CALL TO ORDER Chairman Harris called the meeting to order at 9:01 a.m. 2. PLEDGE OF ALLEGIANCE Chairman Harris led the Pledge of Allegiance. 3. ROLL CALL Alternate Member Lehr was seated. Present: 5- Jim Harris, Donald Bergen, Gabriele Medley, Paul Lehr and Suzannah Ballard Absent: 4- Chad Nelson, Matthew Mitchell, Sam Levin and David Diaz 4. CORRESPONDENCE AND ANNOUNCEMENTS Mr. Morris stated the Swanson Multiple Family Planned Development/Rezone next to The Views was approved last night at the City Council meeting, based on the Planning Commission recommendation. 5. MINUTES Approval of Regular Meeting Minutes from June 1, 2022. Mr. Bergen made a motion to approved the minutes of the last meeting. The motion was seconded by Ms. Ballard and carried by the following vote: Aye: 5 - Harris, Bergen, Medley, Lehr and Ballard 6. PUBLIC HEARING ID 22-3326 Approval of a Conditional Use Permit for 1477 Queens Bay, APN 107-10-092, to Allow Charter and Tour Boats to Operate from Two of the “D” Docks of the London Bridge Resort. Mr. Diaz arrived at 9:04 a.m., was marked present and was seated. Lake Havasu City Page 1 Printed on 7/6/2022 Planning and Zoning Commission Minutes - Final June 15, 2022 Mr. Morris thanked the Chairman and presented a PowerPoint slideshow and narrative including some of the following key points: • The subject “D” Docks are one of four dock complexes located in the channel in front of the London Bridge Resort property. • The resort property includes the existing resort use and associated parking. • Retail shops and additional parking are located to the north of the resort use [Dock Area Map shown on screen] • The Letter of Intent states that the Sunset Charter and Tour Co. lease for the existing dock at the English Village property has not been renewed. • Therefore, they are seeking an alternate location for the dock. • They are asking to relocate from the English Village dock to the London Bridge Resort. • The request is to use two slips on the “D” Dock of the London Bridge Resort for mooring their two boats. • Loading and unloading of passengers will be from the Executive Dock just north of “D” Dock, which is also home to the Dixie Belle vessel. • The applicant advises that parking will be provided in the Resort parking lots, specifically the upper lot. • It appears the relocation should have minimal impact on the surrounding uses and boat traffic within the channel. • No objections were received from any other reviewing agencies or departments. The Fire Department and Engineering Division had comments that are addressed in the proposed conditions of approval. Kenny & Jeanine Samp, husband and wife run the Sunset Charter Tour Co, specializing in guided tours of Lake Havasu. Mr. Samp stated they have been in operation for fifteen years, thanked the Commission for their consideration of this item, and stated they were available for questions. Mr. Diaz asked where they are currently docked? Jeanine Samp said they used to be in the English Village, on the north side of London Bridge, and their vessel was resided in the docks right in front of the London Bridge. When questioned by Mr. Diaz if anyone else uses the docks, Mr. Samp stated they are considered a courtesy dock during the day and rental slips during the evening. Sunset Tours would now be assuming two of the docks out of the "D" Dock configuration - closest to the sea wall. Ms. Ballard asked if there are any other charter or tour boats that operate off of any of these docks. Mr. Samp stated the Dixie Bell has the executive dock. He stated that when the boats are not being in operation, they will live on "D" Dock and when it is time to tour, they will bring the boat out to the executive dock, gather the clients, load them onto the boat and then share Lake Havasu with them. Mr. Lehr asked if there will be any amenities or ticket booth that will be added. Mr. Samp stated they have assumed the building right at the foot of the stairs- Sunset Charter and Lake Havasu City Page 2 Printed on 7/6/2022 Planning and Zoning Commission Minutes - Final June 15, 2022 Tour Company that will have a ticket booth, which is in progress. Chairman Harris opened the Public Hearing, hearing none, he closed the Public Hearing. Mr. Morris stated that based on the findings, the Development Review Committee recommends approval of Land Use Action 22-3326 for a Conditional Use Permit for 1477 Queens Bay, APN 107-10-092, to allow charter and tour boats to operate from two of the “D” Docks of the London Bridge Resort, with the following conditions: 1. The property owner shall contact the Fire Department concerning service of the private fire hydrants and standpipe cabinets for the docks prior to business operation. 2. All appropriate permits shall be obtained prior to business operation at this location. 3. The boat businesses must obtain a City business license for this location prior to operation. 4. Vessel repair, outside of routine maintenance, shall be prohibited at the docks. 5. Because of limited pedestrian space in this area, a ticket booth shall not be located in front of the docks. 6. All loading and unloading of passengers shall be done from the Executive Dock. 7. The London Bridge Resort shall provide parking spaces on-site for this use. 8. No additional signage shall be allowed on or near the docks, except directional signage may be allowed on the property not to exceed 2 signs at 6 square feet per sign. Chairman Harris asked the applicants if they were okay with all the conditions of approval stated and the applicants affirmed. Ms. Medley made a motion to approve Action Item 22-3336 with staff's 8 recommendations, [a Conditional Use Permit for 1477 Queens Bay, APN 107-10-092, to allow charter and tour boats to operate from two of the “D” Docks of the London Bridge Resort, be approved with the following conditions: 1. The property owner shall contact the Fire Department concerning service of the private fire hydrants and standpipe cabinets for the docks prior to business operation. 2. Mr. Lehr assumed the Chair responsibilities. Mr. Morris thanked the Chairman and presented a PowerPoint slideshow and narrative including some of the following key points: • The subject property measures .48 acres and is undeveloped. • It is located at the end of the Leonard Lane cul-de-sac near Palmer and Casper Drive. • The residential properties in the area are zoned R-E and developed with single-family homes. • The Lake Havasu City Golf Club abuts the property and is zoned CG. • The property currently has two zoning districts, Residential Estates (R-E) and Golf Course (GC). • The property owner purchased an abutting portion of property from the golf course and tied it to their residential property in 2019, resulting in the property having both R-E and GC zoning. • This request is to rezone the old golf course portion of the property from GC to R-E, so it will match the balance of the residential lot. • In 2016, the City adopted the current Development Code. • Prior to that adoption, the golf course was zoned R-E just like all the adjacent residential lots. • Concern was expressed at that time regarding the impending sale and possible redevelopment of the course. • As a result, the Golf Course District was created. [Property Map shown on screen] • The new golf course owners embarked on a plan to upgrade the golf course, which resulted in unused portions being sold to some of the adjacent residential owners. • The Zoning Administrator determined these small pieces needed to be rezoned in order for the residential owners to develop the property as one lot. • The rezone will allow the property owner to apply the R-E building setbacks and uses to the entire combined property. • Without the rezone, the GC portion of the property is limited to landscaping, grading, and retaining walls. It was left un-rezoned and he is here today to rezone the property, so that it is all consistent and can be built upon. Acting Chairman Lehr opened the Public Hearing, hearing none, he closed the Public Hearing. Mr. Morris stated that based on the findings, the Development Review Committee recommends the Planning Commission recommend approval of Land Use Action No. 22-3327 for a Zone Change for 2276 Leonard Lane, Tract 135D, Block 2, Lot 15A, from Golf Course (GC) to Residential Estates (R-E) District for the Portion of Lot 15A that was Purchased from the Golf Course. This item will go to the July 26, 2022 City Council meeting. Mr. Diaz made a motion to approve [recommend the City Council approve Land Use Action No. 22-3327 for a Zone Change for 2276 Leonard Lane, Tract 135D, Block 2, Lot 15A, from Golf Course (GC) to Residential Estates (R-E) District for the Portion of Lot 15A that was Purchased from the Golf Course]. The motion was seconded by Ms. Ballard and carried by the following vote: Aye: 5 - Bergen, Medley, Diaz, Lehr and Ballard 7. CALL TO PUBLIC None. 8. FUTURE MEETING The next Regular meeting is scheduled for July 6, 2022. 9.
