HEARING BEFORE THE CITY COUNCIL, JULY 13, 2015 Hearing opened at 7:00 P.M. with Councillor Dombrowski , Chair of the LEGAL AFFAIRS COMMITTEE, presiding. This hearing was continued from June 8, 2015. All members were present except Councillors Freda and Marchand. The following PETITION was the subject of the hearing: 57-15 James J. Carnivale, Karen L. Carnivale and Jeffrey T. Duval: Modify the Zoning map by changing the district designation from Residential to Commercial for land owned by the petitioners as shown on the Assessors Map 239, Lots 5 and 8, and Map 240, Lots 3 and 4. At the request of the petitioners this hearing was continued to August 24, 2015 at 6:45 P.M. No new information was received or discussed. Attendance was taken by a roll call vote; all members were present except for Councillor Freda. The Committee on Records reported that the records through June 8, 2015 were examined and found to be in order. The records were accepted. The following COMMUNICATION was received, referred to the FINANCE COMMITTEE and given REGULAR COURSE. C-1 Dean J. Mazzarella, Mayor: Request that a Drake School Donation Account be established as authorized by Massachusetts General Law Chapter 44, Section 53A. The following PETITION was received, referred to the LEGAL AFFAIRS COMMITTEE, given REGULAR COURSE and referred to the Director of Inspections, the Planning Board, the Zoning Board of Appeals and the City Solicitor. A hearing was set for August 24, 2015 at 7:00 P.M. Vt. 8/0 1-16 John Souza, Patrick Perla, Salvatore Ciccone, Fred Fredricks, Thomas Carignan: Remove the word “vacant” from Article I, Section 22-10.1.1 of the Leominster Zoning Ordinance so that Leominster’s Ordinance conforms with the State’s definition of a “single lot exemption” in M.G.L. Chapter 40A, Section 6. (Legal The following APPOINTMENTS were received, referred to the WAYS & MEANS AND VETERANS AFFAIRS COMMITTEE and given REGULAR COURSE. 2015-2016 Election Officers – terms to expire August 31, 2016 Reserve Firefighters – Sean Donahue, Kimberly K. McGowan, Adam D. Thibeault Upon recommendation of the WAYS & MEANS AND VETERANS AFFAIRS COMMITTEE, the following PETITION was GRANTED. Vt. 8/0 63-15 Donny Do: Renew the second hand dealer’s license for Sam & Friends located at 710 North Main Street. Upon request of the LEGAL AFFAIRS COMMITTEE, the following PETITION was given FURTHER TIME. The hearing was continued to August 24, 2015 at 6:45 P.M. at the request of the petitioners. Vt. 8 “yeas” C-104 Relative to the appropriation of $1,082,285.00 to the Street Resurfacing Expense Account; same to be transferred from the Highway State Aid Revenue Reserved for Appropriation Account. 2 REGULAR MEETING OF THE CITY COUNCIL, JULY 13, 2015, continued ORDERED: - that the sum of One Million, Eighty Two Thousand, Two Hundred Eighty Five Dollars ($1,082,285.00) be appropriated to the Street Resurfacing Expense Account; same to be transferred from the Highway State Aid Revenue Reserved for Appropriation Account. RE: FY 2016 Chapter 90 Local Transportation Aid Funding Upon recommendation of the FINANCE COMMITTEE, the following COMMUNICATION was RATIFIED. Vt. 8 “yeas” (Granted with an Emergency Preamble on June 29, 2015; another vote was required.) C-104A Relative to the appropriation of $16,000.00 to the Police Department Expense Account; same to be transferred from the Police Department Salary & Wages Account.
