MINUTES OF THE LAFAYETTE COMMON COUNCIL November 4, 2013 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday November 4, 2013 at 7:00 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Campbell called the meeting to order at 7:00 pm. The Pledge of Allegiance was given to the flag of our Country. The following members were present: Present: Heide, Klinker, Meyer, Reynolds, Brown, Ahlersmeyer, Weast-Williamson, Downing and Campbell. City Clerk Cindy Murray and City Attorney Ed Chosnek were present. The City Clerk stated that there was a quorum present. President Campbell asked for a motion to rearrange the meeting agenda due to the K-9 in attendance. Councilman Brown moved to allow the change in the agenda, Councilman Klinker seconded. Police Chief Pat Flannelly, spoke regarding the retirement of TICO- the K-9 working dog. He is retiring due to age and health issues. He will be cared for in the home of his handler, A.J. Demello. Capt. Neil Dale presented Tico and Officer Demello with a plaque and gave an overview of Tico’s accomplishments with drug recovery statistics. The council thanked TICO and Officer A.J. Demello for their service with a standing ovation and applause. Councilman Downing moved to approve the minutes of October 7, 2013 October 9, 2013 and October 24, 2013 common council meeting Councilwoman Weast-Williamson seconded. There were no additions or corrections. Minutes approved by unanimous voice vote. The Clerk stated there were no Claims, Petitions or Communications. The Clerk stated the following reports are available in the City Clerk’s Office: Clerk’s Office Monthly-September Water Works Department Monthly-September Water Pollution Control Department Monthly-September Fleet Maintenance/Motor Vehicle Department Monthly-September Ordinances for Second Reading Councilman Meyer moved to remove Ordinance 2013-29 from the table and Councilman Klinker seconded. Motion passed by unanimous voice vote. The Clerk read Ordinance 2013-29 (A Ordinance to Vacate a Portion of the Public Right-of-Way in the City of Lafayette, Indiana-Larry Keller, Petitioner, a Portion of Land to the right of 1001 Queen Street) by title only on second and final reading. Councilman Meyer moved for passage, Councilman Reynolds seconded. Kevin Riley, attorney for petitioner spoke regarding the vacation and stated that the petitioner had made a $1000 offer for the property. The check was presented to Ed Chosnek, City Attorney. Ordinance 2013-29 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2013-30 (An Ordinance Amending Section 7.06.990 Penalties for Parking Violations) by title only on second and final reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Dennis Carson, Redevelopment Director spoke and asked if there were any further questions. Ordinance 2013-30 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2013-38 (An Amendment to Ordinance No. 2010-11 Establishing a Local Wabash Avenue Historic District in the City of Lafayette, Indiana) by title only on second and final reading. Councilman Klinker moved for passage, Councilman Meyer seconded. Aimee Jacobsen, Community Development spoke regarding the property owner’s unpaid property taxes, she stated that she had spoken with him and he will pay them in full in November. Councilman Klinker moved to table until December 2, 2013 regular council meeting. Councilman Meyer seconded. Motion to table until December 2, 2013 council meeting passed by unanimous voice vote Ordinances for First Reading The Clerk read Ordinance 2013-22 (An Ordinance Amending Section Within Chapter 3.04; Chapter 8.03; Chapter 13.01 and Chapter 13.02 as They Pertain to Inspection and Fees) by title only on first reading. Councilman Brown moved for the ordinance to be removed from the table. Councilman Meyer seconded. Motion passed by unanimous voice vote. Councilman Meyer moved to amend the ordinance in its entirety Councilman Brown seconded. Amendment passed 8-0 on a roll call vote. Councilman Meyer moved to hear amended ordinance, Councilman Reynolds seconded. Jenny Leshney, City Engineer spoke regarding the fee changes. Ron Ritchey, Lafayette Fire Department spoke regarding the fee schedule for fire inspections. Amended Ordinance 2013-22 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2013-39 (An Ordinance to Amend Chapter 7.06, Chapter 7.09 and Section 13.03.010 to Address Certain Parking Matters Including Yard Parking and Inoperable Vehicles) by title only on first reading. Councilman Downing moved for passage, Councilwoman Ahlersmeyer seconded. Mayor Roswarski spoke regarding the ordinance. Ordinance 2013-39 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2013-40 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from I3 to GB-W.K. Baldwin, Petitioner) 120 S. Farabee Dr. by title only on first reading. Councilwoman Ahlersmeyer moved for passage, Councilman Brown seconded. Dan Teder, attorney for the petitioner spoke regarding the rezone. Ordinance 2013-40 passed 8- 0 on a roll call vote on first and final reading. The Clerk read Ordinance 2013-41 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from PDCC to CB-City of Lafayette, Petitioner) 103 S.4th Street by title only on first reading. Councilman Klinker moved for passage, Councilman Downing seconded. Mayor Roswarski spoke regarding rezone. Ordinance 2013-41 passed 8-0 on a roll call vote on first and final reading. Resolutions: The Clerk read Resolution 2013-17 (A Resolution for the 2014 Common Council Calendar of Meetings) by title only on first and final reading. Councilman Reynolds moved for passage, Councilman Meyer seconded. Resolution 2013-17 passed 8-0 on a roll call vote on first and final reading. There were no Reports of Standing Committees: There were no Reports of Special Committees: There was Report by the Mayor: Miscellaneous or New Business: Aren Flint from The Davey Tree Group gave a short presentation on the City Tree Inventory. There were no Reports by Council. Public Comment: Perry Barbee, 3700 Redbud spoke. Councilman Heide moved to adjourn, Councilman Klinker seconded.
