CALL TO ORDER Mayor Sheehy called the meeting to order at 6:00 p.m. 2. INVOCATION: Pastor Dale Ray, Lakeview Community Church Pastor Dale Ray with Lakeview Community Church gave the invocation. 3. PLEDGE OF ALLEGIANCE: Chillin 'n Swillin Ms. Gina Gutierrez with Chillin ‘n Swillin led in the Pledge of Allegiance. 4. ROLL CALL Present: 7- Mayor Cal Sheehy, Vice Mayor David Lane, Councilmember Jeni Coke, Councilmember Gordon Groat, Councilmember Michele Lin, Councilmember Donna McCoy and Councilmember Jim Dolan 5. CALL TO THE PUBLIC Mr. Mike Mathers, resident, addressed the Council concerning traffic control at the intersection of Acoma Boulevard and Saratoga Avenue. He said the City installed a three-way stop at this intersection; however, just recently there was an accident involving a golf cart that was struck by a vehicle at the golf cart crossing. He said he believes the issue is because of the two lanes of traffic (one straight lane and one turn lane) and poor visibility of the signs. He suggested that the City install a sensor that can recognize approaching golf carts and activate warning lights to bring attention to golf carts that are crossing. Ms. Lisa Krueger, President of the Lake Havasu Area Chamber of Commerce, addressed the Council and introduced several new chamber members. She also thanked the City for installing new holiday decorations on McCulloch Boulevard. Mr. James Campbell, resident, addressed the Council concerning traffic issues and safety. 6. CORRESPONDENCE, COMMUNICATIONS, PETITIONS, ANNOUNCEMENTS, CITY MANAGER REPORT 7.1 ID 19-2215 Announce Vacancies on Lake Havasu City Boards, Committees, and Commissions (Kelly Williams) City Clerk Kelly Williams announced the current vacancies on various Lake Havasu City Boards, Committees, and Commissions. 7.2 ID 19-2218 City Manager’s Report (Jess Knudson) City Manager Jess Knudson reported on the following: • Announced various certificates of appreciation, welcoming, and ribbon cutting ceremonies. • Mayor Sheehy proclaimed Saturday, November 30, 2019, as “Small Business Saturday” to support shopping locally and visited with 10 local businesses in Lake Havasu City. • Invited the community to attend the 17th Annual Community Dinner on Friday, December 13, 2019, (with two seatings) at 4:00 p.m. and 6:00 p.m. • Household Hazardous Waste Day will be held on Saturday, December 14, 2019, from 8:00 a.m. to 12:00 p.m., at the Public Works Maintenance Facility located at 900 London Bridge Road. • The Lake Havasu City Fire Department received a $500 donation from the Havasu Regional Medical Center Auxiliary to restock the supply of Knox ® Boxes for residents. • The next Coffee with the Mayor and City Manager will be held on Friday, December 6, 2019, from 8:30 a.m. to 10:00 a.m., at the Lake Havasu City Council Lake Havasu City Page 2 Printed on 12/13/2019 City Council Minutes - Final November 26, 2019 Chambers located at 2360 McCulloch Boulevard with guest speaker City Magistrate Mitchell Kalauli. Vice Mayor Lane thanked the Tamarack Neighborhood Watch group and Mr. Knudson for their generous donations towards the Annual Community Dinner. 8. PUBLIC HEARINGS 8.1 ID 19-2198 Adopt Ordinance No. 19-1224 Amending Lake Havasu City Code Section 3.20.040, Schedule of Fees and Service Charges and Updating Costs Recovered (Jill Olsen) Administrative Services Director Jill Olsen advised that the item before Council is the adoption of an ordinance amending the schedule of fees and service charges and updating costs recovered. Ms. Olsen stated that the City’s fees and service charges are reviewed annually in accordance with the City Code. She noted that there were a few minor changes to the fees this year, and explained that the City applied a Consumer Price Index (CPI) of 1.9 percent therefore none of the fees increased dramatically. Ms. Olsen said at the introduction of the ordinance there was discussion regarding how often the fees should be adjusted as adjustments on an annual basis may be an inconvenience for some users of the fees. She said staff is recommending that the Council review the fees on an annual basis but apply CPI to the fees every two years, with a full study and adjustment of the fees every four years. Ms. Olsen noted that the fees within the ordinance are the same as proposed at introduction with the exception of the Youth Camp fee, which did not increase. Mayor Sheehy said he was in favor of the schedule proposed by staff for reviewing and adjusting the fees. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Vice Mayor Lane moved to adopt Ordinance No. 19-1224 amending Lake Havasu City Code Section 3.20.040 and updating costs recovered, seconded by Councilmember Groat, and carried by the following vote: Aye: 7 - Mayor Sheehy, Vice Mayor Lane, Councilmember Coke, Councilmember Groat, Councilmember Lin, Councilmember McCoy and Councilmember Dolan 8.2 ID 19-2196 Adopt Ordinance No. 19-1226 Amending Lake Havasu City Code Section 5.20, Vacation Rentals (Kelly Garry) City Attorney Kelly Garry stated that this ordinance was introduced at the last meeting and Lake Havasu City Page 3 Printed on 12/13/2019 City Council Minutes - Final November 26, 2019 no changes were made to the proposed language. Ms. Garry said vacation rentals are a matter of statewide concern, which means the State forms the regulations and the City can only regulate to the extent allowed by state statutes. Ms. Garry highlighted the significant changes and added that staff recommends adoption of this ordinance. Mayor Sheehy opened the public hearing. Mr. Norman Stephens, resident, addressed the Council concerning a vacation rental located next to his house. He said he is glad to see the City taking up this issue as he has tried contacting Governor Ducey’s office and has only received one response stating that he is unable to see the Governor personally. He said he would like to see vacation rentals prohibited in residential areas as they are a disruption to the neighborhoods. Mr. Stephens said what the Council is adopting is a step forward but is not the solution. Ms. Nancy Campbell, resident, addressed the Council and asked how many days is considered short term. Mayor Sheehy replied that short term is anything less than 30 days. There being no further comments, Mayor Sheehy closed the public hearing. Mayor Sheehy said this is the final adoption of this ordinance using the limited tools that the State has given the City. He said the City will continue to work with the State Legislature and local delegation to get additional opportunities and advocate for local control. He added that they are making some progress, as Governor Ducey has changed his position and is open to discussion. Councilmember Dolan moved to adopt Ordinance No. 19-1226 amending Lake Havasu City Code Section 5.20, Vacation Rentals, in its entirety, seconded by Councilmember McCoy, and carried by the following vote: Aye: 7 - Mayor Sheehy, Vice Mayor Lane, Councilmember Coke, Councilmember Groat, Councilmember Lin, Councilmember McCoy and Councilmember Dolan 8.3 ID 19-2213 Approve Cooperative Purchase for Tennis Court Resurfacing from Elite Sport Builders, LLC (Mike Keane) Parks and Recreation Director Mike Keane advised that this item is to approve a contract with Elite Sport Builders, LLC, to resurface the tennis courts at the Lake Havasu High School. He said the Intergovernmental Agreement (IGA) with the Lake Havasu Unified School District No. 1 is agreed upon that the tennis courts be resurfaced periodically. Lake Havasu City Page 4 Printed on 12/13/2019 City Council Minutes - Final November 26, 2019 Councilmember Lin asked if the gates to the tennis courts are locked, to which Mr. Keane replied that they are locked in the evenings. Mayor Sheehy stated that the tennis courts are a part of the City’s assets through this agreement and are open to the public. Mr. Keane added that as part of the public joint use of public properties the tennis courts are open to the public most of the day except when the school is utilizing them. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Councilmember Coke moved to approve the cooperative purchase for tennis court resurfacing from Elite Sport Builders, LLC, from City of Tucson’s Job Order Contract 192015 in the amount of $56,794, seconded by Councilmember Lin, and carried by the following vote: Aye: 7 - Mayor Sheehy, Vice Mayor Lane, Councilmember Coke, Councilmember Groat, Councilmember Lin, Councilmember McCoy and Councilmember Dolan 9. CURRENT EVENTS Councilmember McCoy reminded the public that the Western Arizona Council of Governments, Area Agency on Aging, provides information, assistance, and services for older adults and family caregivers. Mayor Sheehy reported on the Mohave County Water Authority. He said he and Councilmember Groat traveled to Parker, Arizona, to testify about a hearing that the Arizona Department of Water Resources hosted along the Colorado River. He added that Representative Regina Cobb also attended and said the hearing was regarding water transfers along the Colorado River and said the City stated its position that Lake Havasu City is opposed to any permanent water transfers of Colorado River water. 10.
