MINUTES OF THE LAFAYETTE COMMON COUNCIL April 1st, 2024 REGULAR MEETING (https://www.youtube.com/user/CityofLafayetteIN/live The Common Council of the City of Lafayette, Indiana met in regular session Monday, April 1, 2024 at 6:00 pm. In the Common Council Chamber at 20. N 6th Street. President Snyder called the meeting to order at 6:00 pm. The Pledge of Allegiance Present: Klinker, Nargi, Snyder, Hession Weiss, Reynolds, Brown, Ahlersmeyer, Weast- Williamson, Downing City Clerk Cindy Murray and City Attorney Jacque Chosnek were present. Public Hearing: Councilmember Klinker moved to recess for a public hearing on Ordinance 2024-06 (An Ordinance Vacating A Portion Of An Alley And A Portion Of Fulton Street Within The City Of Lafayette, Indiana) Councilmember Nargi seconded. The Motion passed by unanimous voice vote. John Schrader, Ball Law attorney, spoke regarding this ordinance. No other public comment was heard. Ordinance 2024-09 (An Ordinance Vacating A Portion Of 1st Street In The City Of Lafayette, Indiana) No public comment was heard. Ordinance 2024-11 (An Ordinance For Additional Appropriation In The General Fund (Fund#1010) Fire Department (Dept #010) No public comment was heard. Resolution 2024-11 (A Resolution Declaring The Designation Of Certain Real Estate As An Economic Revitalization (ERA) And Approving The Application For Property Tax Abatement Kregger, LLC (LH Industrial Supplies)-Real Property) No public comment was heard. Councilmember Klinker moved to reconvene the regular meeting. Councilmember Nargi seconded. Motion passed by unanimous voice vote. Approval Of Minutes Councilmember Reynolds moved to approve the minutes of the March 4th, 2024, meeting. Councilmember Hession Weiss seconded. Motion passed by unanimous voice vote. There were no Disposal of Claims, Petitions or Communications. The Clerk stated the following reports are available in the City Clerk’s Office: Renew Department Monthly-February Water Works Department Monthly-February Fleet Department Monthly- February Ordinances for Second Reading The Clerk read Ordinance 2024-06 (An Ordinance Vacating A Portion Of An Alley And A Portion Of Fulton Street Within The City Of Lafayette, Indiana) by title only on second and final reading. Councilmember Hession Weiss moved for passage; Councilmember Brown seconded. Jacque Chosnek stated since John Schrader already gave the whole presentation during the public hearing that we did not need to hear it all again but if anyone had questions they could ask those now. Ordinance 2024-06 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2024-08 (An Ordinance Of The Common Council Of The Lafayette, Indiana Approving The Pledge Of Local Income Tax Revenues To The Payment Of The Bonds Of The City Of Lafayette Redevelopment District In Accordance With A Joint Economic Development Agreement And Approving Other Matters In Connection Therewith) by title only on second and final reading. Councilmember Ahlersmeyer moved for passage, Councilmember Weast-Williamson seconded. Dennis Otten, Bose-McKinney & Evans, spoke regarding this Ordinance. Ordinance 2024-08 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2024-09 (An Ordinance Vacating A Portion Of 1st Street In The City Of Lafayette, Indiana) by title only on second and final reading. Councilmember Weast-Williamson moved for passage, Councilmember Downing seconded. Jacque Chosnek, City Attorney, spoke regarding this Ordinance. Ordinance 2024-09 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2024-10 (An Ordinance Of The Common Council Of The City Of Lafayette, Indiana, Authorizing The Issuance Of One Or More Series Of The City Of Lafayette, Indiana Taxable Economic Development Lease Rental Revenue Bonds (John Purdue Block Project), The Lending Of The Proceeds Thereof To The Lafayette Urban Enterprise Association, Inc., The Funding Of A Forgivable Loan From Certain Readi Funds To John Purdue Block Partners, LLC, And Authorizing And Approving Other Actions Related Thereto) by title only on second and final reading. Councilmember Klinker moved for passage, Councilmember Nargi seconded. Dennis Otten, Bose-McKinney & Evans, spoke regarding this Ordinance. Ordinance 2024-10 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2024-11 (An Ordinance For Additional Appropriation In The General Fund (Fund#1010) Fire Department (Dept #010) by title only on second and final reading. Councilmember Reynolds moved for passage, Councilmember Hession Weiss seconded. Jeremy Diehl, City Controller, spoke regarding this Ordinance. Ordinance 2024-11 passed 8-0 on a roll call vote on second and final reading. The Clerk read Ordinance 2024-12 (An Ordinance Authorizing The Acquisition, Construction, Installation, And Equipping By The City Of Lafayette, Indiana, Of Certain Improvements And Extensions To The Sewage Works Of The City; Authorizing The Issuance And Sale Of Sewage Works Revenue Bonds For Such Purpose; Providing For The Collection, Segregation, And Distribution Of The Revenues Of The Sewage Works And The Safeguarding Of The Interests Of The Owners Of Said Sewage Works Revenue Bonds; Other Matters Connected Therewith; And Repealing Ordinances Inconsistent Herewith) by title only on second and final reading. Councilmember Brown moved for passage, Councilmember Ahlersmeyer seconded. Jacque Chosnek, City Attorney, spoke regarding this Ordinance. Ordinance 2024-12 passed 8-0 on a roll call vote on second and final reading. Ordinances for First Reading The Clerk read Ordinance 2024-13 (An Ordinance To Amend The Zoning Ordinance Of Tippecanoe County, Indiana-UZO Amendment 108) by title on first reading. Councilmember Weast-Williamson moved for passage; Councilmember Downing seconded. Jacque Chosnek, City Attorney, spoke regarding this Ordinance. Ordinance 2024-13 passed 8-0 on a roll call vote for first reading. The Clerk read Ordinance 2024-14 (An Ordinance To Amend The Subdivision Ordinance Of Tippecanoe County, Indiana-USO Amendment 13) Councilmember Klinker moved for passage; Councilmember Nargi seconded. Jacque Chosnek, City Attorney, spoke regarding this Ordinance. Ordinance 2024-14 passed 8-0 on a roll call vote on first and reading. The Clerk read Ordinance 2024-15 (An Ordinance To Amende The Zoning Ordinance Of Tippecanoe County, Indiana, To Rezone Certain Real Estate From R2U To PDRS-400 N 9th Street-Joshua P. Thiel, Petitioner) by title on first and final reading. Councilmember Reynolds moved for passage; Councilmember Hession Weiss seconded. Kevin Riley, RTS Law, spoke regarding this Ordinance. Ordinance 2024-15 passed 8-0 on a roll call vote on first and final reading. The Clerk read Ordinance 2024-16 (An Ordinance To Amend Ordinance 2023-46 An Ordinance Fixing The Salaries Of The Appointed Officers And Employees Of The City Of Lafayette, Indiana, For The Year 2024, Excluding The Sworn Protective Occupation And Law Enforcement Members Of The Police And Fire Departments) by title on first reading. Councilmember Brown moved for passage; Councilmember Ahlersmeyer seconded. Jacque Chosnek, City Attorney, spoke regarding this Ordinance and went through each change. Discussion ensued. Ordinance 2024- 16 passed 8-0 on a roll call vote on first reading. The Clerk Read Ordinance 2024-17 (An Ordinance Vacating A Portion Of Maiden Lane In The City Of Lafayette, Indiana) by title on first reading. Councilmember Weast-Williamson moved for passage; Councilmember Downing seconded. Jacque Chosnek, City Attorney, spoke regarding this Ordinance. Discussion ensued. Ordinance 2024-17 passed 8-0 on a roll call vote on first reading. Councilmember Klinker moved to set public hearing for May 6th, 2024 at 6:01pm, Councilmember Brown seconded. Public Hearing set for May 6th, at 6:01pm passed by unanimous voice vote. Resolutions The Clerk read Resolution 2024-14 (A Resolution Confirming The Designation Of Certain Real Estate As An Economic Revitalization Area (Era) And Approval Of An Application For Property Tax Abatement Kregger, LLC (LH Industrial Supplies) Real Estate) by title on first and final reading. Councilmember Downing moved for passage; Councilmember Klinker seconded. Dennis Carson, Redevelopment Director, spoke regarding this Resolution and gave a chance for questions. Resolution 2024-14 passed 8-0 on a roll call vote on first and final reading. The Clerk read Resolution 2024-15 ( A Resolution Of The City Of Lafayette, Indiana (I) Approving And Authorizing The Execution Of A Lease Among The Lafayette Urban Enterprise Association, Inc., As Lessor, And The City Of Lafayette Redevelopment Commission And John Purdue Block Partners, LLC, As Lessees, And (II) Pledging General Revenues Of The City To The City Of Lafayette Redevelopment Commission For The Payment Of Lease Rentals Under Such Lease)by title on first and final reading. Councilmember Reynolds moved for passage; Councilmember Hession Weiss seconded. Dennis Otten, Bose-McKinney & Evans, spoke regarding this Resolution. Resolution 2024-15 passed 8-0 on a roll call vote on first and final reading. The Clerk read Resolution 2024-16 (A Resolution To Transfer Appropriation Between Major Budget Classification) by title on first and final reading. Resolution 2024-16 passed 8-0 on a roll call vote on first and final reading.
