Meeting Minutes City of League City Zoning Board of Adjustments / Building and Standards Commission Regular Meeting, Thursday, September 7, 2023 City Council Chambers, 200 W. Walker Street, League City, TX 77573 1. Call to Order and Roll Call of Members Mr. Hendershot called the meeting to order at 6:00 p.m. Present: Michael Hendershot, Katie Benoit, Russell Miller, Dave Person (Alternate #1)* * Mr. Hendershot activated Mr. Person as an active voting member of the Board. Absent: Tamara Gann-Curry, Robert Kline (Alternate #2) City Staff: Kris Carpenter, Planning Director; Mark Linenschmidt, Planning Manager; Michelle Villareal, Deputy City Attorney; Larry Suniga, Deputy Fire Marshal; Ralph Blanco, Assistant Building Official 2. Approval of June 1, 2023, minutes Mr. Miller moved to approve the June 1, 2023 minutes. Ms. Benoit seconded the motion. The motion passed 4-0-0. 3. Citizen Communications No citizens spoke. 4. Public Hearing and Action Items A. Hold a public hearing and take action on a Zoning Board of Adjustments Application, VA- 23-0002 (307 East Walker Street), a request for a variance to the League City Code of Ordinances to allow an enlargement of a non-conforming building/site, on property zoned “IL” (Limited Industrial), legally described as a portion of Lot 3 of the Lone Cedar Subdivision, generally located along the south side of East Walker Street, east of Clear Creek Avenue and west of Dickinson Avenue with the address of 307 East Walker Street. Mark Linenschmidt, Planning Manager, gave a presentation on behalf of the City of League City. Mr. James Barry, Property / Business Owner of Dr. Cool / Professor Heat, 307 E. Walker Street, gave a brief explanation of the reason for the variance request. Mr. Hendershot opened the public hearing at 6:13 p.m. Mr. Hendershot asked if there was anyone present that would like to speak. There were none. Mr. Hendershot closed the public hearing at 6:13 p.m. Mr. Miller made a motion to approve Zoning Board of Adjustments Application, VA-23-0002 (307 East Walker Street). Ms. Benoit seconded the motion.  There was a discussion on the permit history, intent, design, and construction of the existing concrete slab on which the building was expanded on. Mr. Person asked if the slab would meet the current building code. Ralph Blanco, Assistant Building Official, indicated that the slab would pass an inspection. Ms. Benoit and Mr. Person asked questions about fire safety. There was a discussion with Mr. Larry Suniga, Deputy Fire Marshal, regarding life safety and fire protection concerns of the building and the surrounding properties. Mr. Person asked about nonconforming parking on the site. It was further discussed that the parking issues were focused primarily on the additional required parking due to the recent building expansion. Mr. Hendershot asked if the Board had any questions for staff. There were none. Mr. Hendershot called for the vote. Motion failed 1-3-0. 5. Other Business A. Consider and take action on the Zoning Board of Adjustments/Building and Standards Commission meeting dates for 2024. Mark Linenschmidt, Planning Manager, gave a presentation on behalf of the City of League City. Mr. Person made a motion to approve the Zoning Board of Adjustments/Building and Standards Commission meeting dates for 2024. Ms. Benoit seconded the motion. Motion passed 4-0-0. 6. Staff Comments Mr. Linenschmidt reminded members about applying for reappointment for those positions that are set to expire at the end of the year. 7.
