MINUTES OF THE LAFAYETTE COMMON COUNCIL December 3, 2018 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday, December 3, 2018 at 6:30 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Campbell called the meeting to order at 6:30pm. The Pledge of Allegiance was given to the flag of our Country. Present: Heide, Klinker, Nargi, Reynolds, Brown, Ahlersmeyer, Weast-Williamson Absent: Downing City Clerk Cindy Murray and City Attorney Ed Chosnek were present Councilman Heide moved to recess for a public hearing on Ordinance 2018-24 (An Ordinance for Additional Appropriation from Police Education Fund (Fund 2320)), Councilman Klinker seconded. No Public Comment was heard. Councilman Heide moved to recess for a public hearing on Ordinance 2018-25 (An Ordinance for Appropriation of Economic Income Tax Funds (EDIT)(Funds #2090)) Councilman Klinker seconded. No Public Comment was heard. Resolution 2018-22 (A Resolution Approving the Purchase and Sale Agreement Between Hook- Super, L.L.C. as Seller and City of Lafayette, as Purchaser). President Campbell announced this public hearing was set in error and will not be heard. Councilman Klinker moved to reconvene the regular meeting, Councilman Brown seconded. Motion passed by unanimous voice vote. Councilman Klinker moved to approve the minutes of the November 5, 2018 council meetings. Councilwoman Nargi seconded. Motion passed by unanimous voice vote. There were no Claims, Petitions or Communications: The Clerk stated the following reports are available in the City Clerk’s Office: Water Works October Monthly Fleet Maintenance October Monthly Police Department October Monthly Lafayette Renew October Monthly Ordinances for Second Reading The Clerk read Ordinance 2018-23 (An Ordinance to Amend Ordinance 2017-37 An Ordinance Fixing the Salaries of the Appointed Officers and Employees of the City of Lafayette, Indiana, for the Year 2018, Excluding the Sworn Protective Occupation and Law Enforcement Members of the Police and Fire Departments) by title only on second and final reading. Councilwoman Nargi moved for passage, Councilman Reynolds seconded. Mike Jones, Controller updated council on two corrections on the exhibit of the 2017-37 Salary ordinance. Ordinance 2018-23 passed 7-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2018-24 (An Ordinance for Additional Appropriation from Police Education Fund (Fund 2320)) by title only on second and final reading. Councilman Reynolds moved for passage, Councilman Brown seconded. Mike Jones, Controller spoke regarding the appropriation that will be used to replace an administrative police car that was destroyed in an accident. Ordinance 2018-24 passed 7-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2018-25 (An Ordinance for Appropriation of Economic Income Tax Funds (EDIT)(Funds #2090)) by title only on second and final reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Mayor Roswarski spoke regarding the plan to use EDIT funds to purchase the former Osco’s site on S. 24th Street. The site will be used for a parking lot that will be utilized for the Parks Department. Ordinance 2018-25 passed 7-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2018-26 (An Ordinance Amending Certain Sections in Title 10- Animals) by title only on second and final reading. Councilwoman Weast-Williamson moved for passage, Councilman Heide seconded. Ed Chosnek, City Attorney explained the changes to the ordinance. Jim Peterson, 1817 Arcadia Dr. representing Lafayette Kennel Club expressed concern about the limit of animals per residence. Laura Houser, West Lafayette spoke regarding the ordinance. Ordinance 2018-26 passed 7-0 on a roll call vote on second and final reading. Ordinances for First Reading: The Clerk read Ordinance 2018-27 (An Amendment to Ordinance No. 2010-11 Inclusion of Certain Property in the Local Upper Main Street Historic District in the City of Lafayette, Indiana) by title only on first reading. Councilwoman Ahlersmeyer moved for passage, Councilwoman Weast -Williamson seconded. John Collier, Economic Development Department, spoke regarding the ordinance. Ordinance passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2018-28 (An Ordinance Authorizing the City of Lafayette, Indiana to Issue its Taxable Economic Development Revenue Bonds and Approving and Authorizing Other Actions in Respect Thereto) by title only on first reading. Councilman Heide moved for passage, Councilman Klinker seconded. Ordinance 2018-28 passed 6-0 on a roll call vote on first reading. Councilman Heide left the meeting at 6:57 pm The Clerk read Ordinance 2018-29 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate from R1U to R2U-1623 Underwood St., Frank Foust Jr, Petitioner) by title only on first and final reading. Councilman Klinker moved for passage, Councilwoman Nargi seconded. Frank Foust, Petitioner spoke regarding his plan for the property. Ordinance 2018-29 passed 6-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2018-30 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate from R2 to NBU-2200 Ferry St., Parkside Pharmacy, Inc, Petitioner) by title only on first and final reading. Councilwoman Nargi moved for passage, Councilman Reynolds seconded. Sarah Wyatt, attorney for the petitioner spoke regarding the planned use. Ordinance 2018-30 passed 6-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2018-31 (An Ordinance Authorizing An Update to 2019 Budget Form 4 and Form 4B to Account for Sale of 2018 Park Bonds) by title only on first reading. Councilman Klinker moved for passage, Councilwoman Nargi seconded. Mike Jones, Controller spoke regarding the ordinance. Ordinance 2018-31 passed 6-0 on a roll call vote on first reading. President Campbell called for a motion to suspend the rules and hear Ordinance 2018-31 for second and final reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Ordinance 2018-31 passed 6-0 on a roll call vote on second and final reading. Resolutions: The Clerk read Resolution 2018-23 (A Resolution Adopting the 2019 Common Council Calendar of Meetings) by title only on first and final reading. Councilman Reynolds moved for passage, Councilman Brown seconded. Resolution 2018-23 passed 6-0 on a roll call vote on first and final reading. The Clerk read Resolution 2018-24 (A Resolution of the Common Council Approving Grant of Temporary Highway Easement to the State of Indiana for the Teal Rd (US52) Project) by title only on first and final reading. Councilwoman Ahlersmeyer moved for passage, Councilwoman Weast-Williamson seconded. Ed Chosnek, Attorney spoke regarding the need by the state to use city easements for the Teal Road Project the City of Lafayette will be paid $14,675.00 for use of the area. Resolution 2018-24 passed 6-0 on a roll call vote on first and final reading. No Reports of Standing Committees. No Reports of Special Committees. No Report by the Mayor. Miscellaneous and New Business: Council Appointments –Redevelopment Commission and GLPTC Board Councilman Klinker moved to appoint Ben Murray to the GLPTC Board, Councilwoman Nargi seconded. Motion passed by unanimous voice vote. Councilman Reynolds moved to appoint Don Teder and T.J. Thieme to the Redevelopment Commission, Councilman Reynolds seconded. Motion passed by unanimous voice vote. No reports of Council. No Public Comment. Councilman Klinker moved to adjourn, Councilman Reynolds seconded. Meeting was adjourned at 7:13 PM.
