MINUTES OF THE LAFAYETTE COMMON COUNCIL MARCH 7, 2022 REGULAR MEETING (https://www.youtube.com/user/CityofLafayetteIN/live The Common Council of the City of Lafayette, Indiana met in regular session Monday, March 7, 2022 at 6:00 pm. President Brown called the meeting to order at 6:00 pm. The Pledge of Allegiance was given to the flag of our Country. Present: Klinker, Nargi, Snyder, Hession Weiss, Ahlersmeyer, Weast-Williamson, Downing and Brown Absent: Reynolds City Clerk Cindy Murray and City Attorney Jacque Chosnek were present. Public Hearing: Councilwoman Hession Weiss moved to recess for a public hearing on the following ordinances, Councilwoman Ahlersmeyer seconded Ordinance 2022-01 (An Ordinance Reestablishing the Cumulative Capital Development Fund) No public comment was heard. Ordinance 2022-05 (An Ordinance for Additional Appropriation of American Rescue Plan Grant Fund (Fund #1760)) No public comment was heard. Ordinance 2022-06 (An Ordinance for Appropriation Reduction of General Fund (Fund #1010) and For Additional Appropriation of General Fund (Fund #1010)) No public comment was heard. Councilwoman Hession Weiss moved to reconvene the regular meeting, Councilman Klinker seconded. Motion passed by unanimous voice vote. Councilwoman Hession Weiss moved to approve the minutes of the February 7, 2022 council meeting, Councilman Klinker seconded. Motion passed by unanimous voice vote. There were no Disposal of Claims, Petitions or Communications: The Clerk stated the following reports are available in the City Clerk’s Office: Fleet Maintenance Department Monthly-January Water Works Department Monthly-January Renew Department Monthly-January and 2021 Annual Report Ordinances for Second Reading: The Clerk read Ordinance 2022-01 (An Ordinance Reestablishing the Cumulative Capital Development Fund) by title only on second and final reading. Councilwoman Hession Weiss moved for passage, Councilwoman Weast-Williamson seconded. Mayor Roswarski spoke regarding the Ordinance and the advantage to reestablishing the fund. Ordinance 2022-01 passed 7-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2022-02 (An Ordinance to Amend Ordinance 2021-54-An Ordinance Fixing the Salaries of the Sworn Protective Occupation and Law Enforcement (POLE) Members of the Police and Fire Departments for the Year 2022) by title only on second and final reading. Councilman Klinker moved for passage, Councilwoman Hession Weiss seconded. Jacque Chosnek, City Attorney spoke regarding the ordinance. Ordinance 2022-02 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2022-03 (An Ordinance to Amend Ordinance 2021-53-An Ordinance Fixing the Salaries of the Appointed Officers and Employees of the City of Lafayette, Indiana for the Year 2022. Excluding the Sworn Protective Occupation and Law Enforcement Members of the Police and Fire Departments) by title only on second and final reading. Councilwoman Hession Weiss moved for passage, Councilwoman Nargi seconded. Mayor Roswarski noted this ordinance transfers legal services from contracted services to a position of full-time employment with the city. The Mayor also noted a change in classification for a member of the custodial staff. Ordinance 2022-03 passed 7-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2022-05 (An Ordinance for Additional Appropriation of American Rescue Plan Grant Fund (Fund #1760)) by title only on second and final reading. Councilwoman Weast-Williamson moved for passage, Councilman Downing seconded. Mayor Roswarski spoke regarding the ordinance. Ordinance 2022-05 passed 7-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2022-06 (An Ordinance for Appropriation Reduction of General Fund (Fund #1010) and For Additional Appropriation of General Fund (Fund #1010)) by title only on second and final reading. Councilwoman Hession Weiss moved for passage, Councilman Klinker seconded. Jeremy Diehl, Controller explained to council this appropriation is necessary to provide funding for the newly created legal department. Ordinance 2022-06 passed 7-0 on a roll call vote on second reading. Ordinances for First Reading: The Clerk read Ordinance 2022-04 (An Ordinance to Amend Sections of Title 12 Historic Preservation and Protection) by title only on first reading. Councilman Klinker moved for passage, Councilwoman Nargi seconded. John Collier, Economic Development spoke regarding the ordinance. Ordinance 2022-04 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2022-07 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate from GB to I3-600 Elston Road, Jetboy, LLC, Petitioner) by title only on first and final reading. Councilwoman Nargi moved for passage, Councilwoman Hession Weiss seconded. Kevin Riley, Attorney for the petitioner spoke regarding the ordinance and the planned use for the property. Mr. Riley noted there is also a commitment with restricted uses. Council discussion ensued. (please refer to audio) Mayor Roswarski spoke in support of the ordinance. Kelly Scott Ausherman, 550 Elston Road, spoke in opposition of the rezone. 2022-07 passed 7-0 on a roll call vote on first and final reading. Resolutions: The Clerk read Resolution 2022-03 (A Resolution Approving the Transfer of Appropriations Within the Water Utility Operation Fund and Water Pollution Control Operating Fund) by title only on first and final reading. Councilwoman Ahlersmeyer moved for passage, Councilwoman Weast-Williamson seconded. Jeremy Diehl, Controller spoke regarding the resolution. Resolution 2022-03 passed 7-0 on a roll call vote on first and final reading. The Clerk read Resolution 2022-04 (A Resolution of the Common Council of the City of Lafayette Amending Resolution 2021-33 Approving an Amended and Restated Lease Between the Lafayette Redevelopment Authority and the Lafayette Redevelopment Commission Authorizing the Lafayette Redevelopment Commission, Authorizing the Issuance of Bonds by the Lafayette Redevelopment Authority and Other Matters Related Thereto (Consolidated Creasy/Central Economic Development Area Project) by title only on first and final reading. Councilwoman Hession Weiss moved for passage, Councilman Klinker seconded. Jeremy Diehl, Controller spoke regarding the Resolution. Scott Frissell, Kreig Devault spoke regarding the financial changes with the bond refunding. Greg Balsano, Baker Tilly spoke on the time line for the refinance of the bonds. Resolution 2022-04 passed 7-0 on a roll call vote on first and final reading. The Clerk read Resolution 2022-05 (A Resolution to Transfer Appropriations Between Major Budget Classifications) by title only on first and final reading. Councilwoman Hession Weiss moved for passage, Councilman Downing seconded. Mayor Roswarski spoke regarding the resolution. Resolution passed 7-0 on a roll call vote on first and final reading. The Clerk read Resolution 2022-06 (Resolution to Opt Back in to Opioids Settlement Pursuant to Indiana Code 4-6-15-2) by title only on first and final reading. Councilwoman Hession Weiss moved for passage, Councilwoman Weast-Williamson seconded. Jacque Chosnek, City Attorney spoke regarding the resolution. Resolution 2022-06 passed 7-0 on a roll call vote on first and final reading. No Reports of Standing Committees. No Reports of Special Committees. Report by the Mayor: Mayor Roswarski read the following Proclamation in support of Ukraine. Proclamation in Support of Ukraine WHEREAS, Ukraine has been a sovereign and independent state since the collapse of the former Soviet Union; and WHEREAS, the United States and Ukraine share common values, including freedom, democracy, and the rule of law; and WHEREAS, at the direction of President Vladimir Putin, Russian forces have invaded Ukraine in violation of international law; and WHEREAS, it has been over a week since this invasion, and the death toll is mounting for civilians, including children; and WHEREAS, we condemn this violence and the threats to innocent civilians in Ukraine; and WHEREAS, everyone in Lafayette should find ways to show support to our Ukrainian friends and neighbors in Lafayette, and those in Ukraine, who are courageously and valiantly fighting to save their homeland; NOW, THEREFORE BE IT RESOLVED THAT, the City of Lafayette stands in solidarity with our Ukrainian neighbors in the United States and abroad.
