Mayor Thurston explained the present meeting was being conducted in a new and challenging era, as the City of Lauderhill, Broward County, the State of Florida, the United States of America, and the world were experiencing new challenges due to the COVID-19 pandemic. Due to the challenges of the virus, the City would continue to hold hybrid, virtual governmental meetings in accordance with the Center for Disease Control (CDC) COVID 19 guidelines, the State of Florida Governor Ron DeSantis Executive Order 20-52, City Code Chapter 8.5, and Florida statutes. The waiver of the physical presence requirement expired, and board members were required to be physically present at public meetings. As a result, all members of the City Commission were present in the Commission Chambers at City Hall assessing the virtual meeting from their laptops. Due to the nature of the meeting and the constraints of holding a virtual hybrid meeting, he asked for everyone’s patience. Anyone wishing to speak should let him know by asking to do so. The microphones of all members of the Commission would be live during the entire meeting, while City staff and members of the public attending the meeting remotely would be muted. He said anyone having issues should text IT Director Doug Downs, thanking everyone for their patience and cooperation during such difficult and ever changing times. Attachments: RES-21R-04-73-Solid Waste MOU working group alternate appointment AR 21R-04-73 City of Lauderhill Page 5 City Commission Meeting Meeting Minutes - Final April 12, 2021 Mayor Thurston said the League of Cities indicated, though he was the City’s representative, the City’s alternate was former City Commissioner Richard Campbell, so the Commission needed to appoint a new alternate for the subject committee. Vice Mayor Grant nominated Commissioner S. Martin as the new alternate. Commissioner S. Martin accepted the nomination. Mayor Thurston opened the discussion to the public. Willie Mae Cooper, 1541 NW 32nd Avenue, Lauderhill, and West Ken Lark’s Homeowners’ Association (HOA) president, sought a better understanding of the subject resolution. City Attorney Hall explained several years ago, Broward County and all its cities entered into an agreement to study the possibility of creating a solid waste district for Broward County, in which all the cities would participate through the district. Currently, Waste Management had a virtual monopoly over waste disposal, so the County and its cities were studying a way to do it differently, perhaps better and cheaper for residents. He said Mayor Thurston was Lauderhill’s delegate and, if approved, Commissioner S. Martin would be his alternate on that committee. Mayor Thurston remarked the City’s long-term goal was to reduce garbage collection fees. City Attorney Hall concurred, stating it was not about the direct service provider, rather it was about where trash went after it left customer sites. Commissioner S. Martin mentioned the previous week he was fortunate to tour Waste Management, noting they encouraged other Commissioners to tour their facility; they sent thanks to Vice Mayor Grant for already doing the tour. On the tour, they saw what happened when trash was transported to the Monarch Hill site where solid waste was dumped. He said they were currently licensed for a height of about 225 feet above sea level; at present, they were near 212 feet. They did not know how many pounds came in per year, but they estimated in be around ten years they would reach the maximum allowed, so there would be discussions and a study later to find another site to dump trash or amend the language to allow the Monarch Hill site to go higher. These were things that would be coming up in future years. Commissioner S. Martin indicated, when they did the tour, and he was at the top of the mound where the trash was placed, they asked him if he saw any birds, and he noticed there were none; normally birds and vultures circled the trash. He was told they had a predatory hawk handler who stood at the top of the hill of trash with a hawk, a predatory bird, to chase away all other birds before they covered the hill at night; they did this every day. He felt ready to take on his duties as the City’s new alternate. Commissioner Dunn thought Vice Mayor Grant nominated the right person. Mayor Thurston agreed. City Attorney Hall stated he had three items on which to update the Commission. Around 1987 or 1988, the State Legislature voted to preempt any laws regarding guns; that is, no cities could enact any laws regulating firearms. In 2011, they took a conditional step and said if a city government enacted any laws regarding the regulation of guns, the sponsoring public official and government would forfeit their time in office, an extremely penalizing legislation. He noted, following the Marjory Stoneman Douglas High School shooting, certain Broward cities were incensed over the tragedy, and a group of cities, spearheaded by the City of Weston, filed a lawsuit attacking the State statue and the legislative action that prevented Florida cities from enacting laws regulating guns. The matter was working its way through the process, and Lauderhill was a party to that lawsuit, but the City was informed the lawsuit received a negative ruling the previous week, so the existing, penal statute remained in force. He assured the Commission all parties to the lawsuit made a good effort, and there might be discussion among the lawyers to determine whether or not there was any strong basis for an appeal; if so, his staff and he City of Lauderhill Page 9 City Commission Meeting Meeting Minutes - Final April 12, 2021 would bring the matter back to the Commission at a future date for discussion. Next, since the annexation in 2005, the City was involved in discussions with the County regarding the provision of water and sewer services in the annexed neighborhoods. At the current a point in the litigation, certain decisions were made in the City’s favor, and other decisions made against the City, and staff now wished to speak with the City Commission about exploring different strategies. He said the court, more or less, said the issue between the City and the County was not a matter for a court’s decision, it was a political issue the two entities should resolve in a meaningful way. Staff wished to hold an attorney/client meeting with the Commission, possibly on Tuesday, April 27, 2021, at 4:00 p.m. in the multipurpose room, City Hall. The style of the case, for the record, was The City of Lauderhill vs. Broward County, Case No. CACE 13-017184, Division 04; he would work on the proper notice for the shade meeting with the City Clerk. City Attorney Hall mentioned a shade meeting held just prior to the present meeting that resulted in the Commission now needing to formally authorize the actions discussed at the shade session. He asked for a short special meeting of about five minutes to call the roll, and vote on a resolution to that end; he would draw up the resolution, and City Clerk Anderson would set up the meeting for the coming Thursday morning at 11:00 a.m. Commissioner S. Martin questioned if it was possible to amend the present agenda and add an item to allow the subject action to take place at the present meeting. City Attorney Hall answered yes. As the Commission already discussed the details of the subject matter and decided upon the action they wished to take, they could vote to formalize that action. Mayor Thurston opened the discussion to the public and received no input. Commissioner S. Martin Yes Mayor Thurston Yes City of Lauderhill Page 10 City Commission Meeting Meeting Minutes - Final April 12, 2021 Commissioner Dunn announced the Lauderhill Health & Prosperity Partnership community needs assessment process would officially begin in the coming week; a series of focus groups would take place next week; information was provided on the City’s website, lauderhil-fl.gov/lhpp. On Monday, April 19, 2021, 10:00 a.m. to 11:00 a.m., at City Hall, there would be a business owner focus group; at 12:00 p.m., there would be a focus group for faith-based organizations; on Wednesday, April 21, 2021, at 10:00 a.m., there would be a healthcare organization focus group; at 3:00 p.m. a focus group for nonprofits; and at 7:30 p.m., there would be a focus group for residents, at which all focus groups would attend. She said there would be a maximum of ten people allowed in the multipurpose room, and residents were being asked to complete a survey; she believed the Communication Department already posted a link on the City’s website. They hoped for a minimum participation of 250 people; the community needs assessment was very important, as the information gathered would help the City make decisions about the health of Lauderhill communities, so community participation was vital in this process. Commissioner Dunn mentioned the Lauderhill Proud program launched, and to anyone who was a talented cook, artist, photographer, songwriter, etc., the City wished to hear from them about why they were proud to be in Lauderhill. She noted there would be competitions for songwriting, art, photography, fashion, and cooking. This was something her colleagues graciously agreed to partner with her on, so anyone interested in participating should visit the City’s website; the deadline to submit was April 23, 2021. Vice Mayor Grant again commended the Chen Medical Center for vaccinating 300 seniors, and the City would be remiss if it failed to thank its fire department for helping to coordinate that effort, as they worked very closely with Chen Medical Center staff to make the effort a success. Additionally, by now everyone heard Congressman Alcee Hastings passed away, and she wished to acknowledge all his hard work; she spoke with his son, Jody, earlier in the day, who hoped to say something at the present meeting but had prior engagement, so he might do so at a future City meeting. She read a short dedication as follows: Alcee Hastings, known to many as Judge, has distinguished himself as an attorney, civil rights activist, traditional leader, and a member of Congress. He was appointed by President Jimmy Carter in 1979 and became the first African American federal Judge in the State of Florida and served in the position for ten years. Additionally, Congressman Hastings was the first African American from Florida elected to the U.S. Congress after the post-civil war period. Congressman Hastings was a very, very outspoken advocate for Florida, and for our nation as a whole. Congressman Hastings was one of the most effective and distinguished public servants in the history of Broward County. He spent his time in office increasing access and opportunities for minorities, women, the elderly, children, and immigrants. He was known to have a diligent eye on making Broward County a better place to live, work, and to visit. She thanked the Commission for the moment of silence, saying though he was gone, his legacy would continue. Vice Mayor Grant stated the Single Mother’s Empowerment Forum flyer was sent out to constituents; it was important for her to communicate that she believed children having two parents in their lives was an ideal that helped them develop and grow. However, situations occurred where mothers and fathers became single parents, most being single mothers, and this trend was nationwide. She said the goal of the forum was to encourage and empower single mothers, giving them resources, educating them on nutrition, finance, time management, etc. As a single mother, she understood the City of Lauderhill Page 11 City Commission Meeting Meeting Minutes - Final April 12, 2021 importance of these factors in one’s life, so the subject initiative was very dear to her heart. She said the initiative partnered with various organizations, including Healthy Moms, Healthy Babies, Children’s Services Council, Chen Medical Center, and others, so as to bring forth the forum. The event would take place on Tuesday, April 27, 2021, at 6:30 p.m., and she encouraged anyone who knew of a single mom who needed some encouragement, motivation and/or inspiration to let them know about the forum. Commissioner Dunn thought the forum an excellent event, asking if attendees were required to register. Vice Mayor Grant answered no; they were sending out the flyer using various media, and the forum would be via Zoom and Facebook; City staff was working with her on those logistics. City Manager Giles-Smith reviewed various changes for City of Lauderhill meetings, the first being there no more COVID 19 special Commission workshops would be held on Wednesdays; those meetings would be incorporated into the Commission’s monthly workshop meetings held the third Monday of each month with a new start time of 4:00 p.m. rather than 7:00 p.m. Members of the public could attend in person at City Hall, or watch on Zoom or Facebook. She said City Commission meetings held the second and last Monday of each month would have a new start time of 5:00 p.m. This was the first passage of the ordinance, so there would be one more reading before the new times took effect, so it was not likely to become effective until the first meeting in May 2021. The change in time would work well for some seniors who wished to attend meetings at City Hall, but they disliked driving at night. She mentioned attendance increased with the possibility of viewing and participating in Commission meetings on Zoom and Facebook. The City looked forward to providing the community with information at Commission workshops and regular meetings, making sure the meetings were available to the public in a variety of ways, so they could watch and participate. Mayor Thurston mentioned on Sunday, April 11, 2021, he had the pleasure of participating in a drive-by birthday shout out for Ms. Betty Bradshaw who lived in the West Ken Lark area and turned 83 years of age. He complimented a number of police officers who were part of the procession: Officers Keechle and Lawrence. He told Police Chief Stanley her officers did a really great job interacting with the community; and the community appeared very comfortable talking to them about what was happening around them. On the afternoon of Monday, April 12, 2021, the City of Lauderhill hosted the Northwest Council of Elected Officials, where northwest Broward cities met to discuss items that were challenging all cities, sharing advice, and discussing problems and issues they were experiencing. At the subject session, Fire Chief Marc Celetti gave a presentation on pivoting in a time of COVID; he did an excellent job, and all of the elected officials present indicated to him they picked up new items from Chief Celetti; he thanked Chief Celetti for his presentation. At the same meeting, Commissioner Dunn gave a presentation on the Return2Work initiative, for which a proclamation was made at the present meeting for Return2Work Week. Mayor Thurston looked forward to everyone’s participation, as everyone knew someone who had difficulty getting a job, and this was an opportunity to improve their skills and, in so doing, enhance their ability to get a job.
