CORRESPONDENCE, COMMUNICATIONS, PETITIONS, ANNOUNCEMENTS, CITY MANAGER REPORT 6.1 ID 23-3724 Announce Vacancies on Lake Havasu City Boards, Committees, and Commissions (Kelly Williams) City Clerk Kelly Williams announced the current and upcoming vacancies on various Lake Havasu City Boards, Committees, and Commissions. She added that applications are available at City Hall and on the City’s website at www.lhcaz.gov. Ms. Williams noted that the deadline to submit applications for consideration is Friday, May 26, 2023, by 5:00 p.m. 6.2 ID 23-3725 City Manager’s Report (Jess Knudson) City Manager Jess Knudson reported on the following: • Announced various ceremonies, events, and proclamations. • Recognized the retirement of John Ellena, Lake Havasu City Police Department, with 13 years of service. 7. PUBLIC HEARINGS 7.1 ID 23-3717 Accept Quit Claim Deed for Purchase of 2223 Swanson Avenue from Mohave County and Authorize Use of Contingency Funds (Kelly Garry) City Attorney Kelly Garry advised that on March 14, 2023, the City Council directed staff to make an offer to purchase the property located at 2223 Swanson Avenue from Mohave County (“County”). Ms. Garry said the subject property is currently a vacant lot located across the street from the ASU at Lake Havasu campus. Ms. Garry explained that under state law the County may sell property to a city without a public auction upon a unanimous vote from the Board of Supervisors and the purchase price must be at least 90 percent of the appraised value. Ms. Garry said the appraised value of the property was Lake Havasu City Page 2 Printed on 4/26/2023 City Council Minutes - Final April 11, 2023 $460,000 and the city offered to purchase the property at 90 percent ($414,000) plus the cost of the appraisal ($2,500) for a total purchase price of $416,500. She said if approved, staff is requesting the use of contingency funds, and added that the Board of Supervisors met on April 3, 2023, and unanimously recommended acceptance of the Quit Claim Deed. Mayor Sheehy opened the public hearing. There being no comments, he closed the public hearing. Vice Mayor Lane moved to accept the Quit Claim Deed and direct staff to remit $416,500 to Mohave County for the purchase of 2223 Swanson Avenue utilizing contingency funds within the General Fund, seconded by Councilmember Dolan, and carried by the following vote: Aye: 7 - Mayor Sheehy, Councilmember Campbell, Councilmember Lin, Councilmember Moses, Councilmember Coke, Vice Mayor Lane and Councilmember Dolan 7.2 ID 23-3730 Award Bid to Hawkke, LLC, for the Removal of Underground Storage Tanks at the Police Department and Airport Facilities in the Amount of $265,268.50 and Authorize the Use of Contingency Funds in the General Fund (Jarod Thiele) Assistant City Engineer Mike Wolfe advised that this item is to award bid for the removal of the Underground Storage Tanks (USTs) at the Police Department and Airport facilities. He said Lake Havasu City currently has five USTs, three tanks located at the Airport (no longer utilized) and two tanks at the Police Department. He said due to the age of these tanks and the cost of insuring them, the city realizes significant savings by having them removed. Mr. Wolfe said plans and specifications were prepared for the project with an invitation to bid publicized on February 15, 2023. He said bids were opened on March 22, 2023, and two bids were received, with Hawkke, LLC, being the low bidder at $265,268.50. Mr. Wolfe said the Arizona Department of Environmental Quality UST Closure documents have been processed for both facilities. He noted that, if approved, staff would coordinate with the city’s Risk Management for a 10-day notice to the city’s insurance provider for continued coverage during closure operations with construction anticipated to begin in May 2023 and completion in June 2023 to avoid additional costs for renewed insurance coverages and premiums. Mr. Wolfe stated that staff is recommending award to Hawkke, LLC, in the amount of $265,268.50, authorizing the use of contingency funds. Mayor Sheehy opened the public hearing. Ms. Bonnie Toy, citizen, addressed the council concerning the use of contingency funds versus general funds, to which Mayor Sheehy explained that contingency funds are budgeted each year for unexpected or unplanned items. Mr. Knudson said the city has $1 million budgeted in contingency funds in the current fiscal year. Lake Havasu City Page 3 Printed on 4/26/2023 City Council Minutes - Final April 11, 2023 Ms. Frankie Lyons, citizen, addressed the council and asked where the USTs would be stored once removed, to which Mr. Wolfe replied that the contractors are state certified, and the tanks would be disposed at a state approved facility. There being no further comments, Mayor Sheehy closed the public hearing. Councilmember Dolan moved to award the bid for removal of underground storage tanks at the Police Department and Airport Facilities to Hawkke, LLC, in the amount of $265,268.50 and authorize the use of Contingency Funds in the General Fund, seconded by Councilmember Moses, and carried by the following vote: Aye: 7 - Mayor Sheehy, Councilmember Campbell, Councilmember Lin, Councilmember Moses, Councilmember Coke, Vice Mayor Lane and Councilmember Dolan 8. CALL TO THE PUBLIC Ms. Evelyn Tinsley, citizen, addressed the council and asked the city to consider installing a fence along the lower field at Cypress Park to keep children from running into the parking lot. Ms. Lyons, citizen, addressed the council and spoke on lowering the rates at the Aquatic Center during the summer months. She said to offset the costs the council could utilize funding from the Go Lake Havasu contract or start charging out-of-town visitors to use the parks. She spoke on the Republic Services trash contract specifically regarding the three free bulk trash pickups that they are contractually required to provide to the residents. Ms. Lorelei Sprott, citizen, addressed the council and said there is a need in the community for two additional swimming pools and an indoor basketball area for the youth to have a place to go and be active during the summer months. Mr. Don Wisdom, citizen, addressed the council and suggested the city have golf carts that transport citizens and visitors in the downtown areas to help alleviate some of the parking concerns. 9.
