Councilman Klinker seconded. The motion passed 8-0 on a roll call vote. Councilman Meyer moved for passage of Ordinance 2013-05 on second and final reading, Councilman Brown seconded. Ordinance 2013-05 passed 8-0 on a roll call vote on second and final reading. Resolutions: The Clerk read Resolution 2013-04 (A Resolution Approving Interlocal Cooperation Agreement for Mutual Aid Box Alarm System Between the Members of the Tippecanoe County Firefighters Association) by title only on first and final reading. Councilman Downing moved for passage, Councilwoman Ahlersmeyer seconded. Richard Doyle, Lafayette Fire Chief spoke regarding the changes in the agreement. Resolution 2013-04 passed 8-0 on a roll call vote on first and final reading. The Clerk read Resolution 2013-05 (A Resolution Approving Interlocal Cooperation Agreement Between the City of Lafayette and Greater Lafayette Public Transportation Corporation) by title only on first and final reading. Councilwoman Weast Williamson moved for passage, Councilwoman Ahlersmeyer seconded. Mr. Chosnek requested that the record to reflect, that on page 22 of the agreement item 24a, the participation goal for disadvantage business enterprise should be changed from 1.46% to 2%. Jenny Leshney, City Engineer explained this grant is for New Freedom Funds which will allow ADA access ramps for the Riehle Plaza railroad bridges. These ramps will allow access from both sides of the plaza in the event the elevator is not operational. Councilman Meyer questioned if the grant would cover the entire cost of the project. Mrs. Leshney replied it would only cover a portion of the costs which have not yet been estimated. The city would then have to seek a way to cover the rest of the costs. Resolution 2013-05 passed 8-0 on a roll call vote on first and final reading. There were no Reports of Standing Committees: There were no Reports of Special Committees: Report by the Mayor: Mayor Roswarski presented Laura M. Bartrom of the St. Lawrence/McAllister Neighborhood with the Marquis de Lafayette for her years of dedication and service to the community and neighborhood. There was no Miscellaneous or New Business: Reports of Council: Councilman Downing complimented Jenny Leshney, of Engineering Department for her departments work with a street light project in his area. Mr. Downing thanked Jule’ Collins and Stanley Knight, Ordinance Enforcement, Engineering Department for their hard work. Councilman Klinker reminded everyone March is Red Cross Hero’s month. Public Comment: Lloyd Wells, 3717 Rawlings expressed concern about sanitation pickup in his neighborhood. Robert Kelly, 124 Eastland Dr. expressed concern regarding some project work going on in his neighborhood by T-Bird Design. President Campbell suggested Mr. Kelly set up a meeting with Mayor Roswarski and Jenny Leshney, City Engineer. Councilman Heide moved to adjourn Councilman Klinker seconded.
