CALL TO ORDER Mayor Sheehy called the meeting to order at 6:00 p.m. 2. INVOCATION: Dr. David Bybee, Christ Chapel Dr. David Bybee, Christ Chapel, gave the invocation. 3. PLEDGE OF ALLEGIANCE: Havasu Rocks Mr. Rick Kerber, Havasu Rocks, led in the Pledge of Allegiance. 4. ROLL CALL Present: 7- Mayor Cal Sheehy, Councilmember Nancy Campbell, Councilmember David Lane, Councilmember Michele Lin, Councilmember Cameron Moses, Councilmember Jeni Coke and Vice Mayor Jim Dolan *Vice Mayor Dolan was present via remote conferencing. 5. CALL TO THE PUBLIC Mr. Bruce Hubbard, citizen, addressed the council regarding the costs of retrofitting the new courthouse building compared to potentially selling the property and purchasing a new building to outfit the courthouse. He suggested the city and County look at purchasing a property together to build a courthouse. Ms. Bonnie Toy, citizen, addressed the council requesting that the city consider reducing the rates at the Aquatic Center during the summer months. Ms. Frankie Lyons, citizen, addressed the council requesting that the city do something to lower taxes. She said the city has control over the taxes and even though the property tax levy rate remains flat, it does not provide relief to the community. Ms. Lyons spoke on comments from councilmembers at the last meeting regarding the property tax rate and concerns from citizens requesting relief. She promised the council that there would be Lake Havasu City Page 1 Printed on 8/10/2022 City Council Minutes - Final July 26, 2022 citizen representation at all future budget work sessions to refresh their memory on what was discussed this year. Ms. Lyons said the increase of revenues should be used on infrastructure and council should get on board with the County’s decisions regarding the solar plant, as the city has no other source of power if Hoover Dam cannot provide electricity. Councilmember Lane commented that electricity in Lake Havasu City does not come from Hoover Dam. Mr. Gabriel Suarez, citizen, addressed the council and said he worked for the Los Angeles Police Department and has seen how a city can deteriorate due to high property taxes, homelessness, and mandatory vaccinations of employees, and added that he does not want those things to happen in Lake Havasu City. 6. PUBLIC HEARINGS 8.1 ID 22-3389 Series #7 Beer and Wine Bar Liquor License, Rickety Cricket Brewing, 2068 McCulloch Boulevard N, Suite A/Nations (Kelly Williams) Ms. Davis advised that Ms. Amy S. Nations has applied for a Series #7 Beer and Wine Bar Liquor License for Rickety Cricket Brewing located at 2068 McCulloch Boulevard N., Suite A. She said all posting requirements have been met, all fees have been paid, and no objections were received. Ms. Davis noted that the location is properly zoned for a Series #7 liquor license. Mr. Keane noted that the anonymous donor will have donated a total of $394,548.18 for the completion of the last four pickleball courts at Dick Samp Park. Mayor Sheehy said it is amazing that the city has members in the community that are willing to donate this amount of money to facilitate a passion of theirs and thanked the anonymous donor for their generous donation covering the entire cost for the completion of the pickleball courts. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Councilmember Lane moved to accept the $144,548.18 donation for construction of the final four (4) pickleball courts at Dick Samp Memorial Park, seconded by Councilmember Moses, and carried by the following vote: Aye: 7 - Mayor Sheehy, Councilmember Campbell, Councilmember Lane, Councilmember Lin, Councilmember Moses, Councilmember Coke and Vice Mayor Dolan 8.4 ID 22-3396 Award Bid for the Construction Contract to T.R. Orr, Inc., for the Dick Samp Memorial Park - Pickleball Court Improvements, Phase III (Mike Wolfe) Civil Engineer Mike Wolfe advised that this item is to award bid for the construction contract to T.R. Orr, Inc., for the Dick Samp Memorial Park Pickleball Courts Improvements Phase III. He said two bids were received on June 22, 2022, with T.R. Orr, Inc., being the apparent low bidder in the amount of $371,398.18. Mr. Wolfe noted that T.R. Orr, Inc., also completed the courts in Phase II, and explained how the courts will be connected. Mr. Wolfe said the project includes the base bid and force account which includes: grading and subgrade preparation, post tension concrete slab with court surfacing and nets, fencing, and sidewalks. Mr. Wolfe reviewed the project schedule and said the anticipated construction completion date is December 12, 2022. Councilmember Moses asked about the discrepancy in the total amount donated and total project cost. He asked if there were additional costs, to which Mr. Wolfe said a portion of Lake Havasu City Page 4 Printed on 8/10/2022 City Council Minutes - Final July 26, 2022 the initial $250,000, donation was spent on design and contract documents. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Mayor Sheehy noted that this item was funded through a generous donor with no costs to the citizens. Councilmember Lane moved to award the bid for the Construction Contract to T.R. Orr, Inc., for the Dick Samp Memorial Park - Pickleball Court Improvements, Phase III, in the amount of $371,398.18, seconded by Councilmember Coke, and carried by the following vote: Aye: 7 - Mayor Sheehy, Councilmember Campbell, Councilmember Lane, Councilmember Lin, Councilmember Moses, Councilmember Coke and Vice Mayor Dolan 8.5 ID 22-3363 Adopt Ordinance No. 22-1291 Approving a Zone Change for 2276 Leonard Lane, Tract 135D, Block 2, Lot 15A, from Golf Course (GC) to Residential Estates (R-E) District for the Portion of Lot 15A that was Purchased from the Golf Course (Luke Morris) Planning Division Manager Luke Morris said the subject property is .48 acres, undeveloped, and located at the end of Leonard Lane (cul-de-sac) near Palmer and Casper Drives. He said the residential properties in this area are zoned Residential Estates (R-E) and are developed with single-family homes. He added that the Lake Havasu City Golf Course (“golf course”) abuts the property and is zoned Golf Course (GC). He said the subject property currently has two zonings: R-E for the original lot and GC for the portion that was purchased from the golf course. He said in 2016, the city adopted the current development code and prior to that adoption the golf course was zoned R-E. He stated that concerns were expressed at that time regarding the impending sale and possible redevelopment of the golf course and as a result, the GC zoning district was created and applied to the golf courses which resulted in public hearing requirements for any rezone of the golf course property. Mr. Morris said the new golf course owners embarked on a plan to upgrade the golf course which resulted in unused portions being sold to adjacent property owners. Mr. Morris explained that the subject property owner purchased an abutting portion of the property from the golf course and tied it to their residential property in 2019, resulting in the property having both R-E and GC zoning. He stated that this request is to rezone the old golf course portion of the property from GC to R-E to match the balance of the residential lot as required by the city. Mr. Morris added that this type of rezone has occurred eight to ten times over the past several years and will allow the property owner to apply the R-E building setbacks and uses to the entire combined property. He stated that without the rezone the golf course portion of the property is limited to such uses as landscaping, grading, and retaining walls. He said the Planning and Zoning Commission heard this request at their meeting on June 15, 2022, and Lake Havasu City Page 5 Printed on 8/10/2022 City Council Minutes - Final July 26, 2022 recommended approval. Councilmember Lane moved to adopt Ordinance No. 22-1291 approving a zone change for 2276 Leonard Lane, Tract 135D, Block 2, Lot 15A, from Golf Course (GC) to Residential Estates (R-E) District for the portion of lot 15A that was purchased from the golf course, seconded by Councilmember Campbell, and carried by the following vote: Aye: 7 - Mayor Sheehy, Councilmember Campbell, Councilmember Lane, Councilmember Lin, Councilmember Moses, Councilmember Coke and Vice Mayor Dolan 8.6 ID 22-3368 Award Agreement for Professional Services for the Mulberry Treatment Plant (MTP) Aeration Basin Repairs to Narasimhan Consulting Services, Inc. (NCS) ( Kathy Raasch) Project Manager Kathy Raasch advised that this item is to award a professional services agreement for the design of the Mulberry Treatment Plant (MTP) Aeration Basin Repair Project to Narasimhan Consulting Services (NCS), Inc., and reviewed the following in her presentation: Background: • Basin walls has noticeable cracking • Structural assessment was performed earlier this year by NCS • Damage to the top of the basin walls caused by the weight and rotation of the existing bridge Recommendation for Repairs: • Remove existing bridge aeration system • Cut and remove 2-3/8-inch section of the entire basin’s wall top surface • Form and pour high strength concrete with steel mesh • Install new diffused aeration – fine bubble system Scope: • Develop a preferred configuration of a fixed grid aeration basin system • Analyze airflow and pressure requirements • Assess impacts on the existing aeration blower and control system • Provide a design report with selected recommendation • Prepare plans and specifications • Provide bid services assistance during public bid process Cost and Schedule: Lake Havasu City Page 6 Printed on 8/10/2022 City Council Minutes - Final July 26, 2022 • Assessment & design cost - $110,060 • 180 days to complete • Construction – Spring 2023 Funding: • CIP – Wastewater Utility Fund Mayor Sheehy opened the public hearing. Ms. Toy addressed the council and asked if this item includes construction costs, to which Mayor Sheehy replied no, only the design and assessment of a new aeration system. There being no further comments, Mayor Sheehy closed the public hearing. Councilmember Moses moved to award the Agreement for Professional Services for the Mulberry Treatment Plant (MTP) Aeration Basin Repairs to Narasimhan Consulting Services, Inc. (NCS), in the amount of $110,060, seconded by Councilmember Lane, and carried by the following vote: Aye: 7 - Mayor Sheehy, Councilmember Campbell, Councilmember Lane, Councilmember Lin, Councilmember Moses, Councilmember Coke and Vice Mayor Dolan 8.7 ID 22-3397 Award Bid for the Construction Contract to Perco Rock Company for the 1001 Mohican Drive Drainage Improvement Project (Mike Wolfe) Mayor Sheehy noted that Item 8.7 was tabled to give staff time to look into more cost-effective alternatives. 9. CURRENT EVENTS Councilmember Moses gave an update on the construction of the Partnership for Economic Development (PED) nomadic workspace building. Councilmember Campbell reported that she attended a Rural Transportation Advocacy Council (RTAC) meeting in Phoenix and spoke on several new projects moving forward. 10.
