Meeting Minutes City of League City Planning and Zoning Commission Regular Meeting, Monday, September 9, 2024 Council Chambers, 200 W. Walker Street, League City, TX 77573 1. Call to Order and Roll Call of Members Paul Maaz, Chair, called the meeting to order at 6:00 p.m. Present: Paul Maaz, Frank Dominguez, Nathan Jung, Matthew Hyde, Matthew Propst, Scott Higginbotham, Pam Arnold Absent: Ruth Morrison City Staff: Kris Carpenter, Planning Director; Mark Linenschmidt, Planning Manager; Masood Malik, Senior Planner; Vince Hustead, Senior Planner; Ann Williams, Planner I; Matt Brown, Assistant City Engineer; Michelle Villarreal, City Attorney 2. Approval of August 19, 2024, minutes Mr. Maaz asked if there were any corrections. He stated hearing none, the August 19, 2024, minutes are approved. 3. Citizen Communications None. 4. Public Hearing and Action Items A. Hold a public hearing and make a recommendation to City Council on a Special Use Permit Application, SUP-23-0003, (Peregrine Wizard BESS), to allow a Battery Energy Storage System (B.E.S.S), a private utility use, on approximately 15.5 acres zoned “IL” (Limited Industrial), legally described as Abstract 19 Perry & Austin Survey Part of Lot 1 (1-0-1) Dickinson Addition A and Abstract 3 Page 16 S F Austin Survey Tract 87, generally located between State Highway 3 and Dickinson Avenue and south of Washington Street, with the address of 1102 South State Highway 3. Kris Carpenter, Planning Director, gave a presentation on behalf of the City of League City. Kevin Conger, Peregrine Energy Solutions, applicant, gave a presentation. Mr. Maaz opened the public hearing at 6:10 p.m. Mary Gibson – 1244 Mossy Oak – Ms. Gibson spoke in opposition of two BESS sites being built so close together. One is Peregrine Wizard and the other Berkman Storage. She requested that City Council take into consideration that the two sites would be built less than 1500 feet apart from one another. Justin Russell – 1234 Centerpointe Dr – Mr. Russell, stated he has 30 years’ experience in IT security and spoke in opposition of the BESS site due to possible Cyber-attacks to US infrastructures by foreign enemies. David Coffman – 1237 Deer Ridge Drive – Mr. Coffman stated he is a retired Environmental Engineer and spoke about detention on the site. He stated he is not against the concept but is in opposition of the location. Mr. Maaz closed the public hearing at 6:28 p.m. Mr. Hyde asked if the company that completed the Hazard Mitigation Analysis was hired by the City. Mr. Carpenter stated that the Hazard Mitigation Analysis was provided by the applicant and reviewed by the City’s third-party consultant and the Fire Marshal’s office to ensure it was compliant with the City’s regulations. Additionally, he stated the Plume Model was completed by a third-party consultant that was hired by the City. Ms. Arnold inquired about the Strategic Partnership Agreement. Mr. Carpenter stated that the Strategic Partnership Agreement is required by the ordinance, which requires a payment in lieu of taxes agreement or similar agreement. Ms. Villarreal, City Attorney, explained the details of the Strategic Partnership Agreement. Mr. Jung asked if the setbacks would limit the ability to develop the commercial property. Mr. Carpenter stated that it would not limit the uses on the commercial frontage. Mr. Jung asked how many entry points there are into the facility? Mr. Carpenter stated that there are three gates. Mr. Jung asked about how many fire mains will serve the facility and if the Fire Department believes it is adequate. Mr. Carpenter stated that there is one Fire main coming from Highway 3 that will loop through the facility and the Fire Department feels what is provided is adequate. Mr. Higginbotham asked about owner transferability. Mr. Carpenter stated there is not a limitation on transfer of ownership; however, emergency procedures would have to be reviewed with the new operator. Dr. Propst inquired about Number 6 of the SUP Conditions in reference to on and off-site overhead lines. Mr. Carpenter stated it has to do with the Railroad requirements of not having underground lines being run under the railroad. Dr. Propst inquired about taxing entities. Planning & Zoning Commission 2 September 9, 2024 Mr. Carpenter confirmed that the City of League City is one of the taxing entities for the property. Dr. Propst commented that this is the first applicant that he has seen that are paying attention to things that are unique to League City in terms of the oak tree registry, and it is a nice detail. Mr. Maaz asked if citizens’ concerns are addressed in this ordinance. Mr. Carpenter responded that the regulations and ordinance adopted are the City’s best attempt to address all citizen concerns. Mr. Maaz commended staff and City Council for the ordinance to give the Planning and Zoning Commission guidance. Mr. Maaz made a motion to recommend approval of Special Use Permit Application, SUP-23-0003, per staff’s recommendations. Dr. Propst seconded the motion. The motion passed by a vote of 5-2-0. B. Hold a public hearing and make a recommendation to City Council on an ordinance amending Chapter 125 of the Code of Ordinances of the City of League City, entitled, “Unified Development Code”, related to platting authority, clearance above sidewalks, landscaping, and land use. Kris Carpenter, Planning Director, gave a presentation on behalf of the City of League City. Mr. Maaz opened the public hearing at 6:44 p.m. No one spoke at the public hearing. Mr. Maaz closed the public hearing at 6:45p.m. Discussion took place in reference to the role of Planning and Zoning Commission in the plat approval process and that the Commission will still hear and be the approval authority for Master Plans as well as hear and be the recommending body for Special Use permits, Zoning applications and Planned Unit Developments. Mr. Hyde made a motion to recommend approval of the ordinance amendment to Chapter 125 of the Code of Ordinances of the City of League City, entitled, “Unified Development Code”, related to platting authority, clearance above sidewalks, landscaping, and land use, per staff’s recommendations. Mr. Dominguez seconded the motion. The motion passed by a vote of 7-0-0. C. Hold a public hearing and make a recommendation to City Council on an ordinance amending Chapter 125 of the Code of Ordinances of the City of League City, entitled, “Unified Development Code”, related to food trucks. Planning & Zoning Commission 3 September 9, 2024 Mr. Maaz opened the public hearing at 6:54 p.m. Tom Crews, Council member, asked if food trucks visiting the baseball fields during sporting events would be prohibited. Kris Carpenter stated that would not be prohibited. Mr. Maaz closed the public hearing at 6:55 p.m. Mr. Higginbotham made a motion to recommend approval of the ordinance amendment to Chapter 125 of the Code of Ordinances of the City of League City, entitled, “Unified Development Code”, related to food trucks, per staff’s recommendations. Mr. Hyde seconded the motion. The motion passed by a vote of 7-0-0. 5. New Business A. Consider and take action on a Preliminary Plat, Samara, Section 16, PLAT-24-0037, generally located along the south side of Ervin Street and east of Landing Boulevard. Mark Linenschmidt, Planning Manager, gave a presentation on behalf of the City of League City. Ms. Arnold made a motion to approve the Preliminary Plat, Samara, Section 16, PLAT-24-0037, per staff’s recommendations. Mr. Jung seconded the motion. The motion passed by a vote of 7-0-0. B. Consider and take action on Final Plats, Westwood, Section 11, PLAT-24-0031, and Westwood Detention Pond/Park, PLAT-24-0039, generally located south of League City Parkway and west of Maple Leaf Drive. Mark Linenschmidt, Planning Manager, gave a presentation on behalf of the City of League City. Mr. Jung made a motion to approve the Final Plats, Westwood, Section 11, PLAT-24-0031, and Westwood Detention Pond/Park, PLAT-24-0039, per staff’s recommendations. Mr. Hyde seconded the motion. The motion passed by a vote of 7-0-0. 6. Staff Comments Mark Linenschmidt, Planning Manager informed the Commission that they will be receiving a packet next week for a CIAC meeting on September 16, 2024. He also let the Commissioners know that the 2025 Planning and Zoning Commission meeting calendar would be on the next meeting agenda for approval. Planning & Zoning Commission 4 September 9, 2024 7.
