MINUTES OF THE LAFAYETTE COMMON COUNCIL October 5, 2020 REGULAR MEETING Due to the current COVID-19 pandemic, All essential meetings are being conducted virtually, conference calls & online streaming (https://www.youtube.com/user/CityofLafayetteIN/live The Common Council of the City of Lafayette, Indiana met in regular session virtually via a Go To Meeting on Monday, October 5, 2020 at 6:00 pm President Nargi called the meeting to order at 6:00 pm The Pledge of Allegiance was given to the flag of our Country. Present: Heide, Klinker, Reynolds, Campbell, Brown, Weast-Williamson, Ahlersmeyer, Downing and Nargi City Clerk Cindy Murray and Deputy City Attorney Jacque Chosnek were present President Nargi requested a moment of silence in memory of John Scheumann Councilman Campbell moved to approve the minutes of the September 8, 2020 council meeting, Councilman Heide seconded. Motion passed 8-0 on a roll call vote. There were no Disposal of Claims, Petitions or Communications: The Clerk stated the following reports are available in the City Clerk’s Office: Fleet Maintenance Department Monthly-August Police Department Monthly- August Renew Department Monthly-August Water Works Department Monthly- August Ordinances for Second Reading: The Clerk read Ordinance 2020-27 (An Amendment to Ordinance No 2010-11 Establishing A Local Ebershoff/914 S 10th Street Historic District in the City of Lafayette, Indiana) by title only on second and final reading. Councilwoman Ahlersmeyer moved for passage, Councilman Brown seconded. The Clerk noted no electronic public comment was received on Ordinance 2020-27. Ordinance 2020-27 passed 8-00 on a roll call vote on second and final reading Ordinances for First Reading: President Nargi requested a motion to move Ordinance 2020-34 up on the agenda at the request of the petitioner Councilman Campbell moved to accept the request and passage, Councilman Heide seconded. The Clerk read Ordinance 2020-34 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana to rezone certain Real Estate from I3, NB & GB to NB-310 N Earl Avenue, Carson & Earl, LLC, Petitioner) by title only on first and final reading. Dan Teder, attorney for the petitioner spoke regarding the ordinance. Ordinance 2020-34 passed 8-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2020-26 (An Ordinance For Lafayette Sewer 2020 Refunding Bond) by title only on first reading. Councilman Reynolds moved for passage, Councilwoman Weast- Williamson seconded. Councilman Klinker moved to withdraw Ordinance 2020-26 at the request of the Mayor and Legal Counsel, Councilman Heide seconded. Ordinance 2020-26 was withdrawn from the agenda 8-0 on a roll call vote. The Clerk read Ordinance 2020-28 (2021 GLPTC Budget-An Ordinance Appropriating Money for the Greater Lafayette Public Transportation Corporation As Required Pursuant to Indiana Code 6-1.1-17-20) by title only on first reading. Councilman Brown moved for passage, Councilwoman Ahlersmeyer seconded. Marty Sennett, General Manager, GLPTC spoke regarding their budget and changes planned for 2021. The Clerk noted no electronic public comment was received on Ordinance 2020-28. Ordinance 2020-28 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2020-29 (2021 Budget Ordinance, An Ordinance Appropriating Money for the Purpose of Defraying the Expenses of Several Departments of the City Government of the City of Lafayette, Indiana for the Fiscal Year Beginning January 1, 2021 and Ending December 31, 2021, Including the Outstanding Claims and Obligations and Fixing a Time When the Same Shall Take Effect) by title only on first reading. Councilman Campbell moved for passage, Councilman Downing seconded. Mayor Roswarski spoke regarding the current local economy and how it will affect the City’s 2021 Budget. The Mayor also noted the City has not had to use the Rainy Day Fund during the 2020 pandemic. The Clerk noted no electronic public comment was received on Ordinance 2020-29. Councilman Campbell thanked the Mayor and all the employees for their hard work. Ordinance 2020-29 passed 8-0 on a roll call vote on first reading. The Clerk read Ordinance 2020-30 (An Ordinance Fixing the Salaries of the Appointed Officers and Employees of the City of Lafayette, Indiana for the Year 2021, Excluding the Sworn Protective Occupation and Law Enforcement Members of the Police and Fire Departments) by title only on first reading. Councilman Klinker moved for passage, Councilman Heide seconded. Mayor Roswarski spoke regarding the ordinance sharing that it would include a 1% salary raise for civilian employees. The Mayor noted with the raise and the insurance premium holiday from IACT no employee should go backwards with their pay. The Clerk noted no electronic public comment was received on Ordinance 2020-30. Ordinance 2020-30 passed 8-0 a roll call vote on first reading. The Clerk read Ordinance 2020-31 (An Amended Ordinance Fixing the Salaries of the Sworn Protective Occupation and Law Enforcement (POLE) Members of the Police and Fire Departments of the City of Lafayette, Indiana, for the Year 2021) by title only on first reading. Councilman Reynolds moved for passage, Councilwoman Weast-Williamson seconded. Councilwoman Ahlersmeyer moved to amend Ordinance 2020-31, Councilman Brown seconded. Jacque Chosnek, Deputy City Attorney stated the amendment is to add the wording for longevity pay to the ordinance. Amendment passed 8-0 on a roll call vote. Mayor Roswarski informed council this ordinance includes longevity pay for the Police and Fire Department which is possible due to the Public Safety LIT tax. Mayor Roswarski also noted there will not be a 1% increase for Police and Fire due to other contractual benefits. The Clerk noted no electronic public comment was received on Ordinance 2020-31. Amended Ordinance 2020-31 passed 8- 0 a roll call vote on first reading. The Clerk read Ordinance 2020-32 (An Ordinance Fixing the Salaries of the Elected Officials of the City of Lafayette, Indiana for the Year 2021) by title only on first reading. Councilman Campbell moved for passage, Councilman Downing seconded. Mayor Roswarski announced there will be no raise in 2021 for the Elected Officials of the City of Lafayette. The Clerk noted no electronic public comment was received on Ordinance 2020-32. Ordinance 2020-32 passed 8-0 a roll call vote on first reading. The Clerk read Ordinance 2020-33(An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate from GB to I3-3445 Union Street, Jose Gaeta, Petitioner) by title only on first and final reading. Councilman Klinker moved for passage, Councilman Heide seconded. Jose Gaeta, Petitioner spoke regarding the ordinance. The Clerk noted no electronic public comment was received on Ordinance 2020-33. Ordinance 2020-33 passed 8-0 a roll call vote on first and final reading. The Clerk read Ordinance 2020-35 (An Ordinance Approving A Lease Between the City of Lafayette Redevelopment Commission and the City of Lafayette Redevelopment Authority Relating to the Financing and Construction of the New Police State and Parking Garage Project, The Pledge of Public Safety Local Income Tax Revenues to the City of Lafayette Redevelopment Commission and the Transfer of Real Estate to the City of Lafayette Redevelopment Authority in Connection Therewith , and Repealing All Ordinances Inconsistent Therewith) by title only on first reading. Councilman Reynolds moved for passage, Councilwoman Weast-Williamson seconded. Mayor Roswarski spoke regarding the project. Dennis Otten, Bose Mckinney spoke regarding the financing of the project. Ordinance 2020-35 passed 8-0 on a roll call vote on first reading. Resolutions: The Clerk read Resolution 2020-20 (A Resolution of the Common Council of the City of Lafayette, Indiana, Approving (1) Resolution No LRC-2020-12 Of the City of Lafayette Redevelopment Commission Which Amended the Economic Development Plan for the Consolidated Creasy/Central Economic Development Area and (2) The Order of the Area Plan Commission Of Tippecanoe County, Indiana Related Thereto) by title only on first and final reading. Councilwoman Ahlersmeyer moved for passage, Councilman Brown seconded. President Nargi noted the Mayor and Legal Council have requested this resolution be tabled until time certain the November 2, 2020 Council Meeting. Councilman Campbell moved to table Resolution 2020-20 until November 2, 2020 Common Council Meeting. Councilman Downing seconded. Motion passed 8-0 on a roll call vote. No Reports of Standing Committees. No Reports of Special Committees. Report by the Mayor: Mayor Roswarski asked that we all keep the family of John Scheumann in our thoughts and prayers. No Miscellaneous or New Business. No Reports by the Council. No Public Comment. President Nargi reminded the council there will be a public hearing on Thursday, October 8th @5 PM for the budgets and salaries. Councilman Heide move to adjourned, Councilman Downing seconded.
