MINUTES OF THE LAFAYETTE COMMON COUNCIL MAY 6, 2019 REGULAR MEETING The Common Council of the City of Lafayette, Indiana met in regular session on Monday, May 6, 2019 at 6:30 p.m. in the City Hall Council Chambers, 20 North 6th Street, Lafayette, Indiana. President Pro-tem Nargi called the meeting to order at 6:30pm. The Pledge of Allegiance was given to the flag of our Country. Present: Heide, Klinker, Nargi, Reynolds, Brown, Ahlersmeyer, Weast-Williamson and Downing Absent: Campbell City Clerk Cindy Murray and Deputy City Attorney Jacque Chosnek were present Councilman Brown moved to recess for a public hearing on Ordinance 2019-10 (An Ordinance for Appropriation of Park Bond Funds (Fund #3120)) Councilwoman Ahlersmeyer seconded. No public comment was heard. Councilwoman Weast-Williamson moved to reconvene the regular meeting. Motion passed by unanimous voice vote. Councilman Heide moved to approve the minutes of the April 1, 2019 council meetings. Councilman Reynolds seconded. Motion passed by unanimous voice vote. Councilman Klinker moved for passage, Councilman Reynolds seconded. Tim Clary, Controller spoke regarding the ordinance. Ordinance 2019-10 passed 7-0 on a roll call vote on second and final reading. Ordinances for First Reading: The Clerk read Ordinance 2019-12 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana-UZO Amendment #95) by title only on first and final reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Jacque Chosnek, Attorney spoke regarding the ordinance. Ordinance 2019-12 passed 7-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2019-13 (An Ordinance for Appropriation of Local Option Highway Use Tax Fund (County Wheel Tax) (Fund#2490)) by title only on first reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Tim Clary, Controller spoke regarding the ordinance. Ordinance 2019-13 passed 7-0 on a roll call vote on first reading Councilman Klinker moved to set a public hearing on Monday, June 3, 2019 at 6:31 pm, Councilman Brown seconded. Motion passed by unanimous voice vote The Clerk read Ordinance 2019-14 (An Ordinance to Amend 2.11.020 Pertaining to the Police Pension Fund) by title only on first reading. Councilman Reynolds moved for passage, Councilman Heide seconded. Mayor Roswarski spoke regarding Ordinance 2019-14 and Ordinance 2019-15. Ordinance 2019-14 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2019-15 (An Ordinance to Amend 2.13.120 Pertaining to the Fire Pension Fund) by title only on first reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Ordinance 2019-15 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2019-16 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana,-UZO Amendment #96) by title only on first and final reading. Councilwoman Weast- Williamson moved for passage, Councilman Downing seconded. Jacque Chosnek, Attorney spoke regarding the ordinance which restricts the height of commercial windmills in Tippecanoe County. Ordinance 2019-16 passed 6-1 on a roll call vote as follows on first and final reading Ayes: Heide, Klinker, Reynolds, Ahlersmeyer, Weast-Williamson and Downing Nays: Brown Resolutions: The Clerk read Resolution 2019-08 (A Resolution of the Common Council Approving Grant of Gas Line Easement to Vectren Energy Delivery of Indiana, Inc for the 18th Street Gas Line Relocation Project) by title only on first and final reading. Councilman Heide moved for passage, Councilman Klinker seconded. Jacque Chosnek, Attorney spoke regarding the resolution. Resolution 2019-08 passed 7-0 on a roll call vote on first and final reading. The Clerk read Resolution 2019-09 (A Resolution to Request Development of a Form Based Zoning Code as an Amendment to the Unified Zoning Ordinance and Any Appropriate Zoning Changes for the Highland Park Neighborhood within the City of Lafayette) by title only on first and final reading. Councilman Heide moved for passage, Councilman Reynolds seconded. John Collier, Economic Development spoke regarding the resolution. Ryan O’Gara, Area Plan Commission explained the process for development of form based zoning. Discussion ensued Janelle Rotar, 608 Wyandotte Ave, member of the Highland Park Preservation Steering Committee, formed to work with Economic Development to create an ordinance that would assure new housing compliments and work with the integrity of the neighborhood. Councilwoman Ahlersmeyer, representing district 4 which includes Highland Park District, shared with council information that indicates currently almost 50% of neighbors responding are not currently in favor of making these changes. Councilwoman Ahlersmeyer wants assurance that the majority of the Highland Park District residents were on board with changes. Jerry Brand 1610 Oak lawn Dr. questioned if zoning would affect other neighborhoods. Resolution 2019-09 passed 7-0 on a roll call vote on first and final reading. The Clerk read Resolution 2019-10 (A Resolution to Approve the City of Lafayette Community Development Block Grant and the Lafayette Housing Consortium Home Program Annual Action Plan for 2019) by title only on first and final reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Michelle Reynolds, Director Lafayette Housing Authority spoke regarding the resolution. Resolution 2019-10 passed 7-0 on a roll call vote on first and final reading. The Clerk read Resolution 2019-11 (A Resolution Declaring the Designation of Certain Real Estate as an Economic Revitalization Area (ERA) and Approving the Application for Property Tax Abatement-LB Associates LLC-Real Estate) by title only on first and final reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Dennis Carson, Director Economic Development spoke regarding the resolution. Jerry Brand, INOK Investments spoke regarding their warehouse project. Resolution 2019-11 passed 7-0 on a roll call vote on first and final reading. Councilman Klinker moved to set a public hearing on Monday, June 3, 2019 at 6:32 pm, Councilman Reynolds seconded. Motion passed by unanimous voice vote. No Reports of Standing Committees. Public Comment: Corina Atherton-Childress, 1800 N 15th St invited everyone to the Tippecanoe Masonic Association/Eastern Star annual Fish Fry at the Tippecanoe Fairgrounds on Saturday, May 11th from 4:30 to 7:00 PM Councilman Heide moved to adjourn, Councilman Reynolds seconded.
