MINUTES OF THE LAFAYETTE COMMON COUNCIL January 3, 2017 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Tuesday, January 3, 2017 at 6:30 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Campbell called the meeting to order at 6:30pm. The Pledge of Allegiance was given to the flag of our Country. The following members were present: Present: Heide, Klinker, Nargi, Reynolds, Ahlersmeyer, Weast-Williamson, Downing and Campbell Absent: Brown City Clerk Cindy Murray and City Attorney Ed Chosnek were present Councilman Heide moved to nominate Councilwoman Nargi as President of the Common Council for the year 2017, Councilwoman Weast-Williamson seconded. The motion passed on by unanimous voice vote. Thereafter, Councilwoman Nargi presided over the meeting. Councilman Downing moved to nominate Councilman Campbell as President Pro-Tem for the year 2017, Councilwoman Weast-Williamson seconded. The motion was passed by unanimous voice vote. Councilman Campbell moved to approve the minutes of the December 5, 2016 Council Meetings. Councilwoman Ahlersmeyer seconded. Motion passed on a roll call vote. There were no Claims, Petitions or Communications: The Clerk stated the following reports are available in the City Clerk’s Office: Water Pollution Control Department Monthly-November Water Works Department Monthly- November Fleet Maintenance Department Monthly- November There were No Ordinances for Second Reading Ordinances for First Reading: The Clerk read Ordinance 2017-01 (A Ordinance to Vacate A Portion of the Public Way in the City of Lafayette, Indiana-Lafayette Pentecostal Church, Petitioner) by title only on first reading. Councilman Heide moved for passage, Councilman Klinker seconded. Jason Ramsland, Attorney for the petitioner spoke regarding the Ordinance. Ordinance 2017-01 passed 7-0 on a roll call vote on first reading. Councilman Campbell moved to set a public hearing on Ordinance 2017-01 on Monday, February 6, 2017 at 6:31 PM, Councilwoman Ahlersmeyer seconded. Motion passed. The Clerk read Ordinance 2017-02 (An Ordinance Fixing the Salaries of the Sworn Protective Occupation and Law Enforcement (POLE) Members of the Police and Fire Departments of the City of Lafayette, for the Year 2017) by title only on first reading. Councilman Downing moved for passage, Councilman Reynolds seconded. Mayor Roswarski spoke regarding the Ordinance that includes a change due to a scrivener’s error. Ordinance 2017-02 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2017-03 (Amendment to Ordinance No. 85-12, As Last Amended by Ordinance in 2012-32, Concerning Charges For Sewerage Services) by title only on first reading. Councilman Reynolds moved for passage, Councilman Campbell seconded. Mayor Roswarski spoke regarding the next phase of the City’s CSO agreement with IDEM that will be beginning in 2017. Brad Talley, Water Pollution Control Superintendent, spoke regarding the upcoming projects involved with the long term control plan and how they were developed. Tim Healy of Greeley and Hanson spoke regarding the details of the two large projects. Mayor Roswarski gave information on the rate increase to fund the projects. The total rate will be 27% and will be phased in over 3 years as follows: 16% the first year, 6% the second year and 5% the third year. Jennifer Wilson, Crowe Howarth went over how the rate increase was established. Jenny Leshney, City Engineer stated the average homeowner’s monthly bill would increase approximately $6.26 and Lafayette’s rates compared to other cities of the same size is 2nd from the bottom . After the rate increase we will only go up to 6th from the bottom. Ordinance 2017-03 passed 7-0 on a roll call vote on first reading. Councilman Klinker moved to set a public hearing on Ordinance 2017-03 on Monday, February 6, 2017 at 6:32 PM, Councilwoman Ahlersmeyer seconded. Motion passed. The Clerk read Ordinance 2017-04 (An Ordinance Authorizing the Acquisition Construction, Installation and Equipping by The City of Lafayette, Indiana of Certain Improvements and Extensions to the Sewage Works of the City, the Issuance and Sale of Revenue Bonds to Provide Funds for the Payment of the Costs Thereof, the Issuance and Sale of Bond Anticipation Notes in Anticipation of the Issuance and Sale of Such Bonds, and the Collection, Segregation and Distribution of the Revenues of Such Sewage Works, The Safeguarding of the Interests of the Owners of the Revenue Bonds, and Other Related Matters, including Repealing Ordinances Inconsistent Herewith) by title only on first reading. Councilman Downing moved for passage, Councilwoman Weast-Williamson seconded. Mayor Roswarski spoke regarding the ordinance. Brenda Defries, Bond Council spoke regarding the process for the issuance and sale of the revenue bonds required to fund the sewage projects, The amount of the bond is not to exceed Fifty Seven Million dollars ($57,000,000) Ordinance 2017-04 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2017-05 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from R1, GB and A to R3, 108 Beck Lane, CRF Affordable Housing , Petitioner) by title only on first and final reading. Councilwoman Ahlersmeyer moved for passage, Councilman Reynolds seconded. Mayor Roswarski spoke in support of the ordinance. Jason Ramsland, Attorney for the petitioner spoke regarding the project and the warranty deed that was included. Steve Hinkley and Mary Hinkley, 324 Beck Lane spoke in opposition to the ordinance. Ordinance 2017-05 passed 7-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2017-06 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from I3 to GB, 99 S. Farabee Dr, Lafayette Retail LLC, Petitioner) by title only on first and final reading. Councilman Heide moved for passage, Councilman Klinker seconded. Don Smith, Attorney for the petitioner spoke regarding the ordinance. Ordinance 2017-06 passed 7-0 on first and final reading. Resolutions The Clerk read Resolution 2017-01 (A Resolution Approving the Detail of the 2017 Water Works and Water Pollution Control Departments Budgets) by title only on first and final reading. Councilman Reynolds moved for passage, Councilman Campbell seconded. Mayor Roswarski spoke regarding the Resolution and the budget process. Brad Talley, Water Pollution Control Superintendent, spoke on changes to the budget that includes a 1.46% with the majority of the increase being salaries and benefits. Kerry Smith, Water Works Superintendent, spoke on changes to the Water Works Budget. Resolution 2017-01 passed 7-0 on a roll call vote on first and final reading. The Clerk read Resolution 2017-02 (A Resolution Approving A Deduction for Tax Abatement in and Economic Revitalization Area (ERA) –Arconic, Personal Property Tax Abatements) by title only on first and final reading. Councilwoman Ahlersmeyer moved for passage, Councilman Downing seconded. Mayor Roswarski spoke in support of the Resolution. Scott Greeson, Arconic representative spoke regarding the Abatement and the Investment. Resolution 2017-02 passed 7-0 on a roll call vote on first and final reading. The Clerk read Resolution 2017-03 (A Resolution Approving the Purchase and Sale Agreement Between Caterpillar, Inc, As Seller and City of Lafayette As Purchaser) by title only on first and final reading. Councilwoman Ahlersmeyer moved for passage, Councilwoman Weast-Williamson seconded. Mayor Roswarski spoke regarding the Resolution, the proposed use of the property is for the City Sanitation, Street, Fleet and Parks Central Maintenance. Resolution 2017-03 passed 7-0 on a roll call vote on first and final reading. Reports of Standing Committees: President Nargi requests all Council Members look over their Committee assignments and let her know if they are interested in changing. There were no Reports of Special Committees. No Report by the Mayor. No Miscellaneous or New Business No Reports of Council No Public Comment. Councilman Klinker moved to adjourn, Councilman Reynolds seconded.
