MINUTES OF THE LAFAYETTE COMMON COUNCIL December 5, 2022 REGULAR MEETING (https://www.youtube.com/user/CityofLafayetteIN/live The Common Council of the City of Lafayette, Indiana met in regular session Monday, December 5, 2022 at 6:00 pm. In the Common Council Chamber at 20. N 6th Street. President Brown called the meeting to order at 6:00 pm. The Pledge of Allegiance was given to the flag of our Country. Present: Klinker, Nargi, Reynolds, Hession Weiss, Ahlersmeyer, Weast-Williamson, Downing and Brown. Absent: Snyder City Clerk Cindy Murray and City Attorney Jacque Chosnek were present. Public Hearing: Councilmember Reynolds moved to recess for a public hearing on Ordinance 2022-44 (An Ordinance for Additional Appropriation For the Greater Lafayette Public Transportation Corporation as Required Pursuant to Indiana Code 6-1.1-17-20) Councilmember Hession Weiss seconded. No public comment was heard. Councilmember Hession Weiss moved to reconvene the regular meeting. Councilmember Nargi seconded. Motion passed by unanimous voice vote. Councilmember Ahlersmeyer moved to approve the minutes Councilmember Hession Weiss seconded. Motion passed by unanimous voice vote. There were no Disposal of Claims, Petitions or Communications: The Clerk stated the following reports are available in the City Clerk’s Office: Fleet Maintenance Department Monthly-October Renew Department Monthly-October Water Works Department Monthly-October Ordinances for Second Reading: The Clerk read Ordinance 2022-44 (An Ordinance for Additional Appropriation For the Greater Lafayette Public Transportation Corporation as Required Pursuant to Indiana Code 6-1.1-17-20) by title only on second and final reading. Councilmember Nargi moved for passage, Councilmember Klinker seconded. Brian Smith, CEO Citybus spoke regarding the ordinance. Ordinance 2022-44 passed 7-0 on a roll call vote on second and final reading. Ordinances for First Reading: The Clerk read Ordinance 2022-45 (An Ordinance to Establish an Opioid Settlement Unrestricted Fund #2256) by title only on first reading. Councilmember Hession Weiss moved for passage, Councilmember Downing seconded. Jacque Chosnek, City Attorney noted the unrestricted fund may be used for whatever fits the needs of the city. The Restricted portion must be used according to the Opioid Remediation guidelines. Ordinance 2022-45 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2022-46 (An Ordinance to Establish an Opioid Settlement Restricted Fund #2257) by title only on first reading. Councilmember Klinker moved for passage, Councilmember Nargi seconded. Jacque Chosnek, City Attorney noted this ordinance is for the restricted funds. Ordinance 2022-46 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2022-47 (An Ordinance Fixing the Salaries of the Sworn Protective Occupation and Law Enforcement Members of the Police and Fire Departments of the City of Lafayette, Indiana For the Year 2023) by title only on first reading. Councilmember Ahlersmeyer moved for passage, Councilmember Weast-Williamson seconded. Jacque Chosnek, City Attorney noted the purpose of the amendment was to include the position of Firefighter I back into the ordinance until the last class of firefighters finish their current training program. Ordinance 2022-47 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2022-48 (An Amendment to Ordinance No. 2010-11 Establishing A Local Perrin North Historic District in the City of Lafayette, Indiana) by title only on first reading. Councilmember Nargi moved for passage, Councilmember Klinker seconded. John Collier, Economic Development Director spoke regarding the ordinance. Ordinance 2022-48 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2022-49 (An Amendment to Ordinance No. 2010-11 Inclusion of Certain Property in the Local Perrin/Cason Street Historic District in the City of Lafayette, Indiana. by title only on first reading. Councilmember Hession Weiss moved for passage, Councilmember Reynolds seconded. John Collier, Economic Development spoke regarding the ordinance. Ordinance 2022-49 passed 7-0 on a roll call vote on first reading. The Clerk read Ordinance 2022-50 (An Amendment to Amend Ordinance 2022-36 An Ordinance Fixing the Salaries of the Appointed Officers and Employees of the City of Lafayette, Indiana For the City of Lafayette, Indiana. Excluding the Sworn Protective Occupation and Law Enforcement Members of the Police and Fire Departments) by title only on first reading. Councilmember Hession Weiss moved for passage, Councilman Downing seconded. Mayor Roswarski noted this amendment will change the title of the Community Parks and Urban Forester to City Forester. The amendment will also add 2 Civilian Crime Scene Investigators to the Police Department and Ordinance. The Mayor noted this will not change the budget that has been passed for 2023. Ordinance 2022-50 passed 7-0 on a roll call vote on first reading. Mayor Roswarski requested a suspension of the rules to allow the changes to be in place for the start of 2023. Councilmember Hession Weiss moved to suspend the rules and hear Ordinance 2022-50 on second reading, Councilmember Reynolds seconded. Motion passed by unanimous voice vote. The Clerk read Ordinance 2022-50 (An Amendment to Amend Ordinance 2022-36 An Ordinance Fixing the Salaries of the Appointed Officers and Employees of the City of Lafayette, Indiana For the City of Lafayette, Indiana. Excluding the Sworn Protective Occupation and Law Enforcement Members of the Police and Fire Departments) by title only on second and final reading. Councilmember Hession Weiss moved for passage, Councilmember Weast-Williamson seconded. Ordinance 2022-50 passed 7-0 on second and final reading. The Clerk read Ordinance 2022-51 (An Ordinance to Repeal and Replace Chapter 8.06-Trees and Shrubs) by title only on first reading. Councilmember Downing moved for passage, Councilmember Ahlersmeyer seconded. Tim Detzner, City Forester noted this ordinance is to make updated changes to the current ordinance that has been in place since 1988. Councilmember Hession Weiss congratulated Mr. Detzner on his upcoming retirement and thanked him for his years of service to the community. Ordinance 2022-51 passed 7-0 on a roll call vote on first reading. Resolutions: The Clerk read Resolution 2022-26 (A Resolution Approving Sale of Real Estate 415 Columbia Street- Columbia Properties, LLC) by title only on first and final reading. Councilmember Reynolds moved for passage, Councilmember Nargi seconded. Mayor Roswarski spoke regarding the resolution noting the ownership group that leases the building would now like to purchase the location at fair market value. Stu Boehning, Columbia Properties, spoke regarding future plans for the property. Resolution 2022-26 passed 7-0 on a roll call vote on first and final reading. No Reports of Standing Committees. No Reports of Special Committees. There was no Report by the Mayor. No Miscellaneous or New Business. Reports by the Council: Councilmember Klinker thanked the City Clerk for all of her hard work on the Christmas Parade and wished everyone a Merry Christmas. Councilmember Hession Weiss expressed condolences for Councilmember Snyder on the loss of his sister. Public Comment: Pearl Speakman, 923 S 22nd St. expressed concern regarding criminal activity in the community. Angelika Kokkalis, 222 S 5th St. spoke regarding issues with obtaining permits with the City Engineering Department. Jeromy Grenard, City Engineer responded to concerns and offered to meet with her.
