MINUTES OF THE LAFAYETTE COMMON COUNCIL November 6, 2017 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on November 6, 2017 at 6:30 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President-Nargi called the meeting to order at 6:30pm. The Pledge of Allegiance was given to the flag of our Country. The following members were present: Present: Heide, Klinker, Reynolds, Campbell, Brown, Ahlersmeyer, Weast-Williamson, Brown and Nargi City Clerk Cindy Murray and City Attorney Ed Chosnek were present. Councilman Campbell moved to recess for Public Hearings on Ordinance 2017-36 (An Ordinance Establishing Rates and Charges for the Use and Services Rendered by Waterworks Utility of the City of Lafayette, Indiana), Councilman Reynolds seconded. No public comment was heard. Councilman Campbell moved to reconvene the regular meeting, Councilman Klinker seconded. Motion passed by unanimous voice vote. Councilman Campbell moved to approve the minutes of the October 18, 2017 Special Council Meeting, Councilman Reynolds seconded. Motion passed unanimous voice vote. Claims, Petitions or Communications: None The Clerk stated the following reports are available in the City Clerk’s Office: Fleet Maintenance Department Monthly-September Lafayette Renew Department Monthly- September Water Works Department Monthly- September Police Department-September Ordinances for Second Reading: The Clerk read Ordinance 2017-33 (An Ordinance Of the Common Council of the City of Lafayette, Indiana, Authorizing the Issuance of the City of Lafayette, Indiana, Economic Development Revenue Bones in a Maximum Aggregate Principal Amount Not to Exceed Six Million Dollars ($6,000,000.00 and Approving and Authorizing Other Actions in Respect Thereto) by title only on second and final reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Mayor Roswarski spoke in support of the Ordinance and asking the council to support these projects and this Ordinance. Ordinance 2017-33 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2017-34 (An Ordinance Amending Chapter 7.13 of the Lafayette Municipal Code Regulation of Traffic in a Residential Complex) by title only on second and final reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. City Attorney, Ed Chosnek explained the amendment. Ordinance 2017-34 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2017-35 (An Ordinance of the Common Council of the City of Lafayette, Indiana, Authorizing the Issuance of Waterworks Revenue Bonds for the Purpose of Providing Funds to Pay the Cost of Certain Additions, Extensions and Improvements to the Municipal Waterworks of Said City, Providing for the Safeguarding of the Interests of the Owners of said Bonds, Other Matters Connected Therewith Including The Issuance of Notes in Anticipation of Bonds and Repealing Ordinance Inconsistent Herewith) by title only on second and final reading. Councilman Campbell moved for passage, Councilman Reynolds seconded. Jenny Leshney, Utility Consultant spoke regarding the reasoning for the bond and projects that need to be implemented. Perry Barbee, 3700 Redbud expressed concerns Ordinance 2017-35 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2017-36 (An Ordinance Establishing Rates and Charges for the Use and Services Rendered by the Waterworks Utility of the City of Lafayette, Indiana) by title only on second and final reading. Councilman Klinker moved for passage, Councilman Reynolds seconded. Kerry Smith, Water Works Superintendent spoke regarding the cost saving changes the Water Works Department has made without increasing rates in the past. David McGimpsey, Bingham, Greenbaum and Doll, explained the process for filing the rate change with the Indiana Utilities Regulatory Commission. Russell Bridges, 1114 Ferry Street asked when the rate increase would begin. Mr. McGipmsey responded it would take several months. Ordinance 2017-36 passed 8-0 on a roll vote on second and final reading. Ordinances for First Reading The Clerk read Ordinance 2017-45 (An Ordinance Amending Section 4.06.040 of The Lafayette Municipal Code Farmer’s Market Time of Use) by title only on first reading. Councilman Brown moved for passage, Councilwoman Weast-Williamson seconded. President Nargi noted that no set time is assigned due to fluctuation for opening time of the Market. Ordinance 2017-45 passed 8-0 on first reading. The Clerk read Ordinance 2017-46 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from MRU to NBU-2300 South Street, Kaspro Properties, LLC-Petitioner) by title only on first and final reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Christopher Shelmon, Attorney for the Petitioner spoke regarding the Ordinance. Ordinance 2017-46 passed 8-0 on first and final reading. The Clerk read Ordinance 2017-47 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to Rezone Certain Real Estate from, I3 to GB-2450 Sagamore Parkway, Lafayette-CB2, LLC-Petitioner) by title only on first and final reading. Councilman Campbell moved for passage, Councilman Reynolds seconded. Ed Chosnek, City Attorney recommended the Council table the Ordinance until the December 4, 2017 meeting at the request of the Petitioner. Councilman moved to table until time certain December 4, 2017, Councilman Reynolds seconded. Ordinance 2017-47 tabled until time certain December 4, 2017. Resolutions The Clerk read Resolution 2017-23 (A Resolution Approving the 2018 Common Council Calendar of Meetings) by title only on first and final reading. Councilman Klinker moved for passage, Councilman Heide seconded. Ordinance 2017-23 passed 8-0 on first and final reading. The Clerk read Resolution 2017-24 (A Resolution Establishing The City of Lafayette Entrepreneur and Enterprise District to be Commonly known as X District) by title only on first and final reading. Councilman Klinker moved for passage, Councilman Heide seconded. Dennis Carson, Economic Development Director, stated this Resolution establishes a new place based Economic Development Program was passed this year by the Indiana General Assembly, it provides tax incentives for businesses in specific area as well as other State resources for programing to encourage the development of small businesses technology and innovative startups. This district is the same as the current Enterprise area but the current Enterprise program will phase out at the end of 2018. This new program the Entrepreneur and Enterprise District branded as the Enterprise X District will start in 2018 as a 5 year pilot program in Lafayette and Fort Wayne only. It will be housed under the Urban Enterprise Association which is a 501.3c not for profit Community Development Corporation and will be overseen by a seven member management committee. It will be closely aligned with the Matchbox co-working Studio that is also located in the X District and is overseen by the Lafayette Urban Enterprise District that is managed by its own seven member committee. Mr. Carson acknowledged the work of Senator Brandt Hershman and Representative Sally Siegrist, they both were instrumental with pushing this bill through the State Legislature for the economic benefit of both Lafayette and Fort Wayne. Resolution 2017-24 passed 8-0 on first and final reading. There were no Reports of Standing Committees There were no Reports of Special Committees. Miscellaneous and New Business: President Nargi requested a motion to appoint the following citizens to the Entrepreneur and Enterprise District Committee for a term of five years: Kelley Henriott, Howard Sypher and Lindsay Mason. Councilman Klinker moved to appoint, Councilman Heide seconded. Motion passed by unanimous voice vote. Councilman Brown moved to appoint Mike Gibson to the GLPTC Board for a period of four years, Councilwoman Ahlersmeyer seconded. Motion passed by unanimous voice vote. Report by the Mayor: Mayor Roswarski thanked the Council for all their hard work and support in moving the community forward. Mayor Roswarski introduced Deputy Chief Dave Payne, who recently retired from the Police Department and was named the new Purchasing Director for the city and thanked him for his service and all the improvements and projects he brought to the Lafayette Police Department. Reports of Council: Councilman Campbell has requested an update to the smoking ordinance in 2018. Public Comment: Lloyd Wells, 3712 Rawlings Dr. questioned the purpose of the decorative lights on Sagamore Pkwy. Mayor Roswarski responded, they were designed to for recognizing different events such as Veteran’s day and holidays. Russell Bridges, 1114 Ferry Street, expressed concern over unpaved sidewalks corners at several intersections. Councilman Campbell moved to adjourn, Councilman Reynolds seconded.
