Opening ceremonies: The meeting was called to order at 7:03 PM by Mayor Bruce Rowley. All present were welcomed. The invocation was offered by Councilmember Chris Webb. The Pledge of Allegiance was led by Councilmember Ray Evans Town Officials present: Mayor Bruce Rowley and Councilmembers Ray Evans, Chris Webb, Amy Lowe, and Taryn Brooks. Town Staff present: Town Clerk Heather Poulsen Others present: Rebecca Dopp from the Times News, Clint Pew, Jim Brown, Wes Brown, Dan Green, Dale Kension, Phyllis Kenison, Susan Kendall, Barrett Brooks, and Planning Commission Chairman Alan Paystrup. 2. Swearing in of New Elected Officials Town Clerk Heather Poulsen swore in Susan Kendall as the new Deputy Clerk. 3. Discussion Items: Clinton Pew- Mr. Pew introduced himself to the Town Council and explained that he is running for County Commissioner. If elected he would like to establish better communication between the county commissioners and the city’s, have a strong planning and zoning committee, and support law enforcement. Jim Brown- He lives on 300 west just outside of town and was informed last fall that his stock water connection was going to be turned off. He realizes that there is a leak in the line somewhere and would be willing to find and fix the leak if the town would consider leaving the stock water line on. When he bought the property, he was told by the agent that they had a stock water line. Councilmember Amy Lowe asked if they had done any due diligence as far as researching what the agent told them and they had not. The councilmembers agreed to discuss the matter. Dan Green- Mr. Green is trying to put together a place to have a community garden. They are going to start small but would like the Council’s support. They are wondering if they get bigger and need someplace to meet if there is the possibility that they could use the town hall. Mayor Rowley said that he was sure something could be worked out. 4. Action Items: a. Levan Town Clerk Heather Poulsen swore in Susan Kendall as the new Deputy Clerk. b. Cole Jackman submitted a business license application for Jackman Concrete. Councilmember Ray Evans made a motion to approve the business license for Cole Jackman. Councilmember Amy Lowe seconded the motion. Mayor Bruce Rowley and Councilmembers Ray Evans, Amy Lowe, Taryn Brooks, and Chris Webb voted Yes. The motion carried. c. Ordinance No. 04132022-01 Delinquent Animal Control Fines Council member Taryn Brooks made the motion to set the new delinquent animal control fines as follows: • If an animal control citation is issued the resident shall have two weeks to pay the fine • Two weeks after an animal control citation is issued, if the fine is not paid, a delinquent letter will be sent out with a $25 late fee being assessed • Two weeks after that letter is sent out, if the fine is still not paid, another letter will be sent assessing another $25 late fee being assessed. The resident will also be informed that if all fees are not paid within two weeks the case will be turned over to our lawyer and they, the resident, will be responsible for all legal fees involved. Mayor Bruce Rowley and Councilmembers Ray Evans, Amy Lowe, Taryn Brooks, and Chris Webb voted Yes. The motion carried. d. Levan Town has a new mayor and town clerk so it needs a new Public Entity Resolution- Authorizing users for PTIF (public funds) accounts. Mayor Bruce Rowley asked for a roll call vote to adopt the Public Entity Resolution authorizing users for PTIF accounts. Mayor Bruce Rowley opened the sealed bids that were submitted for a 5 year lease on the 4 ¾ acres cemetery pasture. The bids were as follows: • Jamie Garrett- $135 a year • Gus Rowley- $150 a year • Russell Mangelson- $153 a year Councilmember Ray Evans made the motion to accept Russell Mangelson’s bid of $153 a year for 5 years on the Levan Town’s Cemetery pasture. Councilmember Amy Lowe seconded the motion. Mayor Bruce Rowley and Councilmembers Ray Evans, Amy Lowe, Taryn Brooks, and Chris Webb voted Yes. The motion carried. f. Casey Royce submitted a bid to do Levan’s Street mowing for the summer. His bid was for 3 mowing’s at $1200 each mowing and mowing the arena 1 time for $600. Councilmember Taryn Brooks made the motion to accept Casey’s bid with the stipulation that Clerk Heather Poulsen ask him if he would be willing to mow the rodeo arena twice. Once before the rodeo in June and once in the late fall. Councilmember Ray Evans seconded the motion. The motion carried. g. Town Clerk Heather Poulsen explained that they had not received any applications for a Town laborer/cemetery/ groundskeeper. She had spoken with Utilities Manager Jason Worwood and his suggestion was to open the application again without the laborer and split the groundskeeper and the cemetery into two jobs. Both with negotiable wages so that if someone wanted one or both of the jobs, they could then negotiate the wage. Councilmember Ray Evans made the motion to open up the groundskeeper and cemetery caretaker jobs with negotiable wages. Councilmember Ray Evans seconded the motion. Mayor Bruce Rowley and Councilmembers Ray Evans, Amy Lowe, Taryn Brook, and Chris Webb voted Yes. The motion carried. h. Mayor Rowley asked that the town council put a moratorium on multifamily dwelling units do to the fact that the town doesn’t have its impact fee study finalized and to see what the impacts of these types of buildings would be on our septic tanks. Mayor Rowley asked for a roll call vote on Ordinance 04132022-01-Moratorium on Multifamily dwelling units. Mayor/Council Member/Department/Committee Reports: a. Mayor/Council Members: None b. Office Issued Permits Report: i. Building permits: None c. Planning Commission: Taryn Brooks reported that the planning commission is looking at the multifamily dwelling ordinance. They are discussing what the impact of multifamily units would have on septic tanks and if they need to adjust the ordinance. d. Committee: Taryn reported that she was getting bids to redo the backstop and outfield fence on the baseball field as well as to get the dugouts redone. She was also working with Phil Baker to get a bid for a sprinkler system design. Taryn also is working with the correctional facility in Nephi to get bids on signs for the park and splash pad rules. She would like to discuss in a work session when to open the splash pad. Councilmember Chris Webb reported that everything went well with the Easter Celebration the town hosted. Councilmember Ray Evans reported that the JRDA is moving forward and hoping to switch to the new system by July. Ray also reported that the town cleanup is set for April 30th and would like it advertised on the website as well as Facebook. Councilmember Amy Lowe said she was going to purchase some raffle prizes for the town cleanup. Other: Mayor Rowley wondered if they could get a list of surplus items that the town owned and see what the process is to sell that off. Ray Evans asked if maybe in the future a piece of the cemetery pasture would be split off for a community garden. Mayor Rowley explained that it was a possibility but not for 5 years since the town just agreed to a new pasture lease agreement contract for 5 years. 6. Council Business: a. Approval of Minutes: -March 9, 2022- Regular Session Councilmember Taryn Brooks made the motion, seconded by Councilmember Ray Evans, to approve the minutes from the Regular Session dated March 9, 2022. Mayor Bruce Rowley and Councilmembers Ray Evans, Amy Lowe, Taryn Brook, and Chris Webb voted Yes. The motion carried. b. Approval of Claims Councilmember Ray Evans made the motion, seconded by Councilmember Amy Lowe, to approve the Claims dated 3/01/2022 to 3/31/2022. Mayor Bruce Rowley and Councilmembers Ray Evans, Amy Lowe, Taryn Brook, and Chris Webb voted Yes. The motion carried. c. Approval of Payroll Comparison Report Councilmember Chris Webb made the motion, seconded by Councilmember Taryn Brooks, to approve the Payroll Comparison Report dated 2/01/2022 to 3/31/2022. Mayor Bruce Rowley and Councilmembers Ray Evans, Amy Lowe, Taryn Brook, and Chris Webb voted Yes. The motion carried. d. Mayor Bruce Rowley and Councilmembers Ray Evans, Amy Lowe, Taryn Brook, and Chris Webb voted Yes. The motion carried. e. Review of Tentative Cash Receipts Report The council reviewed the Cash Receipts Report dated 3/01/2022 to 3/31/2022. f. Budget Report Review The council reviewed the budget report for 7/01/2021 to 3/31/2022. 7. Adjourn: Councilmember Ray Evans made the motion, seconded by Councilmember Taryn Brooks to adjourn. All council members present were in favor.
