LAFAYETTE HEARING AUTHORITY
March 27, 2012
The Lafayette Hearing Authority met on Tuesday, March 27, 2012 at 9:30 a.m. in the City Council
Chambers of Lafayette City Hall. Present were: Ron Shriner, Gary Henriott and Cindy Murray.
Ed Chosnek, City Attorney, was also present.
Mr. Shriner called the meeting to order.
MINUTES
Mr. Henriott moved for approval of the September 13, 2011 minutes. Mrs. Murray seconded. Motion
Carried.
NEW BUSINESS
Order to Comply and Notice to Appear at Demolition Hearing -1311 Morton Street
Scott Dieterle, Engineer’s Office, stated that the property owner is New Era Missionary Baptist Church
and has had no communication with them to date. Mr. Dieterle stated that the house is in bad condition
with the foundation cracking and deteriorating in several locations. The roof is in disrepair along with the
fascia falling off the house. Mr. Chosnek stated that the church is a voluntary association which is a form
of an organization that is allowed by the State of Indiana. Mr. Chosnek explained that the association was
dissolved in 1999 which in turn means that no one owns the property. Mr. Chosnek stated that the best
way to clear title to the property would be for the city to order the demolition and place a lien on the
property. Mr. Henriott moved to affirm order of demolition. Mrs. Murray seconded. Motion Carried.

Mr. Dieterle stated that when the property was brought to his attention the owner of the garage was
Federal National Mortgage Association. With a recent look at the tax records they indicate a new owner
purchased the property on March 13, 2012. Mr. Dieterle stated that he sent a letter to the new owners
regarding the order to appear. Mr. Dieterle received a phone call from the new owner who expressed
interest in rehabilitating the garage if possible, if not demolishing it himself. Mr. Henriott moved to table
this item. Mrs. Murray seconded. Motion Carried. This item will be continued on the agenda until the
next meeting.
The Board asked Mr. Dieterle to compile a report of all of the properties that he has had contact with for
submission to the Board at the next meeting. The list/report should include all the structures that have
been demolished, repaired, rehabilitated and notices sent. The list/report should include the
accomplishments either directly or indirectly by the Hearing Authority. Before and after pictures of the
structures were requested.

Interior front entrance has drywall collapsing from ceiling and wood structure rotting
Tree leaning on house damaging roof and fascia
Back stairway to second floor unstable and not to code
Tree on West side of house leaning over house next door and looks unsafe

Has a severe lean to the West and in danger of collapsing
Foundation has deteriorated

Recommendation: New owners purchased property on March 13, 2012. I recommend we table this until I
can talk with new owners.
