Opening ceremonies: The meeting was called to order at 7:03 PM by Mayor Bruce Rowley. All present were welcomed. The invocation was offered remotely by Mr. Rajan Zed, President of the Universal Society of Hinduism. The Pledge of Allegiance was led by Councilmember Chris Webb. Town Officials present: Mayor Bruce Rowley and Councilmembers Ray Evans, Chris Webb, and Taryn Brooks. Discussion Items a. Recognize Elizabeth Hone Elizabeth Hone was not present but Mayor Rowley wanted to recognize her for the service she had done for the town as it’s clerk. b. Marty Palmer Mr. Palmer is running for County Commissioner -Seat B. He wanted to introduce himself to the council. If he gets elected he would like to keep a good relationship between the town and the county. He is against the high density growth that is going into Nephi but he does realize that Nephi needs a few more businesses but the growth needs to be managed. He believes in the constitution and would like to preserve our rights. c. However, no residents were in attendance that wanted to talk about it. d. Alan Kendall- ATV Ordinances Mr. Kendall read an official complaint letter that he submitted to the mayor and town council. It was signed by Mr. Kendall, Sue Kendall, and Ruby Bauer. They were concerned about the southwest corner of Center Street and First East. Their concern was that for years that corner has been used as a short cut for motorcycles and ATV’s. When the kids drive around the corner, they kick up a lot of dust and that dust blows over into Ruby Bauer’s home. He then read Levan Code 6.02.030 stating what a qualifies as a public nuisance. They were requesting that the town put a permanent obstacle on the corner preventing the kids from cutting that corner. The mayor then opened the meeting for public comment. Many residents felt like it was a good thing for residents to have the right to ride ATV’s, side by sides, and motorcycles in town. Many people in attendance were also concerned about the safety of children riding them. They felt that children were not riding them safely within the speed limits, with helmets on, and around livestock. Mayor Rowley asked Sherriff Doug Anderson to explain the legalities of detaining someone. Anderson explained that you could flag someone down, detain them, for a justifiable reason however you could not physically detain them or make them feel like they can not leave. He also explained that speed limits and other laws need to be obeyed. It was agreed that the sheriff’s office would come to Levan and hold a safety class for off road vehicles. Mr. Jim Huggard also agreed to come to the sheriff’s safety class and teach the kids how to ride safely around livestock that is being ridden around town. Mayor Rowley then agreed to put some gravel down on the southwest corner of center street and first east to address the dust problem that Mr. Kendall brought up in his complaint. e. Discuss changing the date for the Levan Rodeo to July 8th and 9th The town council agreed to change the date of the Levan Town Rodeo from June 25th to July 8th and 9th. Taryn Brooks- Bids for baseball Councilmember Taryn Brooks reported that she had been trying to get bids for fencing and backstop at the baseball diamond. She has received one bid from Northwest fence and it was: $12,900 for the backstop $5,900 for the dugouts $16,300 for a 6 ft. outfield fence $14,200 for a 4 ft. outfield fence The council discussed the option of instead of hiring someone to build dugouts if the town could do something like a lean-to type building that you can get at Cal-Ranch for around $600. Taryn also reported that she had received light for the ball fields for free from Payson. Mayor Rowley suggested that the town be careful about putting any new grass in at the park areas due to that fact that we are in a drought. 3. Action Items: a. Approval of the FY 2023 Tentative Budget Councilmember Taryn Brooks made a motion to approve the FY 2023 Tentative Budget. Councilmember Chris Webb seconded the motion. Mayor Bruce Rowley and Councilmembers Ray Evans, Taryn Brooks, and Chris Webb voted Yes. Council member Amy Lowe was absent. The motion carried. b. Resolution 05112022-01 Levan Town Park and Town Hall Fees and Rules. Council member Ray Evans made the motion to set the new Town hall and park rules. Councilmember Taryn Brooks seconded the motion. Mayor Bruce Rowley and Councilmembers Ray Evans, Taryn Brooks, and Chris Webb voted Yes. Council member Amy Lowe was absent. The motion carried. c. Resolution 05112022-02 adopting a GRAMA, Government Records Access and Management Act, fee schedule Councilmember Ray Evans made the motion to pass Resolution 05112022-02 adopting a GRAMA fee schedule for Levan Town. Councilmember Chris Webb seconded the motion. Approval to purchase Dump Truck/ Snow Plow with CIB grant/loan Councilmember Ray Evans made the motion to approve the purchase of a dump truck/ snow plow with the CIB grant/loan. Councilmember Chris Webb seconded the motion. Mayor Bruce Rowley and Councilmembers Ray Evans, Taryn Brooks, and Chris Webb voted Yes. Council member Amy Lowe was absent. The motion carried. e. Appoint Christine Carrigan to be on the Planning Commission Councilmember Taryn Brooks made the motion to appoint Christine Carrigan to be on the Planning Commission. Councilmember Ray Evans seconded the motion. Mayor Bruce Rowley and Councilmembers Ray Evans, Taryn Brooks, and Chris Webb voted Yes. Council member Amy Lowe was absent. The motion carried. 4. Approval of Payroll Comparison Report Councilmember Taryn Brooks made the motion, seconded by Councilmember Chris Webb, to approve the Payroll Comparison Report dated 3/01/2022 to 4/30/2022. Mayor Bruce Rowley and Councilmembers Ray Evans, Taryn Brooks, and Chris Webb voted Yes. Council member Amy Lowe was absent. The motion carried. d. Approval of Final Cash Receipts Report Councilmember Chris Webb made the motion, seconded by Councilmember Taryn Brooks, to approve the Cash Receipts Report dated 3/1/2022 to 3/31/2022. Review of Tentative Cash Receipts Report The council reviewed the Cash Receipts Report dated 4/01/2022 to 4/30/2022. f.
