CALL TO ORDER Mayor Sheehy called the meeting to order at 6:00 p.m. Mayor Sheehy announced that members of the public can attend in-person or watch or listen to the meeting on Channel 4, or live stream on the City’s website. He added that public comments are being accepted by emailing the City Clerk at cityclerk@lhcaz.gov at least one-hour prior to the posted start time of the meeting. 2. INVOCATION: Pastor Andrew Cave, Lamb of God Lutheran Church Pastor Andrew Cave, Lamb of God Lutheran Church, gave the invocation. 3. PLEDGE OF ALLEGIANCE: ASU Changemakers Mr. Anthony “TJ” Cook, ASU Changemakers, led in the Pledge of Allegiance. 4. ROLL CALL Present: 7- Mayor Cal Sheehy, Vice Mayor Jeni Coke, Councilmember Nancy Campbell, Councilmember Jim Dolan, Councilmember David Lane, Councilmember Michele Lin and Councilmember Cameron Moses *Councilmembers Jim Dolan and Michele Lin were present via remote conferencing. 5. CALL TO THE PUBLIC Ms. Christine Simmons, citizen, addressed the Council and said the Protect Our Deserts (POD) group will be holding a desert clean-up event on March 27 and 28, 2021, from 8:30 a.m. to 3:30 p.m. on Paso De Oro and Colt Drive. She said their focus is to educate the public on respecting and keeping the desert safe and clean. Ms. Sara Jones, citizen, addressed the Council and spoke concerning the newspaper article that reported that the City Council is considering new taxes to generate additional revenues. She suggested the City stop cancelling special events and look at other ways of raising revenues that will not affect the residents. Ms. Jones congratulated Mohave County for recently passing Resolution 2021-17 declaring Mohave County a constitutional and Lake Havasu City Page 1 Printed on 2/10/2021 City Council Minutes - Final January 26, 2021 second amendment sanctuary county, and encouraged the City Council to become a constitutional sanctuary city. Mayor Sheehy clarified that special events are being cancelled by the event promoters not by the actions of the City. Mr. Joseph DeMulling, citizen, addressed the Council regarding a vacation rental on Saratoga Avenue that causes numerous disturbances and safety concerns. He said several of the neighboring residents are scared and concerned for the safety of their homes, animals, children, and seniors. He said he believes police officers are valuable and need support from the community; therefore, he has taken action with a neighborhood petition stating their frustration and request for the City Council to indefinitely cancel the permit of the owner of this vacation rental. Mr. Jeffrey Callen, citizen, addressed the Council and expressed his love for the community and the local Police Department and stated that he would like to donate towards masks that can be purchased for the local police officers. Ms. Kris Socash-DeMulling, citizen, addressed the Council and said the vacation rental her husband spoke about is a “bad apple” and is escalating and becoming very dangerous. She spoke concerning the impact the rental is having on the surrounding neighborhood due to trash, noise, parking, and drag racing and requested that the City revoke their permit. Ms. Socash-DeMulling said they have had to take evasive actions on their property due to vandalism and have been forced to get security systems and cameras. She said it is frustrating and is a drain on the community and the Police Department. Ms. Alune DuBray, citizen, addressed the Council and said she lives behind this vacation rental and has been dealing with the ongoing issues and disturbances for three years. City Clerk Kelly Williams read the written public comments into the record as follows: “Good evening Mayor and Council members, Starting out, I want to say that I am not a resident of Lake Havasu, but have rented a place here since Jan 1. We had never been to your fine city before this year. My wife and I both had the opportunity to work remotely and we chose Lake Havasu to enjoy warm weather and work remotely. We love your town, Everyone is friendly. It has a great location and we were(possibly still are, note sure at this point) thinking about moving to Lake Havasu permanently. However, there is one big problem. Our internet service. We were told by the owners that the internet is good in Lake Havasu. It is not. The house we are staying at has Sudden Link. I thought Frontier was bad...wow, this company is awful and it really does affect where we want to move to. We both work, our house has to have at least adequate to good internet. The Customer Service people inside are terrific. They are doing the best they can. It is not their fault. The problem is the company themselves. They laid off most of their service personnel and are now outsourcing. A guy came to my house. Fixed some things, but the real problem is in the "node on the pole in the backyard" Apparently they have to be "re-adjusted" for cold weather and then adjusted again for hot weather in the spring and summer. If they know this, why can't they just do it? Why do they have to wait until customers call because their internet isn't working because the node is not adjusted for cold weather. Because when we call we first get there answering machine or someone in another country. After that fails to solve anything, then we have to drive down to their building and wait outside for an hour until one of their overworked and underappreciated office staff calls a tech. then the tech says "there is an outage in your area". Really, well that explains why I showed up at their building and waited an hour....thanks for that!! I have heard too many times in the three weeks I have been in Lake Havasu "there is an outage in your neighborhood" and "we will get to it as soon as possible". Yes, I know there is an outage. I also know why, because whatever "node" is on top of the pole needs to be adjusted and apparently Sudden Link laid off most of the people who know how to adjust it and the 3 techies left are too busy and the outsourced techs can't do it. The outsourced guy who came two weeks ago said he would put in a ticket to have the node fixed. Regarding when it would be fixed, he said it "could be a day, it could be two weeks". When I went into the Sudden Link store today, they told me it had yet to be scheduled!!!!!! It is apparent Sudden Link can not serve the needs of Lake Havasu. Although this is the only drawback to Lake Havasu that I can see right now it is a huge one and will affect our decision on whether to come back to stay temporarily or permanently. I am spending the time to write this email because, in talking with residents(who are also very upset) they said this issue is known by the city and they are "looking into it" Please do more than look into and use your powers to find an internet provider who can provide internet. Sudden Link cannot, not because they don't have good staff, but because they have extremely poor management. Best Regards (Submitted by) Bob Barrett.” “Mayor Sheehy and Councilmembers, So, after voting yourselves a hefty pay raise, you are now discussing raising taxes on Lake Havasu City residents? How tone deaf is that? A property tax increase would not only impact property owners, but would also affect our already high rents. A sales tax increase would affect everyone, at a time when many people are already struggling to provide for their families. Raising taxes in the midst of a pandemic-driven economic downturn simply because you lack the will to balance your own budget is unconscionable and irresponsible. In the past four years I have seen the rent on my house increase by over 25% as property values have soared due to a flood of Californians fleeing a state that has been economically ravaged by the same tax and spend policies you are proposing. It drives up the cost of living and as a retiree living on a fixed Lake Havasu City Page 3 Printed on 2/10/2021 City Council Minutes - Final January 26, 2021 income, Havasu is quickly becoming unaffordable. If you’re spending more money than you’re taking in then you need to do what every citizen and business does under similar circumstances: adjust your budget. I can’t just turn on some magic money spigot if my financial resources are running low at the end of the month. Why should elected officials get a pass? Raising taxes is a go to “solution” for politicians unwilling to control their spending. You should not be excused for your ineptitude by balancing your budget on the backs of taxpayers. She added that applications are available at City Hall and on the City’s website at www.lhcaz.gov. 7.2 ID 21-2678 City Manager’s Report (Jess Knudson) City Manager Jess Knudson reported on the following: • The Lake Havasu City Fire Department was selected to participate in the Lake Havasu City Page 4 Printed on 2/10/2021 City Council Minutes - Final January 26, 2021 National Fire Protection Association (NFPA) Community Risk Reduction Pilot Program. • Fire Department Captain Green, Captain Schulenburg, and Captain Sylvester received their 40-hour Aircraft Rescue and Firefighting (ARFF) basic certification training for use and maintenance of the ARFF vehicle. • The next Coffee with the Mayor and City Manager will be held at the Lake Havasu Aquatic Center, Relics & Rods Hall, on February 5, 2021, at 8:30 a.m. • COVID-19 update. 8. PUBLIC HEARINGS 8.1 ID 21-2665 Approve Cooperative Purchase of a Lenco BearCat Armored Vehicle Using Houston-Galveston Area Council Contract No. AM10-20 (Chief Doyle) Police Captain Troy Stirling advised that this item is to approve a cooperative purchase of a Lenco BearCat armored vehicle through a Houston-Galveston Area Council contract. Captain Stirling said the Council discussed this at their November 10, 2020, meeting as it is a vehicle that the Police Department has wanted to purchase for many years. He said several of the surrounding law enforcement agencies utilize armored vehicles; however, there is at least an hour and a half response wait. Captain Stirling added that this type of armored vehicle is commonly used by law enforcement agencies in the United States and will provide enhanced protection for the officers and the SWAT team. He said the estimated build-time is approximately 10 months; therefore, if approved, the funding (utilized from General Fund savings through the CARES Act) will be carried forward into Fiscal Year 2021-22. Councilmember Campbell asked about the life expectancy of the vehicle, to which Captain Stirling stated that the department is researching ways to protect the vehicle from the elements to prolong the life expectancy for as long as possible. Mayor Sheehy opened the public hearing. Ms. Janet Grippi, citizen, addressed the Council and asked if this purchase is coming out of the City’s CARES Act funding, to which Mayor Sheehy replied yes. There being no further comments, Mayor Sheehy closed the public hearing and added that no written public comments were received. Councilmember Lane moved to approve the cooperative purchase of a Lenco BearCat Armored Vehicle in the amount of $277,016 utilizing the Houston-Galveston Area Council Contract No. AM10-20 and payment of the applicable delivery fees and taxes; and authorize the City Manager to sign the Cooperative Purchase Agreement on behalf of the City, seconded by Lake Havasu City Page 5 Printed on 2/10/2021 City Council Minutes - Final January 26, 2021 Councilmember Campbell, and carried by the following vote: Aye: 7 - Mayor Sheehy, Vice Mayor Coke, Councilmember Campbell, Councilmember Dolan, Councilmember Lane, Councilmember Lin and Councilmember Moses 8.2 ID 21-2666 Approve Sole Source Purchase of Two LIFEPAK 15 Units from Stryker Medical (Chief Pilafas) Fire Chief Peter Pilafas advised that this item is approval of a sole source with Stryker Medical for two cardiac monitors (LIFEPAK 15s) to replace two LIFEPAK 12s that have reached their service life. He said these units are used for Advanced Life Support (ALS) treatments by paramedics for diagnostics with cardiac arrhythmias and cardiac arrests and are an essential tool used during medical emergency service calls. There were no comments or questions from the Council. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing and added that no written public comments were received. Councilmember Dolan moved to approve the sole source purchase of two LIFEPAK 15 units and associated equipment from Stryker Medical in an amount not to exceed $60,000, seconded by Vice Mayor Coke, and carried by the following vote: Aye: 7 - Mayor Sheehy, Vice Mayor Coke, Councilmember Campbell, Councilmember Dolan, Councilmember Lane, Councilmember Lin and Councilmember Moses 8.3 ID 21-2664 Approve Amendment No. 1 to the Engineering Professional Services Agreement for the S-1C-24 Water Storage Tank Replacement & Expansion with Atkins (Jason Hart) Public Works Director Greg Froslie said this item is an amendment to the design contract for a replacement water tank at Booster Station 1C on Scout Drive. He said the existing 1.0 million gallons (MG) storage tank was being replaced with a 1.5 MG tank as proposed in the City’s Water Master Plan to enhance fire flows in the area; however, once the design level reached 30 percent it was discovered that the site was too small to accommodate a larger size tank and would require removal of utility poles and construction of a large retaining wall. The City requested a proposal from Atkins to replace the water tank at Booster Station 1C with the same size as the existing tank, 1.0 MG. Mr. Froslie noted that the amendment is less than $8,000, but exceeds five percent of the original contract requiring City Council approval. Councilmember Lane said the City should see a significant savings with a reduction in tank size, to which Mr. Froslie said yes it is a smaller tank and should be well within budget. Councilmember Lane moved to approve Amendment No. 1 to the Engineering Professional Services Agreement for the S-1C-24 Water Storage Tank Replacement & Expansion with Atkins, seconded by Councilmember Moses, and carried by the following vote: Aye: 7 - Mayor Sheehy, Vice Mayor Coke, Councilmember Campbell, Councilmember Dolan, Councilmember Lane, Councilmember Lin and Councilmember Moses 8.4 ID 21-2676 Approve Cooperative Purchase of Two (2) MicroTransit Vehicles from San Tan Ford Utilizing Arizona State Contract ADSPO17-166124 (Patrick Cipres) Transit Manager Patrick Cipres advised that this item is approval of two microtransit vehicles from San Tan Ford utilizing an Arizona State contract. He said the vehicles have a lead-time of 14 to16 weeks once ordered and are the first of the “demand response” microtransit pilot program that will commence in the Fall 2021. Councilmember Moses asked why the City is not purchasing these locally, to which Mr. Cipres explained that the City must abide by the Federal Transit Administration regulations and requirements purchasing through an Arizona State contract. Councilmember Moses moved to approve the cooperative purchase of two microtransit vehicles (Ford Edge) from San Tan Ford utilizing the Arizona State Contract ADSPO17-166124, in the amount of $68,554.18, seconded by Councilmember Campbell, and carried by the following vote: Aye: 7 - Mayor Sheehy, Vice Mayor Coke, Councilmember Campbell, Councilmember Dolan, Councilmember Lane, Councilmember Lin and Councilmember Moses 9. CURRENT EVENTS Councilmember Lin said at the last Parks and Recreation Advisory Board meeting the Pickleball Association reported that they are collecting money for additional amenities at the Dick Samp Park and want to be seen as partners for any future projects including lights at the pickleball courts. 10.
