MINUTES OF THE LAFAYETTE COMMON COUNCIL November 6, 2023 REGULAR MEETING (https://www.youtube.com/user/CityofLafayetteIN/live The Common Council of the City of Lafayette, Indiana met in regular session Monday, November 6,2023 at 6:00 pm. In the Common Council Chamber at 20. N 6th Street. President Ahlersmeyer called the meeting to order at 6:00 pm. The Pledge of Allegiance led by Scout Troop#3326 was given to the flag of our Country. West Lafayette Mayor John Dennis addressed the Council and Mayor Roswarski with a message of thanks and gratitude for his many years working with Lafayette and West Lafayette. Present: Klinker, Nargi, Snyder, Reynolds, Hession Weiss, Brown, Weast-Williamson, Downing and Ahlersmeyer. 1st Deputy City Clerk Mindy Miller Riehle and City Attorney Jacque Chosnek were present. Councilmember Klinker moved to recess for a public hearing on Ordinance 2023-49 (Ordinance for Appropriation in the General Fund) (#1010) Councilmember Nargi seconded. No public comment was heard. Councilmember Snyder moved to reconvene the regular meeting; Councilmember Reynolds seconded. Motion passed by unanimous voice vote. Councilmember Hession Weiss moved to approve the minutes of the October 19, 2023 and October 26, 2023 special meetings. Councilmember Brown seconded. Motion passed by unanimous voice vote. There were no Disposal of Claims, Petitions or Communications: The Clerk stated the following reports are available in the City Clerk’s Office: Renew Department Monthly-September Water Works Department Monthly-September Fleet Maintenance Department Monthly-September Ordinances for Second Reading The 1st Deputy Clerk read Ordinance 2023-49 (An Ordinance for Additional Appropriation in the General Fund) (Fund#1010) by title only on second and final reading. Councilmember Weast-Williamson moved for passage; Councilmember Diehl seconded. Jeremy Diehl, Controller noted this ordinance is requesting an additional $175,000 for the overtime line of the Fire Department. Ordinance 2023-49 passed 8-0 on a roll call vote on second and final reading. Ordinances for First Reading The 1st Deputy Clerk read Ordinance 2023-50 (An Ordinance Amending Certain Sections Within Title 10 – Animals Including Amending Section 10.03.050 Concerning Animal Establishments and Adding New Section 10.03.060 Concerning Commercial Sales of Dogs and Cats) by title only on first reading. Councilmember Klinker moved for passage, Councilmember Nargi seconded. Jacque Chosnek, City Attorney noted there is an amendment to this ordinance to further define retail establishments. Councilmember Snyder moved to amend Ordinance 2023-50; Councilmember Reynolds seconded. Motion passed by unanimous voice vote. Sharon Dull, Humane Society of Greater Lafayette spoke regarding puppy sales. Amended Ordinance 2023-50 passed 8-0 on a roll call vote. The 1st Deputy Clerk read Ordinance 2023-53 (An Ordinance to Amend the Zoning Ordinance of Tippecanoe, Indiana to Rezone Certain Real Estate from R1 to I3-Crossrods Engineers, PC) by title only on first reading. Councilmember Hession Weiss moved to for passage, Councilman Brown seconded. Jacque Chosnek, City Attorney noted there has been an amendment decreasing the area involved. Councilmember Weast-Williamson moved to amend Ordinance 2023-53, Councilmember Downing seconded. Motion passed by unanimous voice vote. Kevin Riley, Attorney for the petitioner requested the ordinance be tabled until time certain Monday, December 4, 2023. Councilmember Klinker moved to table until time certain, Councilmember Nargi seconded. Motion passed. Ordinance 2023-58 passed 8-0 on a roll call vote on first and final reading. The 1st Deputy Clerk read Ordinance 2023-59 (An Ordinance To Amend the Zoning Ordinance of Tippecanoe County, Indiana, to Rezone Certain Real Estate from CB & R2U to PDMX-600, 638, and 703 N 4th Street, Lafayette-Imagination Lofts, LLC) by title only on first and final reading. Councilmember Weast-Williamson moved for passage; Councilmember Reynolds seconded. Dennis Carson, Economic Development Director spoke in support of the planned development. Ryan, Munden, attorney for the petitioner spoke regarding the project which will include apartments and 4 homes. Ordinance 2023-59 passed 8-0 on a roll call vote on first and final reading. Resolutions: The 1st Deputy Clerk read Resolution 2023-27 (A Resolution of the Common Council of the City of Lafayette, Indiana, Authorizing the Participation of Said City in the Motor Fuel Budgeting Program of the Indiana Bond Bank, The Execution of the Qualified Entity Reimbursement Agreement in Connection Therewith and Other Related Matters) by title only on first and final reading. Councilmember Klinker moved for passage, Councilmember Nargi seconded. Jeremy Diehl, Controller spoke regarding the program for 2024. Resolution 2023-27 passed 8-0 on a roll call vote on first and final reading. Councilmember Snyder moved for passage; Councilmember Reynolds seconded. Resolution 2023-28 passed 8-0 on a roll call vote on first and final reading. Perry Barbee, 3700 Redbud, spoke in support of the resolution.
