City Council Regular Meeting DRAFT Minutes Monday, November 22, 2021 at 7:00 PM 27400 Southfield Road, Lathrup Village, Michigan 48076 In accordance with Emergency Orders issued by the Michigan Department of Health and Human Services, Oakland County, local officials, and State of Michigan legislation, which allows for electronic meetings of public bodies, notice is hereby given that the City of Lathrup’s City Council will be meeting electronically using www.Zoom.us for videoconference and public access. 1. Call to Order by Mayor Garrett at 7:07 p.m.(in accordance with PA 254 of 2020, the members should identify their physical location by stating the county, city, township, or village and state from which he or she is attending the meeting remotely). 2. Roll Call Mayor Mykale Garrett and Mayor Pro Tem Bruce Kantor Council members: Ian Ferguson, Dawn Medley and Saleem Siddiqi All present are in Lathrup Village, MI – Oakland County. Council member Dawn Medley is located in Setauket, NY – Suffolk County. Present: City Administrator, Dr. Sheryl L. Mitchell Theriot, Assist. City Administrator/Treasurer, Pamela Bratschi, City Attorney, Scott Baker, Police Chief, Scott McKee, Director, Community and Economic Development/DDA, Susie Stec, Government Services, Kelda London and City Clerk, Yvette Talley 3. Pledge of Allegiance 4. Presentation – Rep Kyra Harris Bolden Currently she is working on Health care issues, criminal justice reform and Economic Development- Liquor license amendment- If you have Downtown Development Authority Zone, it will allow you to have a special liquor license permit for redevelopment and not just for rehabilitation of a property. Victim’s rights bills will take away FOIA for civil suit – if you are alleging sexual misconduct. Working on appropriations and was able to get 1 million dollars for the 35th District, in which Lathrup Village will receive $200,000 for infrastructure. Official Comments and Reports Council member Ferguson stated – he attended the Southfield School Board meeting as Lathrup Village liaison to keep the line of communications and joint partnership going. He expressed his appreciation for the support he received while on City Council. Council member Siddiqi stated- he thanked everyone for their support and it was an honor to serve on City Council. Council member Medley stated – It was a pleasure to work with everyone and wished the best for Lathrup Village. Also, she appreciates the leadership courage that was brought to City Council. Mayor Pro Tem Kantor stated- thanked everyone for working well together to get a lot of procedures and policies done. There is a lot to be proud of. Mayor Garrett – thanked the City Council for getting a lot of things done. The support she has received have been overwhelming and she’s thankful for the caring spirit. Attorney Scott Baker – thanked the entire City Council for the tireless hours spent working on the behalf of the City. Dr. Sheryl Mitchell Theriot thanked everyone for the time, effort and passion put forth in all the work that you do. Pamela Bratschi – thanked City Council for all of their support when she was acting City Administrator/Treasurer. 6. Results of voting – 3 to 2 in favor of nominating Mykale Garrett for Mayor of the City of Lathrup Village. Public Comments for Items on the Agenda (Speakers are limited to 3 minutes) None 18. A. Public Hearings – Community Block Grant – Program Year 2022 Dr. Sheryl Mitchell Theriot gave an overview and answered specific questions. There will be allocations for $3,500 for senior services and $3,500 for transportation services for the senior population. Haven submitted a written public comment requesting $2,500 for FY-2022 for those who experience domestic violence or sexual assault. Mayor Garrett opened the public hearing. There were no public comments. Received a written public comment from HAVEN. Mayor Garrett closed the public hearing. Motion by Mayor Pro Tem Kantor, seconded by Council member Jennings to Adopt the Attached Resolution regarding the proposed use of the Program Year 2022 Community Development Block Grant Funds in the approximate amount of $7,000. The RFP was issued on October 1, 2021, with responses due by November 1, 2021. Two responses were received: CAC Real Estate Services Keller Williams/Jon Ruud – Associate Dr. Mitchell Theriot and Susie Stec both scored the bids with the highest score being Keller Williams/Ruud Associates. Council member Miller asked about the Comprehensive Plan and Attorney Scott Baker gave an Overview and answered specific questions. The initial RFP that went out was trying to solicit ideas. Council decided to list the property to let the market decide. The city was offered less than half of what the property is worth. Susie Stec stated it was presented as a concept and the public did comment on it. Residents preferred to have the property sold as residential property. Motion by Council member Jennings, seconded by Mayor Pro Tem Kantor to Award the bid for Real estate Services to Keller Williams/Ruud Associates for the House in the Woods Property, located at 19600 Forest Drive and authorize the City Attorney to review/prepare appropriate contract documents for Council consideration. Professional Services Contract with Hubbell, Roth & Clark – Environmental Engineering Services for MS4 & StormWater Permit Requirements. Dr. Sheryl Mitchell Theriot gave an overview and answered specific questions. Motion by Mayor Pro Tem Kantor, seconded by Council member Jennings to Approve the Proposal from Hubbell, Roth & Clark for Environmental Engineering and stormwater Requirements, in the amount of $7,825 and authorize the Mayor to sign the agreement and related documents. First Reading – Amendment to Stormwater Management Ordinance – Chapter 30 Article II Attorney Scott Baker gave an overview and answered specific questions. Recommended changes for the Post Construction Ordinance to have language coincide with current Oakland County Standards. Motion by Council member Jennings, seconded by Mayor Pro Tem Kantor to Approve the 1 st Reading of the Amendment to the Stormwater Management Ordinance. City Administrator Report Dr. Sheryl Mitchell Theriot- highlights of year review: Maintained a safe workplace during COVID-19. We have municode meetings, we’re on Zoom and simultaneously live streaming on Facebook. See click fix -residents are using it and it has made it easier for staff to track work orders. E-newsletter has over 1300 subscribers and goes out weekly to residents. Sanitary retention tank is now under agreement with Oakland County Water Resource Commissioners. Point and Pay allows residents to make payments online and schedule inspections, utility bills are viewable online. Street Improvements projects as well as the Capital Improvement projects Munetrix is a financial transparency information system that makes available the financials of the city online. We have a financial rating of zero which the highest rating you can get relative to the financial stability of the community. Special events – We’ve had the 65th Anniversary, the Caribbean festival, Ladies in leadership program and Summer interns assisting Recreation Department and the DDA. Recreation van was acquired to transport seniors to different events. Looking for volunteers to escort the seniors on some of their day trips. An expansion of diversity, equity and inclusion with the Dr. Martin L. King celebration, African American History Month celebration, diversity champion awards and the Juneteenth celebration. Performance measures have been instituted, Police contracts have been successfully negotiated as well as contracts with Southfield Fire and EMS services. Grants – existing staff have been successful in acquiring grant dollars. Dr. Mitchell Theriot read her letter of resignation last day of employment is December 18,2021. 22. City Attorney Report – Orientation will be at the next Study Session meeting. All discussion and deliberation, emails, telephone calls, social media etc. with 3 council members present is in violation of the Open Meetings Act. Use city emails for all city business. If you use personal email for city business, you are subjecting your personal email to be requested as a record(FOIA). The same restrictions apply to social media – it is advised not to respond on social media. If a council member post on social media, do not chime in. Discussion on State of Emergency Declaration is in effect to the end of 2021. Reports of Boards, Commissions, and Committees Mayor Pro Tem Kantor stated –Planning Commission working on Ordinance for Electric vehicle charging stations. Working on a solar ordinance which is in the beginning stages. Infrastructure Committee – end of first year of road project and capital improvement projects. Road project is $500,000 under budget. Capital Improvement fund – watermain work is under budget. Fire hydrants- replaced 39 repaired 2 – underbudget. Gate valves which are values used to turn off watermains when there are repairs needed. Many were refurbished rather than replaced which is a significant cost savings. Excavations - EAGLE changed their methodology so every home would not have to be sampled instead 300 homes will be done which will result in a cost savings. Landscaping repair will be done in the Spring. Lead line repair is over budget but only 25% of residents have participated in the process, asking residents to test and forward the information to the city. If residents are having problems testing, call water department to schedule an appointment. 24. Unfinished / New Business None 25. Public Comments Jason Hammond – 27590 California S. E. – thanked Dr. Sheryl Mitchell Theriot for her dedication and service to the city. He is hopeful that the current City Council will work with the next City Administrator to increase the vision for the city. Mr. Tamarelli- 18485 Dolores -discussed water loss rate in the city. Proposed performing 2 low- cost tests. Mayor Pro Tem Kantor invited him to the infrastructure committee meeting. 26. Mayor and Council Comments Mayor Pro Tem congratulated all City Council members. Council members Jennings thanked everyone for their support of all Council members. Council member Miller thanked everyone who supported her. Bringing the community back together and respecting each other putting the residents first.
