MINUTES OF THE LAFAYETTE COMMON COUNCIL December 2, 2013 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday December 2, 2013 at 7:00 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Campbell called the meeting to order at 7:00 pm. The Pledge of Allegiance was given to the flag of our Country, led by Boy Scout Troop # 303 from St. Boniface. The following members were present: Present: Heide, Klinker, Reynolds, Brown, Ahlersmeyer, Weast-Williamson, Downing and Campbell. Absent: Meyer City Clerk Cindy Murray and City Attorney Ed Chosnek were present. The City Clerk stated that there was a quorum present. Councilman Downing moved to approve the minutes of November 4, 2013 common council meeting Councilwoman Ahlersmeyer seconded. There were no additions or corrections. Minutes approved by unanimous voice vote. The Clerk stated there were no Claims, Petitions or Communications. The Clerk stated the following reports are available in the City Clerk’s Office: Clerk’s Office Monthly-October Fleet Maintenance/Motor Vehicle Department Monthly-October Water Works Department Monthly-October Water Pollution Control Department Monthly-October Police Department Monthly- September and October Ordinances for Second Reading The Clerk read second amended Ordinance 2013-22 (An Ordinance Amending Section Within Chapter 3.04; Chapter 8.03; Chapter 13.01 and Chapter 13.02 as They Pertain to Inspection and Fees) by title only on second and final reading. Councilman Klinker moved for passage, Councilman Brown seconded. Ed Chosnek, City Attorney noted the following scrivener’s error: Paragraph 11, third line of table should read 2-3 yrs, Councilman Brown moved to amend the Ordinance to correct scriveners error, Councilman Heide seconded. The amendment passed by voice vote. Second Amended Ordinance 2013-22 passed 7-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2013-38 (An Amendment to Ordinance No. 2010-11 Establishing a Local Wabash Avenue Historic District in the City of Lafayette, Indiana) by title only on second and final reading. Councilman Brown moved for passage, Councilwoman Weast-Williamson seconded. Aimee Jacobsen, Community Development spoke regarding the petitioners delinquency in his property taxes, and recommended the council deny this request. Ordinance 2013-38 failed 0-7 on a roll call vote on second and final reading. The Clerk read Ordinance 2013-39 (An Ordinance to Amend Chapter 7.07, Chapter 7.09 and Section 13.03.010 to Address Certain Parking Matters Including Yard Parking and Inoperable Vehicles) by title only on second and final reading. Councilman Downing moved for passage, Councilwoman Ahlersmeyer seconded. Mayor Roswarski spoke regarding the ordinance. Ordinance 2013-39 passed 7-0 on a roll call vote on second and final reading. Ordinances for First Reading The Clerk read Ordinance 2013-42 (An Ordinance to Establish Fund 214 “Wellness Fund”) by title only on first reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Mike Jones, Controller spoke regarding the new Wellness fund. Perry Barbee, 3700 Redbud spoke regarding the Ordinance. Ordinance 2013-42 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2013-43 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana-UZO #79) by title only on first and final reading. Councilwoman Ahlersmeyer moved for passage, Councilman Reynolds seconded. Ordinance 2013-43 passed 7-0 on a roll call vote on first and final reading. Resolutions: The Clerk read Resolution 2013-18 (A Resolution of the Common Council of the City of Lafayette, Indiana, Recommending the Participation of Said City in the Motor Fuel Budgeting Program of the Indiana Bond Bank for the 2014 Budget Year, the Execution of the Qualified Entity Reimbursement Agreement in Connection Therewith and other Related Matters) by title only on first and final reading. Councilman Brown moved for passage, Councilman Heide seconded. Mike Jones, City Controller spoke regarding the Resolution. Resolution 2013-18 passed 7-0 on a roll call vote on first and final reading. The Clerk read Resolution 2013-19 (A Resolution Declaring the Designation of Certain Real Estate as an Economic Revitalization Area (ERA) and Approving the Application by Worwag Coatings LLC for Property Tax Abatement) by title only on first and final reading. Councilwoman Weast-Williamson moved for passage, Councilman Klinker seconded. Jodi Hamilton, Greater Lafayette Commerce spoke regarding the Resolution. Connie Hollis, Controller for Worwag, spoke regarding the company’s planned expansion. Mayor Roswarski spoke in support of the abatement. Resolution 2013-19 passed 7-0 on a roll call vote on first and final reading. The Clerk read Resolution 2013-20 (A Resolution Authorizing the Mayor of the City of Lafayette to Enter into an Interlocal Agreement with the City of West Lafayette, County of Tippecanoe and the Area Plan Commission of Tippecanoe County) by title only on first and final reading. Councilman Downing moved for passage, Councilman Reynolds seconded. Jenny Leshney, City Engineer spoke regarding an interlocal agreement to purchase of traffic counters to assist with future planning for transportation projects. Mrs. Leshney stated 80% of this project would be paid for by a federal grant and 20% by the various agencies, the city’s portion of the purchase would be $271.30. Resolution 2013-20 passed 7-0 on a roll call vote on first and final reading. There were no Reports of Standing Committees: There were no Reports of Special Committees. There was no Report by the Mayor. There was no Miscellaneous or New Business. There were no Reports by Council. Public Comment: President Campbell reviewed the public comment policy for city meetings for the visiting scout troop. Perry Barbee, 3700 Redbud, thanked the scouts for being here, commended the Street Department for continuing leaf pickup after the scheduled date. Mr. Barbee also reminded everyone of the Christmas Parade in downtown Lafayette on Sunday, December 8th at 2:00 PM. President Campbell wished everyone a Happy Holiday Season Councilman Heide moved to adjourn, Councilman Klinker seconded.
