Contact the City at 755-6700 with 24-hours advance notice for special accommodations. PROCLAMATION  PROCLAMATION CITY OF LIBERTY LAKE, WASHINGTON A PROCLAMATION BY THE CITY OF LIBERTY LAKE, WASHINGTON, DECLARING NOVEMBER 13th AS “WORLD PANCREATIC CANCER DAY” WHEREAS, in 2015 an estimated 48,960 people will be diagnosed with pancreatic cancer in the United States and 40,560 will die from the disease; WHEREAS, pancreatic cancer is one of the deadliest cancers, is the fourth leading cause of cancer death in the United States, and is projected to become the second by 2020; WHEREAS, pancreatic cancer is the only major cancer with a five-year relative survival rate in the single digits at just seven percent; WHEREAS, when symptoms of pancreatic cancer present themselves it is generally late stage, and 73 percent of pancreatic patients die within the first year of their diagnosis, while 93 percent of pancreatic cancer patients die within the first five years; WHEREAS, approximately 900 deaths will occur in Washington in 2015; WHEREAS, pancreatic cancer is the 7th most common cause of cancer-related death in men and women across the world; WHEREAS, there will be an estimated 367,000 new pancreatic cancer cases diagnosed globally in 2015; WHEREAS, the good health and well-being of the residents of Liberty Lake are enhanced as a direct result of increased awareness about pancreatic cancer and research into early detection, causes, and effective treatments; NOW, THEREFORE, BE IT RESOLVED THAT the City Council designate November 13th the as “World Pancreatic Cancer Day” in the City of Liberty Lake. This will be a workshop item for discussion on November 3rd. During the workshop, I will give examples on how this policy would impact Capital Improvement Projects that are in the 2016 Budget. This policy was discussed at the Community Development Committee on October 27th. If the policy was to pass, then the City would create a new capital fund for items 2. & 3 on the attached proposed policy. Also attached are some examples of what other jurisdictions have adopted. I am also attaching Ordinance 163 that established the Public Arts Commission. Such art shall include the visual and performing arts, which may include the production or arrangement of sounds, colors, forms, movements or other elements in a manner that enhances the sense of beauty and is of aesthetic value. Public Art is financed by the following: 1. City Capital Improvement Projects (Public – over $500,000). All City Capital Projects that exceed $500,000 and are identified in the Capital Facilities Plan must include construction for Public Art. The amount for Public Art is based on the total amount of the awarded contract for construction as originally approved by the city council or as subsequently amended, multiplied by one (1) percent. The one percent for Public Art must be used on the project that was awarded. The one percent may not be transferred to another project. 2. City Capital Improvement Projects (Public – under $500,000). For City Capital Projects that are less than $500,000 and identified in the Capital Facilities Plan shall include a contribution of one (1) percent to a special fund known as the “Municipal Arts Fund” of the amount of the awarded contract for construction. City Council thru the Budget, may appropriate dollars to be allocated to a special fund known as the “Municipal Arts Fund”. 3. Additional allocation of Funds and Expenditures. The City Council thru the Budget, may appropriate dollars to be allocated to the Municipal Arts Fund. The City Council, at its discretion and upon the recommendation and advice of the Public Arts Commission, shall determine from time to time, the amount to be allocated for the selection, acquisition, and/or installation of individual works of art or the art that may be placed within, on, or about other public facilities. All such expenditures for art shall be approved by City Council.  Chapter 3.31 – CITY OF BUIEN ART IN PUBLIC PLACES FUND Sections: 3.31.010 Established. 3.31.020 Definitions. 3.31.030 Deposits. 3.31.040 Method of calculation of total project cost. 3.31.050 General obligation proceeds. 3.31.060 Uses of funds. 3.31.070 Responsibilities of arts commission. 3.31.010 Established. There is hereby established in the city treasury a special fund to be known and designated as the “art in public places fund” for the purpose of providing funds for qualifying capital improvement projects. [Ord. 238 § 1, 1998] 3.31.020 Definitions. As used in connection with the art in public places fund and qualifying capital improvement projects, the following terms have the meanings set forth below: (1) “Acquisition of real property” means the purchase of parcels of land or existing buildings and structures, including associated costs such as appraisals or negotiations. (2) “Art in public places” means any expression by an artist of visual works of art available to the public in an open city-owned facility in areas designated as public areas, or noncity-owned property if the work of art is installed or financed, either in whole or in part, by the city. (3) “Arts commission” means the Burien arts commission. (4) “Demolition costs” means the cost of removing buildings or other structures from the property. (5) “Equipment” means equipment or furnishings that are portable. (6) “Qualifying capital improvement projects” means projects funded wholly or in part by the city of Burien for construction or remodeling of government owned public buildings, transit centers and parks. (7) Funding from projects supported by state, federal and county dollars may only be used for one percent for the arts projects if allowed by the government agency granting the project funds. [Ord. 238 § 2, 1998] 3.31.030 Deposits. All authorizations and/or appropriations for qualifying capital improvement projects shall include an amount of not less than one percent of the total project cost to be set aside for transfer to the art in public places fund. [Ord. 238 § 3, 1998] 3.31.040 Method of calculation of total project cost. For qualifying capital improvement projects, the minimum amount to be appropriated for art in public places shall be as follows: the amount shall be based on the total amount of the awarded contract as originally approved by the city council or as subsequently amended, multiplied by one percent; provided, however, that any city funded amount for the acquisition of real property or equipment or for the demolition shall be excluded for the purposes of this calculation. [Ord. 238 § 4, 1998] 3.31.050 General obligation proceeds. In the case of a city project which involves the use of general obligation bond proceeds, funds appropriated shall be used for projects and capital purposes consistent with the authorizing resolution or ordinance approved by the city council and the voters. [Ord. 238 § 5, 1998] 3.31.060 Uses of funds. The appropriations from qualifying capital improvement projects shall be pooled into the art in public places fund. The city council, upon advice and recommendation from the arts commission, shall approve, from time to time, the amount to be authorized for qualifying capital improvement projects. These funds shall be used for: (1) Selection, acquisition and installation or display of original works of visual art which may be an integral part of the project, or be placed in, on or about the project, or be placed in, on or about the project or in another public facility; (2) Repairs and maintenance of public art acquired with the qualifying capital improvement funds; and (3) Other project-specific expenses of selection and acquisition; provided, that no part of the funds shall be used to pay administrative staffing expenses of the program. Any unexpended qualifying capital improvement project funds which remain in the art in public places fund at the end of any budget year shall not be transferred to the general fund or otherwise lapse, but said unexpended funds shall be carried forward from year to year until expended for the purposes set forth in this section, unless otherwise directed by city council. [Ord. 238 § 6, 1998] 3.31.070 Responsibilities of arts commission. Annually the arts commission shall make recommendations to the city council that will reflect short and long range planning for art works and sites regarding the appropriation of qualifying capital improvement project funds. The recommendations will relate to, but not be limited by, the following: (1) Art projects will be responsive to the developing public art needs of the community; (2) Art projects will reflect the scope, scale and character of the site; and (3) Art projects will be part of new parks and building developments. The arts commission shall carry out all necessary tasks and procedures consistent with established arts policies for the selection, placement and conservation of art works. Whoever requests an appropriation of an eligible fund for a construction project includes one percent of the estimated project cost for works of art. When the council approves such an appropriation request, the appropriation includes the one percent for art. B. Appropriation Requests. 1. All appropriation requests subject to this section shall be reviewed by the director of arts prior to submission to the city council. 2. At the time an appropriation request is submitted to the city council, the director may ask that up to one-half of the one percent for arts be transferred to the municipal arts projects fund for purposes authorized in SMC 7.08.106, and as further provided in this section. At the time of making a request, the director shall additionally consult with the party responsible for the overall appropriation request. 3. Administration of the execution and placement of art projects supported by funds so transferred is under the authority of the arts director. C. Transfer of funds under subsection (B) of this section remains subject to any restrictions or requirements applicable to uses of the funds in contract or law, such as applicable requirements as may arise under RCW 43.09.210 or from funding or grant sources. 1. The party or department originating the appropriation request may also propose other restrictions. 2. Any portion of funds transferred may also be placed in a restricted pooled fund for maintenance of artwork, the fund to be administered by the director of arts. D. The director of arts, with the support of the arts commission, develops criteria for use of or access to funds transferred under subsection (B) of this section, which shall consider: 1. accessibility of the work to the community (e.g., placement in parks, publicly accessible corridors, community gathering places, and public buildings or other zones of public interaction); 2. compatibility with the municipal comprehensive land use plan, including the long-range land use plan; and 3. conformity to the municipal arts plan, referenced in SMC 4.05.050 and chapter 4.05 SMC; 4. art proposed to be placed in parks shall further be subject to approval of the park board. 5. art in municipal libraries shall be subject to approval of the library board. 6. the director of arts may also consider the advice of other jurisdictional bodies such as neighborhood councils, business improvement district councils or similar bodies exercising oversight or advisory  over affected areas. E. All selection and placement of art shall at all times be subject to the ultimate judgment and discretion of the director of arts, and no public forum or rights of access shall ever be created. As a general principle, public art should encourage enjoyment and appreciation of art for all ages and members of the public. The City at all times reserves the right to decline to accept any art proposal. Subject to the consultation requirements of RMC 2-8-3D, all authorizations and/or appropriations for municipal construction projects shall, concurrently, upon budgeting therefor by the City Council and authorization by the Mayor, whenever legally permitted, include an amount equal to not less than one percent (1%) of the actual total project cost, to be used for the selection, acquisition and/or installation of works of art to be placed in, on, or about City public facilities, which are suitable and appropriate therefor. The amount that is transferred to the one percent (1%) for art fund, based on the project’s budget cost that is used for planning purposes, shall be adjusted up or down from that amount, based on the actual total project cost after it has been completed. In the event any law, rule or regulation establishing a source of funds for a particular project, including but not limited to grants, loans, or assistance from Federal, State or other governmental units, prohibits, limits or excludes art and art works as a proper expenditure, then the amount of funds from such source shall be excluded in computing the one percent (1%) amount of the total project cost. B. All funds authorized and/or appropriated pursuant to this Section shall be maintained in the one percent (1%) for arts fund. The City Council, upon the recommendation and advice of the Commission, shall approve, from time to time, the amount to be allocated for the selection, acquisition and/or installation of individual works of art to be placed either as an integral part of the municipal construction project in connection with which the funds were appropriated or attached thereto, or detached within or outside such project, or to be placed in, on or about other public facilities. All of such expenditures for art shall be approved by the City Council and as otherwise provided by law. C. Funds authorized and/or appropriated pursuant to this Section for a municipal construction project but not expended on any such project shall be placed and retained in the one percent (1%) for arts reserve fund. If for any reason any transfer to such fund shall be contrary to law or prohibited by any rule or regulation governing such funds, then any such unspent or residual sum authorized and/or appropriated as a part of such construction project may be expended for any like or similar public purpose or purposes relating to the selection, acquisition and/or installation of works of art. (Ord. 5155, 9-26-05; Ord. 5365, 3-24-08) CITY OF ISSAQUAH Chapter 3.99 MUNICIPAL ARTS FUND Sections: 3.99.010 Established. 3.99.010 Established. A. It shall be the policy of the City, unless otherwise prohibited or limited by law, to direct and further the inclusion of art in its public facilities. Such art shall include the visual and performing arts, which may include the production or arrangement of sounds, colors, forms, movements or other elements in a manner that enhances the sense of beauty and is of aesthetic value. B. Municipal construction projects, for the purposes of this chapter, shall include those paid for wholly or in part by the City at a cost to the City exceeding $10,000 for the construction, renovation, or remodel of any public building, park, street, sidewalk, parking, facility, or any portion thereof, within the City limits of Issaquah. This section shall not pertain to capital projects paid for wholly or in part by the City’s Water and Sewer Capital Funds, unless the City Council shall find that the project as installed is accessible to and generally frequented by the general public. C. All authorizations and/or appropriations for municipal construction projects shall, whenever legally permitted, include an amount equal to a certain percentage of the total estimated project cost, to be used for the selection, acquisition and/or installation of works of art to be placed in, on, or about appropriate City public facilities; or, in the case of performing art, in a facility and venue open to the public. The amount for art shall be calculated using a sliding scale equal to the following: 1. One-half of 1 percent of the total estimated cost up to $5,000,000; plus 2. One-quarter of 1 percent of the total estimated cost exceeding $5,000,000. D. Other entities participating in the cost of a municipal construction project may be granting agencies, or local improvement district property owners or developers participating in the cost of a project. In the event any law, rule or regulation establishing a source of funds for a particular project prohibits, limits or excludes art and art works as a proper expenditure on the part of these entities, then the amount of funds from such source shall be excluded in computing the percentage amount of the “total estimated project cost.” E. All funds authorized and/or appropriated pursuant to this section shall be maintained in the City of Issaquah Municipal Arts Fund, which is hereby created. The City Council, at its discretion and upon the recommendation and advice of the Commission, shall determine from time to time, the amount to be allocated for the selection, acquisition and/or installation of individual works of art or the art may be placed within, on, or about other public facilities; or, in the case of performing art, in a facility and venue open to the public. All such expenditures for art shall be approved by the City Council, except as otherwise provided for in this chapter. F. Funds authorized and/or appropriated pursuant to this section for a municipal construction project (but not expended on any such project) shall be retained in the “Municipal Arts Fund.” If, for any reason, any transfer to such fund shall be contrary to law or prohibited by any rule or regulation governing such funds, then any such unspent or residual sum authorized and/or appropriated as a part of a construction project shall be expended for the arts or reimbursed to the funding source(s). G. The City’s portion of the amount for art shall be placed in the Municipal Arts Fund as part of the City’s annual budgeting of capital projects, or as otherwise determined by the Council. H. The Mayor, based upon the advice and recommendation of the Arts Commission, may expend annually from the Municipal Arts Fund an amount up to the beginning fund balance, but not exceeding $1,000, for performing works of art. Any such funds not expended shall not accumulate from year to year.
