MINUTES OF THE LAFAYETTE COMMON COUNCIL June 2, 2014 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday June 2, 2014 at 7:00 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Campbell called the meeting to order at 7:00 pm. The Pledge of Allegiance was given to the flag of our Country. The following members were present: Present: Reynolds, Campbell, Brown, Weast-Williamson, Downing and Meyer. Absent: Heide, Klinker and Ahlersmeyer City Clerk Cindy Murray and City Attorney Ed Chosnek were present. The City Clerk stated that there was a quorum present. Councilman Campbell moved to approve the minutes of the May 5, 2014 Council Meeting, Councilman Downing seconded. The motion passed by unanimous voice votes. Claims, Petitions or Communications: President Meyer stated a request was made to suspend the rules to hear Resolution 2014-07 which was filed after the deadline. Councilman Downing moved to allow Resolution 2014-07 to be heard, Councilwoman Weast-Williamson seconded. The motion passed by unanimous voice vote. President Meyer noted the rules are suspended and the Resolution would be heard at the appropriate time. The Clerk stated the following reports are available in the City Clerk’s Office: Clerk’s Office Monthly-April Fleet Maintenance Department Monthly-April Water Works Department Monthly-April Police Department Monthly-April and 2013 Annual Report Water Pollution Control Department Monthly-April Ordinances for Second Reading The Clerk read Ordinance 2014-08 (An Ordinance Establishing a 3 Feet Safe Passing Distance Between Motor Vehicles and Bicycles) by title only on second and final reading. Councilman Campbell moved for passage, Councilman Reynolds seconded. Ordinance 2014-08 passed 5-0 on a roll call vote on second and final reading. Ordinances for First Reading The Clerk read Ordinance 2014-11 (An Ordinance to Vacate an Alleyway in the City of Lafayette, Indiana-Eric Coleman, Petitioner) by title only on first reading. Councilman Campbell moved for passage, Councilwoman Weast-Williamson seconded. Kurt Laker, Attorney for the Petitioner spoke regarding the property and Mr. Coleman’s planned use. Councilman Campbell expressed opposition to vacating city owned property without monetary compensation and asked that a market analysis is done. Mr. Laker stated he had Kim Beazer, Century 21, local realtor to evaluate the value of the area and has an email stating each section of the property is worth $100.00. Mr. Laker stated he client is willing to pay compensation to the city for his and the three (3) adjacent neighbors for a total of $400.00. Councilman Campbell moved to amend the ordinance with the condition of payment to the city for $400.00 and a copy of the email stating the value of the area. Councilman Reynolds seconded, Councilwoman Weast- Williamson noted that #9 of Exhibit C states Pursuant to Resolution No. 97-14, the Petitioner is not required to pay compensation to the City of Lafayette in connection with the vacation of an Alley. President Meyer noted the amendment would remove that language. Amendment passed 5-0 on a roll call vote. Amended Ordinance 2014-11 passed 5-0 on a roll call vote on first reading. Councilwoman Weast-Williamson moved to set a public hearing for Monday, July 7, 2014 at 7:01 pm, Councilman Downing seconded. The motion passed by unanimous voice vote. Councilman Klinker arrived at 7:13pm The Clerk read Ordinance 2014-12 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from PDRS to R2, Timberstone Development LLC, 14.42 Acres in Expired Portion of Crosser Common PD) by title only on first and final reading. Councilman Reynolds moved for passage, Councilman Campbell seconded. Dan Teder, Attorney for the petitioner spoke regarding the planned use of the Development. The following citizens spoke regarding concerns about the changes to their area do to the rezoning: R Michael Spalding, 2200 Powderhouse Lane, Brian Cramer, 10 Walker Court, Glen Greason, 2 Walker Court and Alpha Spalding, 2200 Powderhouse Lane. John Scheumann, Petitioner responded to questions from neighbors. Jenny Leshney, City Engineer spoke regarding the cost recovery charges and stated the cost applies equally to everyone in the area. Ordinance 2014-12 passed 6-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2014-13 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from I3 to GB, W.K. Baldwin, Petitioner- 3465 South Street) by title only on first and final reading. Dan Teder, Attorney for the petitioner spoke regarding the ordinance. Councilman Brown moved for passage, Councilwoman Weast-Williamson seconded. Ordinance 2014-13 passed 6-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2014-14 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from I3 to GB, the Ruth Schafer Family, LP, Petitioner 2.12 Acres at 91 North 36th Street) by title only on first and final reading. Councilwoman Weast- Williamson moved for passage, Councilman Downing seconded. Dan Teder, Attorney for the petitioner spoke regarding the Ordinance. Ordinance 2014-14 passed 6-0 on a roll call vote on first and final reading. Resolutions The Clerk read Resolution 2014-07 (A Resolution to Approve the Lafayette Housing Consortium Home Program and the City of Lafayette Community Development Block Grant Action Plan for 2014) by title only on first and final reading. Council Brown moved for passage, Councilman Klinker seconded. Aimee Jacobsen, Community Development spoke regarding the resolution. Resolution 2014-07 passed on a roll call vote on first and final reading. There were no Reports of Standing Committees: There were no Reports of Special Committees: There was no Report by the Mayor: Miscellaneous or New Business: 2014 Compliance of Statement of Benefits for Tax Abatement President Meyer stated the Council will need to review the companies as listed on the Memo from the Redevelopment Commission and then vote on them individually by voice vote. Dennis Carson, Economic Director gave a report on each of the following businesses and Industries and all were found to be in substantial compliance by the Lafayette City Council by individual unanimous voice vote. There were no Reports by Council: Public Comment: Jim Page, 1506 Durango expressed concerns regarding a Semi cab parking in residential neighborhoods and shared pictures, also asking the ordinance be revisited to possibly limit the issues. Randy Anderson, St Lawrence /McAllister Neighborhood invited everyone to attend an Ice Cream Social celebrating a 16 hour Habitat Build, 2333 ½ Charles Street on Tuesday June 9, 2014 Councilman Campbell moved to adjourn, Councilwoman Weast-Williamson seconded.
