He gave many letters from neighbouring residents in opposition to the annexation and rezoning of Midlothian Manor to the Village Clerk. CONSENT AGENDA A. Approval of Minutes from the Village Board Meeting of September 18, 2023 B. Approval of Minutes from the Village Board Meeting of October 16, 2023 C. Approval of Semi'Monthly Warrant Register Dated November 6, 2023 Totaling $1,900,044.03 D. Reduction in Letter of Credit to $10,200 for Journey Cremations at 495 Enterprise Parkway Summaryi Journey Cremations has constructed its new direct cremation establishment at 495 Enterprise Parkway. A guarantee of site improvements in the form of a Letter of Credit for $102,000 was provided to the Village for site earthwork, storm sewer and detention improvements, site paving, and landscaping. This work has been completed and a reduction t0 10% of the original letter of credit to be held for two years is now warranted. E. Amendment to Utilities Services Easement and Development Agreement by and between the Village of Lake Zurich and Kildeer Ventures LLC doing business as Buona Beef at Kildeer Crossings Subdivision at 21591 North Rand Road in Kildeer and the Accompanying Plat of Easement Dedication Summary: This agreement allows the Village 0f Lake Zurich to provide potable water and sanitary sewer services to Lot 1 only of Bradford’s 4-lot commercial Village of Lake Zurich Board of Trustees Regular Meeting. November 6th 2023. 2 subdivision Within Kjldeer Crossings, which is currently under development With a Buona Beef restaurant. The agreement amendment also references a plat of easement dedication, establishing perpetual easements over Lake Zurich’s utilities extending along the periphery of the lot. This easement dedication accommodates Buona Beefs site design and clarifies the property owner’s and Lake Zurich’s rights and responsibilities for restoration should the site be disrupted for utility repair. Change Order Request With Floors Incorporated for Buffalo Creek Dance Floor in the Additional Amount of $8,500 Summary: At the September 18, 2023 Board meeting, Trustees approved an agreement with Floors Incorporated in the amount of $42,500 to install an ADA-accessible wood sprung dance floor at Buffalo Creek Building B. Due to the original bid not including any contingency amounts associated with unknown issues, a change order for additional funds is requested in order to provide proper floor leveling prior to the installation. Trustee Spacone asked if there was money in the budget for Agenda Item #5F and Village Manager responded in the afhrmative. Recommended Action: A motion was made by Trustee Weider, seconded by Trustee Euker. AYESI 6 Trustees Bobrowski, Euker, Riley, Spacone, Sugrue, Weider. NAYSI 0 ABSENT: 0 MOTION CARRIED. NEW BUSINESS A. Fire Pension Municipal Compliance Report and Tax Levy Request Summary: The Illinois Pension Code requires the Village levy a tax each year to meet the actuarial requirements of the Fire Pension Fund. The Lake Zurich Fire Pension Board is requesting a tax levy in the amount of $2,842,641 for the Village Board to consider. Last year, the Fire Pension Board requested a levy of $2,512,418 and the actual levy was $2,386,797. The Fire Pension Fund is now 7 1.79% funded, a decrease of 3.05% on an actuarial value from last year’s status of 74.84% funded. Lt. Spencer Cordell, LZFD, addressed the Board. Staff answered the Board members questions on the decrease in contributions, who administered the fund (State of Illinois) and a request for more information from a Trustee. Recommended Action: No Village Board action requested at this point. This tax levy request is for informational purposes only. Lake Michigan Water Funding Presentation Summaryi Over the past decades, the Village of Lake Zurich has contemplated transitioning away from relying on deep-aquifer wells to Lake Michigan as its source for the community’s water supply. A confluence of factors, including preserving an IEPA allocation for Lake Michigan water, increasing environmental regulation, the long-term sustainability of the aquifer, and upcoming capital reinvestment in the existing system, have brought Lake Michigan to the forefront of the Village’s water supply options.  Village of Lake Zurich Board of Trustees Regular Meeting. November 6th 2023. 3 In May 2023, the Village Board adopted a Resolution expressing the intent of Lake Zurich to join the Central Lake County Joint Action Water Agency to secure Lake Michigan as the community’s future source of potable water. The Board also approved an agreement With CDM Smith to take the next procedural and analytical steps toward transitioning to a Lake Michigan water supply, including construction and operating cost projections. These decisions were preceded by in-depth analyses into the feasibility of Lake Michigan vs. staying on deep water wells, a major reduction in the Village’s water loss rate, and ongoing reinvestment in the Village’s water distribution system. CDM Smith had previously estimated that constructing the improvements to connect t0 Lake Michigan through CLCJAWA would require approximately $154 million, with a planned construction window of 2026-2027. Staff, CDM and CLCJAWA have explored possible funding approaches and will share their recommendations for funding the transition to Lake Michigan water. Village Manager Ray Keller gave a Powerpoint presentation on the Enterprise Fund, the proposed Lake Michigan water allocation, preliminary cost of $154m, funding possibilities, timeline. There were two options proposed for the funding — Option 1 would be increases in water billing for households after the IEPA grants and Option 2 would be the IEPA grants, a lower increase in water billing for house holds and an 0.5% increase in the sales tax, spreading the costs with non-residents. There would be a referendum on the November 2024 ballot for the voters. Also addressed in the PowerPoint was staying on well water and the costs of maintenance etc plus the removal and disposal of radium, which Lake Co. soon will not take. Board members asked questions and the staff and guests answered them. They included supply chain issues, contingency plans during transition, CLCJAWA membership, allocation timeline, keeping two wells, and senior discount retained. Village Manager Keller stated that all materiels will be posted on the Village’s website. Recommended Actioni No Village Board action requested at this time. Stag will prepare the appropriate action items for a future board meeting, based on the Village Board’s direction. PRESIDENT’S REPORT / COMIMUNITY UPDATE There was none.
