MINUTES OF THE LAFAYETTE COMMON COUNCIL July 1, 2013 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday July 1, 2013 at 7:00 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Campbell called the meeting to order at 7:00 pm. The Pledge of Allegiance was given to the flag of our Country. The following members were present: Present: Heide, Klinker, Meyer, Reynolds, Brown, Ahlersmeyer, Weast-Williamson, Downing and Campbell. City Clerk Cindy Murray and City Attorney Ed Chosnek were present. The City Clerk stated that there was a quorum present. Councilman Klinker moved to approve the minutes of June 3, 2013 common council meeting Councilman Heide seconded. There were no additions or corrections. Minutes approved by unanimous voice vote. The Clerk stated there were no Claims, Petitions or Communications. The Clerk stated the following reports are available in the City Clerk’s Office: Clerk’s Office Monthly-May Water Works Department Monthly-May Water Pollution Control Department Monthly-May Fleet Maintenance/Motor Vehicle Department Monthly-May Police Department Monthly-April There are no Ordinances for Second Reading Ordinances for First Reading The Clerk read Ordinance 2013-16 (An Ordinance Amending Section 8.07.030 of the Lafayette City Code Weed and Rank Vegetation-Notice to Owner) by title only on first reading. Councilman Heide moved for passage, Councilman Reynolds seconded. Jacque Chosnek, Deputy Attorney spoke regarding the ordinance and explained the changes. Ordinance 2013-16 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2013-17 (An Ordinance Repealing Chapter 4.09-Peddlers, Transient Vendors, Solicitors and Beggars and Replacing it with New Chapter 4.09-Peddlers and Solicitors and New Chapter 4.16-Transient Merchants)) by title only on first reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Jacque Chosnek, Deputy Attorney spoke regarding the ordinance and explained the changes. Ordinance 2013-17 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2013-18 (An Ordinance Authorizing the City of Lafayette to Issue its “[Taxable] Economic Development Revenue Bonds, Series 2013 (LUEA Project)”) by title only on first reading. Councilman Meyer moved for passage, Councilwoman Weast-Williamson seconded. Dennis Carson spoke and gave a short PowerPoint presentation. Mayor Roswarski also spoke in favor of the Ordinance. Lisa Lee with Ice Miller Bond Counsel spoke regarding the bond and the events prior involving the Redevelopment Commission and how the bonds will be paid back by or through the Consolidated Creasy/ Central Lafayette Economic Development Area -Creasy- Treece sub-Allocation Area TIF (Tax Increment Financing) Lauren Matthes, from Umbaugh spoke regarding the bond and the financial structure, council discussion ensued. Ordinance 2013-18 passed 8-0on a roll call vote on first reading. The Clerk read Ordinance 2013-19 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana-UZO Amendment #77) by title only on first and final reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Ordinance 2013-19 passed 8-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2013-20 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from PDRS to R1B-Scheumann Properties, Petitioner-Brittany Chase PD) by title only on first and final reading. Councilman Brown moved for passage, Councilman Heide seconded. Dan Teder, attorney for petitioner spoke regarding the Ordinance. Lloyd Wells, 3717 Rawlings Drive questioned the location of the development. Ordinance 2013-20 passed 8-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2013-21 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from I3 to GB-Steve Norfleet, Petitioner-20.455 acres on Maple Point Drive) by title only on first and final reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Dan Teder, attorney for petitioner spoke regarding the rezone. Ordinance 2013-21 passed 8-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2013-22 (An Ordinance Amending Sections Within Chapter 3.03; Chapter 8.03; Chapter 13.01 and Chapter 13.02 as They Pertain to Inspections and Fees) by title only on first reading. Councilman Meyer moved for passage, Councilman Klinker seconded. Councilwoman Ahlersmeyer moved to send the Ordinance to the Ordinance special council meeting for further review Councilman Meyer seconded. The motion passed by unanimous voice vote. There are no Resolutions. There were no Reports of Standing Committees. There were no Reports of Special Committees. Councilman Kevin Klinker Chairperson for the Annexation, Redevelopment and Zoning Committee reported that the committee had met twice and had reached a recommendation for the council. The recommendation is to have Ed Chosnek, City Attorney file a Resolution for the August meeting which the Council will then forward to the Area Plan Commission Ordinance committee for review of the language change as follows: Multiple R2 Zoning would be allowed on one lot. There was no Report by the Mayor. There was no Miscellaneous or New Business: Reports by Council: Councilman Meyer noted the Central Catholic Knight’s Boys Baseball Team had won the State Championship and requested the Clerk send them a letter of congratulations. Public Comment: Darrelyn Carte, 1116 Hedgewood Dr questioned when the 4th of July Celebration might return to Slayer Hill at Purdue University. Mayor Roswarski responded, the expenses involved with Purdue made it cost prohibitive for the Stars and Strips Committee to return the festival to Purdue, therefore the Riehle Plaza site will most likely remain the permanent site.
