MINUTES OF THE LAFAYETTE COMMON COUNCIL May 6, 2013 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday May 6, 2013 at 7:00 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Campbell called the meeting to order at 7:00 pm. The Pledge of Allegiance was given to the flag of our Country. The following members were present: Present: Heide, Klinker, Meyer, Reynolds, Brown, Ahlersmeyer, Weast-Williamson, Downing and Campbell. City Clerk Cindy Murray and City Attorney Ed Chosnek were present. The City Clerk stated that there was a quorum present. Councilman Klinker moved to approve the minutes of April 1, 2013 common council meeting Councilman Meyer seconded. There were no additions or corrections. Minutes approved by unanimous voice vote. The Clerk stated there were no Claims, Petitions or Communications. The Clerk stated the following reports are available in the City Clerk’s Office: Clerk’s Office Monthly-March Water Works Department Monthly-March Water Pollution Control Department Monthly-March Police Department Monthly-March Fleet Maintenance/Motor Vehicle Department Monthly-March Ordinances for Second Reading The Clerk read Ordinance 2013-06 (An Ordinance Amending Chapter 4.06 of the Lafayette Municipal Code Entitled “Lafayette Farmer’s Market”) by title only on second and final reading. Councilman Meyer moved for passage, Councilman Klinker seconded. Council discussion ensued Ordinance 2013-06 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2013-09 (An Ordinance concerning the refunding by the City of Lafayette, Indiana of its Sewage Works Revenue Bonds of 2000, Sewage Works Revenue Bonds of 2001, Series A, and Sewage Works Revenue Bonds of 2006, authorizing the issuance of sewage works refunding revenue bonds for such purpose; providing for the collection, segregation and distribution of the revenues of the sewage works and the safeguarding of the interests of the owners of said sewage works refunding revenue bonds; other matters connected therewith; and repealing ordinances inconsistent herewith) by title only on second and final reading. Councilman Downing moved for passage, Councilwoman Weast-Williamson seconded. Representatives from PiperJaffray - Landon Boehm and Boze Mckinney-Dennis Otten gave a brief update on the bonds and the proposed interest rates. Ordinance 2013-09 passed 8-0 on a roll call vote on second and final reading. Ordinances for First Reading The Clerk read Ordinance 2013-10 (An Ordinance for Appropriation of Local Highway Use Tax Funds (County Wheel Tax (Fund # 249) by title only on first reading. Councilwoman Ahlersmeyer moved for passage, Councilman Brown seconded. Mayor Roswarski updated the council on the Union Street project that the funds will be used toward. Ordinance 2013-10 passed 8-0 on a roll call vote on first reading. Councilman Heide moved to set a public hearing for June 3, 2013 at 7:01pm, Councilman Klinker seconded. The motion passed by unanimous voice vote. The Clerk read Ordinance 2013-11 (An Ordinance to Amend Ordinance 2012-20 An Ordinance Fixing the Salaries of the Appointed Officers and Employees of the City of Lafayette, Indiana for the Year 2013, Excluding the Sworn Protective Occupation and Law Enforcement Members of the Police and Fire Department) by title only on first reading. Councilman Klinker moved for passage, Councilman Reynolds seconded. Pat Flannelly, Chief of Police and IT Director Andy Milam spoke and explained the changes in the ordinance with it being an IT position and coordinating that with the police department. Discussion ensued with council members. Ordinance 2013-11 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2013-12 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana-UZO Amendment # 76-Agricultural Rental Halls) by title only on first and final reading. Councilwoman Ahlersmeyer moved for passage, Councilman Reynolds seconded. Ed Chosnek, City Attorney spoke regarding the additional language to the Ordinance. Ordinance 2013-12 passed 8-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2013-13 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from R1B, R2 and R3 to R1U, R2U and R3U-Monon Neighborhoods) by title only on first and final reading. Councilman Brown moved for passage, Councilman Downing seconded. Aimee Jacobsen, Community Development spoke regarding the ordinance. Ordinance 2013-13 passed 8-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2013-14 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from I3 to GB-Eva Gaeta, Petitioner) by title only on first and final reading. Councilman Downing moved for passage, Councilwoman Weast-Williamson seconded. Tim Broden attorney spoke on behalf of the petitioner. Ordinance 2013-14 passed 8-0 on a roll call vote on first and final reading. Resolutions: The Clerk read Resolution 2013-08 (A Resolution to Approve the Lafayette Housing Consortium Home Program and the Lafayette Community Development Block Grant Action Plan for 2013) by title only on first and final reading. Councilwoman Ahlersmeyer moved for passage, Councilman Brown seconded. Aimee Jacobsen, Community Development spoke regarding the Resolution. Resolution 2013-08 passed 8-0 on a roll call vote on first and final reading. The Clerk read Resolution 2013-09 (Resolution of the City of Lafayette Common Council Regarding Approval of Expansion of Economic Development Area) by title only on first and final reading. Councilman Heide moved for passage, Councilman Klinker seconded. Mayor Roswarski spoke regarding the consolidation of these two TIF districts. Resolution 2013-09 passed 8-0 on a roll call vote on first and final reading. There were no Reports of Standing Committees: There were no Reports of Special Committees: Report by the Mayor: Mayor Roswarski reminded everyone of the Community Meeting regarding Home Hospital at Jenks Rest on Tuesday May 7th at 6:00pm and the SIA announcement on Wednesday May 8th at 10:00am. Miscellaneous or New Business: Councilman Meyer moved to appoint Jack Walkey to the Police Civil Service Commission. Councilman Klinker seconded. The motion passed by roll call vote 8-0. There were no Reports of Council: Public Comment: Lloyd Wells 3717 Rawlings Dr. spoke regarding towing enforcement. Perry Barbee, 3700 Redbud praised the crews working on the recent water main breaks, reminded everyone of Clean Sweep on Saturday June 1st and wished all the mothers a Happy Mother’s Day. Councilman Heide moved to adjourn Councilman Klinker seconded.
