MINUTES OF THE LAFAYETTE COMMON COUNCIL April 1, 2013 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday April 1, 2013 at 7:00 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Campbell called the meeting to order at 7:00 pm. The Pledge of Allegiance was given to the flag of our Country. The following members were present: Present:, Klinker, Meyer, Reynolds, Brown, Ahlersmeyer, Weast-Williamson, Downing and Campbell. Absent- Heide City Clerk Cindy Murray and City Attorney Ed Chosnek were present. The City Clerk stated that there was a quorum present. Councilwoman Weast-Williamson moved to approve the minutes of March 4, 2013 common council meeting Councilman Downing seconded. There were no additions or corrections. Minutes approved 7-0 on a roll call vote. The Clerk stated there were no Claims, Petitions or Communications. The Clerk stated the following reports are available in the City Clerk’s Office: Clerk’s Office Monthly-February Water Works Department Monthly-February Water Pollution Control Department Monthly-February Fleet Maintenance/Motor Vehicle Department Monthly-February Water Pollution Control Department Annual Report-2012 There are no Ordinances for Second Reading Ordinances for First Reading The Clerk read Ordinance 2013-06 (An Ordinance Amending Chapter 4.06 of the Lafayette Municipal Code Entitled “Lafayette Farmer’s Market”) by title only on first reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Councilman Meyer spoke regarding the proposed Ordinance and explained the reason for the changes. Perry Barbee 3700 Redbud questioned if the violations were isolated incidents or if this was a chronic problem. Pearl Speakman 923 So.22nd Street was concerned with who would be paying for the new signage at Farmers Market, and he was opposed to the city paying for the signs. Councilman Meyer stated that he would speak with the Farmers Market managers about the cost of signage. Ordinance 2013-06 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2013-07 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana-UZO Amendment #75-Zoning Commitments) by title only on first and final reading. Councilman Klinker moved for passage, Councilman Meyer seconded. Ed Chosnek, City Attorney spoke regarding the ordinance. Ordinance 2013-07 passed 7-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2013-08 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from I3 to GB-INOK Investments- 3589 Sagamore Parkway North) by title only on first and final reading. Councilman Downing moved for passage, Councilman Brown seconded. Councilman Meyer left the council chamber at 7:10pm due to conflict of interest. Joe Bumbleburg, Attorney for the petitioner spoke regarding the future plans for the area. Ordinance 2013-08 passed 6-0 on a roll call vote on first and final reading. Councilman Meyer returned to the chamber at 7:17pm. The Clerk read Ordinance 2013-09 (An Ordinance concerning the refunding by the City of Lafayette, Indiana of its Sewage Works Revenue Bonds of 2000, Sewage Works Revenue Bonds of 2001, Series A, and Sewage Works Revenue Bonds of 2006, authorizing the issuance of sewage works refunding revenue bonds for such purpose; providing for the collection, segregation and distribution of the revenues of the sewage works and the safeguarding of the interests of the owners of said sewage works refunding revenue bonds; other matters connected therewith; and repealing ordinances inconsistent herewith) by title only on first reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Mike Jones, Controller spoke regarding the historically low interest rates and that could contribute to a savings of over 5 million dollars with the refinancing of the above mentioned bonds. Landon Boehm, PiperJaffray Financing Team, presented the Interest Rate Review and the Aggregate Savings Analysis showing the preliminary savings to the city of $5.62 million. Jennifer Wilson, Crowe Financial Advisor also spoke regarding the cost savings involved with the refunding. Tony Setzer, Attorney with Bose McKinney Bond Counsel for the project, spoke regarding the timeline for pricing and the closing of the bonds. President Campbell inquired if the council would be given the final rate of savings at the May meeting. Mr. Setzer replied the final rate will not be established until after the second reading and prior to the closing in May; the council would be approving a rate of not over six percent (6%) however the anticipated rate is much lower. Ordinance 2013-09 passed 7-0 on a roll call vote on first reading. Resolutions: The Clerk read Resolution 2013-07 (A Resolution of the City of Lafayette Common Council Approving Order of the Area Plan Commission) by title only on first and final reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Dennis Carson, Economic Development Director explained this is the third step in expanding the Creasy TIF and consolidating the Central TIF, adding 196 acres which includes the Home Hospital site, Murdock Park, Murdock School, Columbian Park and some surrounding areas to the Creasy district and consolidating with the Central TIF since it will be touching that area. Mr. Carson stated this will help the city to better participate in the development of the Home Hospital site and streamline line resources. Councilman Meyer asked if there had been any recent inquiries into the Home Hospital site. Mr. Carson answered the owners have had discussions with some interested parties but nothing is planned at this time. Resolution 2013-07 passed 7-0 on a roll call vote on first and final reading. There were no Reports of Standing Committees. There were no Reports of Special Committees. There was no Report by the Mayor. There was no Miscellaneous or New Business. There were no Reports of Council. Public Comment: Pearl Speakman, 923 S. 22nd St spoke regarding concerns over annexation and ordinance violations. Perry Barbee, 3700 Redbud questioned parking in front of City Hall. Councilman Downing moved to adjourn Councilman Klinker seconded.
