SUMMARY STATEMENT
In January 2015, the City entered into a contract with Gregg Dohrn (G.R. Dohrn & Associates) for professional
planning services. Task 1 was to conduct the periodic review / update to the City Comprehensive Plan which
was completed in October 2015. In 2016, the City will be conducting Task 2 (City Development Regulation
Periodic Review / Update - Municipal Code Revisions). Gregg Dohrn has submitted a scope of service and task
list that meets the WA State Growth Management Act (GMA) Periodic Update requirements and the City’s
GMA Public Participation Program.
Attached is Amendment No. 1 and budget (Exhibit C) to the contract for Task 2 Municipal Code Revisions. The
initial contract is still in effect and included Task 2.
We are requesting that Council approve Amendment No. 1 to revise the original Task 2 for Gregg Dohrn (G.R.
Dohrn & Associates) to provide assistance in reviewing and updating the City’s Development Regulations /
Municipal Code, for an amount not to exceed $33,040.
RECOMMENDED ACTION

Amendment No. 1 to Contract for Services
Between the City of Liberty Lake and G.R. Dohrn and Associates
The City of Liberty Lake (“City”) and G.R. Dohrn and Associates (“GRDA”) previously entered
into a Contract for Services (“Contract”) on or around February 3, 2015, for certain consulting
services as set forth and described in the Contract. The City and GRDA desire to amend the
terms of the Contract, and more specifically, the services identified in Task 2 of the
Contract. Therefore, pursuant to the parties’ agreement to amend the Contract, the Scope of
Services identified in the Contract shall be amended to replace the current Task 2 (Municipal
Code Revisions) with the following revised Task 2 and corresponding budget:
Task 2 Update Development Regulations
2.1 Project Mobilization
G. R. Dohrn and Associates will review and evaluate the City’s Development Regulations.
This review will include:
a. Meeting with the City’s Planning and Building Services staff;
b. Conducting a GMA compliance review;
c. Meeting with representatives of State agencies and the Spokane County Planning
Department to identify potential update priorities and opportunities for collaboration
with others; and
d. Meeting with the City Management Team to discuss opportunities to improve the
City’s Development Regulations.
e. In addition, this could also include at some point in the update process, a meeting
with local service providers and/or the local developers to see if they have any issues
or ideas for consideration.
2.2 Detailed Scope, Schedule, and Budget
GRDA will prepare and present for City review and approval a memo highlighting potential
update priorities and a more detailed scope of services, schedule, and budget identifying the
proposed level of effort and outlining the proposed step by step actions necessary to update
the City’s Development Regulations.
2.3 Updated Shoreline Master Program
It is anticipated that one of the project priorities will be to update the City’s Shoreline Master
Program in accordance with the provisions of the Washington State Shoreline Management
Act and the Growth Management Act. If so, consideration will be given to strategies for the

adoption of the Spokane County Shoreline Master Program as opposed to preparing a
freestanding City master program.
2.4 Critical Area Ordinance Update
It is anticipated that the project priorities will include updating the City’s regulations that
protect environmentally sensitive areas outside of jurisdictional shoreline areas. If so,
consideration will be given to collaborating with other jurisdictions and/or adopting model
ordinances.
2.5 Other Development Regulation Revisions
In accordance with direction provided by the City and the availability of resources, GRDA
will research and present for review and comment by City staff draft revisions to the City
Development Regulations. This may include, but is not limited to:
a. Revisions necessary to remain in compliance with the GMA;
b. Code enforcement;
c. Design standards; and/or
d. Land division.
2.6 Planning Commission Review
At the direction of the City, the Consultant will present the proposed amendments to the City
Planning Commission for review and comment and at a public hearing. The Consultant will
make revisions as appropriate.
2.7 SEPA/GMA Review
GRDA will prepare for issuance by the City draft documents for an integrated SEPA/GMA
review. It is anticipated that this review will result in the issuance of a Determination of Non-
Significance. If this is not the case, a revision to the scope of services and budget may be
required. The Consultant will assist the City in reviewing and responding to comments and
will make revisions to the draft amendments to the Development Regulations as appropriate.
2.8 Local Adoption
GRDA will present the Planning Commission recommended draft revisions to the City
Council for their review and final approval.

GRDA will provide additional professional planning services as may be required by the City
in order to complete the update process in a timely and cost effective manner.
2.10 Project Management/Communications
GRDA will submit to the City periodic project management reports that documents project
activities to date, the resources required to complete each task, and emergent management
issues.
2.11 Management Reserve/Contingency

3.1 Gateway Master Plan (Optional Task)
At the request of the City, G.R. Dohrn and Associates, in partnership with the Eastern
Washington University Urban and Regional Planning Program, will lead a team of students
in preparing and presenting alternative scenarios to improve the appearance of the I-
90/Liberty Lake Road interchange and the gateway to the City.
AMENDED PROJECT BUDGET
G. R. Dohrn and Associates shall be reimbursed for time and materials for Task 2, not to exceed
$33,040 unless authorized by the City, subject to the following conditions:
1. Invoices shall be submitted by G. R. Dohrn and Associates on a regular basis in a mutually
agreed upon format.
a. Invoices shall highlight the services provided during the billing period, progress to date,
planned activities, and emergent management issues.
b. Invoices shall only include the time and the cost of supportive services and materials
required to provide the requested services.
c. All invoices shall be based on the 2013 GRDA rate schedule with student interns to be
compensated at a rate not to exceed $15.15/hour.
2. It is understood that the Consultant may reallocate resources between sub-tasks in the
approved project budget (Exhibit C) provided that the contract amount for the task is not
exceeded.

3. G. R. Dohrn and Associates shall be responsible for travel related expenses associated with

SUMMARY STATEMENT
City Staff researched and received quotes for a new vehicle for Planning & Building Services to replace the green
Ford Explorer that has transmission issues. We are replacing the white Ford Explorer that also has transmission and
other issues with the Dodge Ram purchased in 2015. The optimal vehicle and price is a 2016 Dodge Ram 1/2 Ton V6
4WD Extended Cab Short Box pickup through the WA State Department of Enterprise Services CARS contract pricing
for a delivered purchase price of $29,920.55 + applicable title and licensing fees. The vehicle quote is attached. A
vehicle rotation plan has not yet been established for City Hall; however it is intended that this vehicle will be
utilized for 12 - 15 years by various City departments. The vehicle quote received is within the 2016 budgeted
amount of $30,000.

SUMMARY STATEMENT
We were successful with our grant application to the Washington Transportation Improvement Board
(TIB) for the roundabout construction at Mission and Molter. This project will convert the existing 4 way
stop to a single lane roundabout. The TIB funds for this project are $560,000. The City funds $172,000
towards construction. The City is also funding $84,374 for design of the roundabout. The project is
scheduled to go out for bid in early January of 2016.
RECOMMENDED ACTION
Accept the funds from TIB, authorize Mayor to sign and execute both the fuel tax agreement and
the project funding status form.

In October of 2015, the City issued an Request for Proposal for Legal Services. The City received 4
responses. The City selected 3 of the Law Firms to interview. Chief Asmus, RJ Stevenson, and Arlene
Fisher (former Finance Director for the City), met with three firms in a formal interview process and
made a recommendation to retain Evans, Craven, and Lackie P.S. for Legal Services. The other two

The City of Liberty Lake, Washington (“City”), agrees to retain Evans, Craven &
Lackie, P.S. (“ECL”), 818 West Riverside, Lincoln Building, Suite 250, Spokane,
Washington 99201-0910 for City Attorney Services.
I. RECITALS
A. The City is desirous of retaining Evans, Craven and Lackie, P.S. to
perform legal services as specified herein.
B. Legal Services (“Services”) shall generally include attendance at City
Council Meetings, Special Meetings, and Workshops; preparation and review of all City
Ordinances, Resolutions, contracts and other legal related documents; legal opinions and
memorandums; review of public works projects; land use planning; purchasing and
procurement; leasing, purchasing and sale of property; employment matters; public
disclosure laws; and certain other limited legal services as designated by the Mayor.

II. AGREEMENT
NOW, THEREFORE, in consideration of the following terms and conditions, the
parties agree as follows:
1. Services/Term/Fees.
Sean P. Boutz of Evans, Craven, and Lackie, P.S. shall provide Services as
the City Attorney to the City of Liberty Lake in accordance with City Ordinance, State
Law and generally accepted legal practices, including those Services contained herein,
provided that in the event the City requires ECL’s legal services, including those of Mr.
Boutz, outside of the designated Services, including but not limited to any litigation,
appeal, administrative law agency or tribunal, or other related jurisdiction, the City shall
compensate ECL on an hourly basis as set forth in paragraph 1(B) below.
A. Effective January 1, 2016 and continuing each month thereafter
through December 31, 2019, unless modified earlier by the parties, the fee for Services
shall be in the amount of five thousand five-hundred dollars ($5,500) per month. The
Services provided under this Agreement shall be tracked at an hourly rate of one hundred
eight-five dollars ($185) per hour for budgeting purposes. The City shall continue
compensating ECL the previous fee for Services rendered under the parties prior
agreement through December 2015.

B. For those legal services performed outside of the designated
Services identified in this Agreement, Mr. Boutz shall be compensated by the City at an
hourly rate of one hundred ninety-five dollars ($195) per hour.
C. At least ninety (90) days prior to the expiration of this Agreement
on December 31, 2019, the parties shall meet to discuss and negotiate an extension of this
Agreement to the mutual satisfaction of both parties. In the event the parties are unable to
reach an extension of this Agreement before December 31, 2019, the parties hereby agree
to extend the monthly fee and Services as provided herein until an extension is agreed
upon, or the relationship is mutually terminated.
2. Billing and Payment.
The City shall make monthly payments of the retainer amount set forth
herein upon receipt of ECL’s monthly billing invoice. Additional charges and incidental
expenses related to traveling while representing the City shall be mutually agreed upon
between the City and ECL.
3. Effort and Outcome.
Sean P. Boutz and ECL shall use best efforts in its representation of the
City. The City acknowledges that ECL and Mr. Boutz can provide no guarantees with
respect to the outcome of a matter.
4. Termination of Representation.
a. ECL reserves the right to withdraw from this Agreement if the City fails to
perform as outlined in this Agreement or for any reason as permitted or
required under the Washington Rules of Professional Conduct or as
permitted by the Court Rules or Judicial Decisions of the State of
Washington. Notification of withdrawal shall be made in writing to the
City with a reasonable notice period of at least sixty (60) days provided by
ECL. In the event of a withdrawal, the City agrees to promptly pay ECL
for all Services rendered including all fees, charges and expenses incurred
pursuant to this Agreement prior to the date of the withdrawal.
b. The City reserves the right to terminate the Agreement with or without
cause upon sixty (60) days-notice to ECL. In the event of such
termination by the City, ECL shall deliver all files as requested by the City
provided, that the City shall promptly reimburse ECL all outstanding fees,
charges and expenses incurred pursuant to this Agreement as well as
copying charges for reproduction of any produced files.

5. Entire Agreement.
This Agreement constitutes the entire understanding between the parties
and any prior understanding or representation proceeding the date of this Agreement shall
not be binding upon either party except to the extent incorporated herein.
6. Modification.
This Agreement shall be modified only by mutual agreement of the parties
herein. Any modification shall be in writing and signed by each party or an authorized
representative.
7. Notice.
Any Notice provided for under this Agreement shall be deemed
sufficiently given when sent by certified or registered mail to the respective address of
each party.
8. Washington Law and Venue
This Agreement shall be governed by and enforced in accordance with the
laws of the State of Washington. Venue shall be Spokane County.

ORDINANCE NO. 17-B
AN ORDINANCE OF THE CITY OF LIBERTY LAKE, WASHINGTON, AMENDING
LIBERTY LAKE MUNICIPAL CODE CHAPTER 4-4-2 TO LEVY AND IMPOSE AN
ADDITIONAL 1.3% SPECIAL EXCISE TAX ON THE SALE OR CHARGE MADE FOR
THE FURNINSHING OF LODGING BY ANY HOTEL, MOTEL, ROOMING HOUSE,
TOURIST COURT, OR TRAILER CAMP WITHIN THE CITY OF LIBERTY LAKE
PURSUANT TO RCW 67.28.181, TO BE USED FOR CERTAIN CAPITAL PURPOSES
FOR TOURISM PROMOTION, CREATING A SPECIAL FUND FOR THE TAX, AND
OTHER MATTERS RELATING THERETO.
WHEREAS, RCW 67.28.180 and 67.28.181 provide that qualified cities are authorized to
levy and collect a special excise tax on the sale or charge made for the furnishing of lodging that
is subject to tax under Chapter 82.08 RCW; and
WHEREAS, pursuant to RCW 67.28.1801, the state-credit lodging tax is credited against
the existing Washington State sales tax, resulting in no net increase in the amount of sales taxes
imposed upon the furnishing of lodging; and
WHEREAS, pursuant to RCW 67.28.181, the City of Liberty Lake (“City”) is authorized
to levy an additional special excise tax on the sale or charge made for the furnishing of lodging
that is subject to tax under chapter 82.08 RCW (“additional lodging tax") at a rate not to exceed
the lesser of two percent (2%) or a rate that, when combined with all other taxes imposed upon
sales of lodging within the municipality under chapter 67.28 RCW and chapters 36.100, 82.08,
and 82.14 RCW, equals twelve percent (12%); and
WHEREAS, pursuant to RCW 67.28.1817, any municipality that proposes imposition of
a tax or an increase in the rate of tax under chapter 67.28 RCW shall submit the proposal to the
City's Lodging Tax Advisory Committee (" LTAC") for review and comment and shall not take
any final action or pass the proposal until at least forty-five (45) days after submission of the
proposal to the LTAC;
WHEREAS, on December 4, 2015, the LTAC conducted a public meeting, at which the
LTAC discussed an increase to the additional lodging tax and moved and approved unanimously
to request the City Council to pass an additional 1.3% lodging tax to be put into funds as
designated herein; and
WHEREAS, the City Council desires to establish and levy such additional lodging tax in
the amount of 1.3% to be put into funds dedicated for promotion and capital expenditures that
support tourism facilities that generate overnight guests, as provided by law.
NOW, THEREFORE, the City Council of the City of Liberty Lake, Washington, do
ordain as follows:
Section 1. Amendment. Chapter 4-4-2 of the City of Liberty Lake Municipal Code is
hereby amended as follows:
A. Imposition. There is levied a special excise tax of two percent (2%)on the sale of
or charge made for the furnishing of lodging that is subject to tax under Chapter
82.08 RCW. The tax imposed under Chapter 82.08 RCW applies to the sale of or
charge made for the furnishing of lodging by a hotel, rooming house, tourist court,
motel, or trailer camp, and the granting of any similar license to use real property,
as distinguished from the renting or leasing of real property. It shall be presumed
that the occupancy of real property for a continuous period of one (1) month or
more constitutes a rental or lease of real property and not a mere license to use
and enjoy the same.
B. Imposition of Special Excise Tax. There is levied a separate special excise tax of
1.3 percent on the sale of or charge made for the furnishing of lodging that is
subject to tax under Chapter 82.08 RCW, pursuant to RCW 67.28.181.
C. Imposition of Tax in Addition to Other Taxes and Fees. The taxes levied in this
chapter shall be in addition to any license fee or any other tax imposed or levied
under any law or any other City Ordinance.
Section 2. Amendment. Chapter 4-4-3 of the City of Liberty Lake Municipal Code is
hereby amended as follows:
A. Creation of Tourism-Promotion Fund. There is created a special fund in the
treasury of the City and all taxes collected under this chapter shall be placed in
this special fund to be used solely for the purpose of paying all or any part of the
cost of tourist promotion, acquisition of tourism-related facilities, or operation of
tourism-related facilities or to pay for any other uses as authorized in Chapter
67.28 RCW, as now or hereafter amended.
B. Creation of Tourism-Promotion Capital Fund. There is created a special fund in
the treasury of the City and all taxes collected under this chapter shall be placed in
this special fund to be used solely for the purpose of paying all or any part of the
cost of tourist promotion, acquisition of tourism-related facilities, or operation of
tourism-related facilities or to pay for any other uses as authorized in Chapter
67.28 RCW, as now or hereafter amended.
Section 3. Severability. If any section, sentence, clause or phrase of this Ordinance
shall be held to be invalid or unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any
other section, sentence, clause, or phrase of this Ordinance.
Section 4. Effective Date. This Ordinance shall be in full force and effect five (5)
days after publication of this Ordinance or summary thereof in the official newspaper of
the City of Liberty Lake as provided by law.

CITY OF LIBERTY LAKE
SPOKANE COUNTY, WASHINGTON
AN ORDINANCE OF THE CITY OF LIBERTY LAKE, WASHINGTON, ADOPTING A BUDGET
FOR THE PERIOD JANUARY 1, 2016 THROUGH DECEMBER 31, 2016, APPROPRIATING
FUNDS AND ESTABLISHING SALARY SCHEDULES FOR ESTABLISHED POSITIONS.
WHEREAS, state law requires the Mayor to prepare a preliminary budget for the City of
Liberty Lake at least sixty (60) days before the beginning of the City’s fiscal year beginning
January 1, 2016 and ending December 31, 2016.
WHEREAS, the Mayor, in consultation with City Staff, has prepared and placed on file
with the City Clerk a preliminary budget together with an estimate of the amount of money
necessary to meet the expenses of the City, including payment of outstanding obligations;
WHEREAS, notice was posted and published on October 22, 2015 and October 29,
2015 that the City Council of the City of Liberty Lake would meet and receive public comment in
the City Council chambers prior to the adoption of the budget;
WHEREAS, the attached 2016 Budget of the City of Liberty Lake reflects the provision of
municipal services and programs that will enhance the public health, safety and welfare of the
citizens; and
WHEREAS, the City Council has determined that the best interest of the City is serviced
by adopting the budget set forth herein:
NOW, THEREFORE, the City Council of the City of Liberty Lake, Washington, does
ordain as follows:
Section 1. Adoption of the Budget. The budget for the City of Liberty Lake for the
year 2016 is hereby adopted at the fund level and as the balanced budget for the City with
appropriations limited to the total estimated revenues and ending fund balance of the City. The
final budget for $11,616,927 attached hereto by this reference is incorporated herein pursuant to
RCW 35A.33.075.
Estimated resources for each separate fund of the City of Liberty Lake, and aggregate
expenditures for all such funds for the year 2016 are set forth in a summary form in Exhibit A.
Section 2. Positions, Salary Schedules and Adjustments. The various positions and
salary ranges for City employees are adopted in the form and amounts attached to this
Ordinance as Exhibit B. To further the efficient operation of the City, the Mayor is authorized to
make transfers between individual appropriations within any one fund for the 2016 budget. The
Mayor may make salary adjustments as deemed appropriate in the exercise of reasonable
discretion.
Section 3. Transmittal. A complete copy of the budget, as adopted, together with a
copy of this Ordinance, shall be transmitted by the City Clerk to the Division of Municipal
Corporations of the Office of the State Auditor and to the Association of Washington Cities.
Section 4. Severability. If any section, sentence, clause or phrase of this Ordinance
should be held to be invalid or unconstitutional by a court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section,
sentence, clause or phrase of this Ordinance.
Section 5. Effective Date. This Ordinance shall be in full force and effect five (5)
days after publication of this Ordinance or a summary thereof in the official newspaper of the

ORDINANCE NO. 175A
AN ORDINANCE AMENDING THE CITY OF LIBERTY LAKE PLANNING
COMMISSION BYLAWS.
WHEREAS, the City of Liberty Lake (“City”) passed Ordinance No. 75 creating a
Planning Commission and establishing duties thereof; and
WHEREAS, consistent with Ordinance No. 75 the City passed Ordinance 175 approving
Bylaws for the Planning Commission; and
WHEREAS, the City Council of Liberty Lake in consultation with the Planning
Commission desire to amend the Bylaws as set forth herein.
NOW, THEREFORE, the City Council of the City of Liberty Lake, Washington, do
ordain as follows:
Section 1. Amendment.
Ordinance No. 175, Section C (3), is hereby amended to read as follows:
a. Regular Members: The Planning Commission shall consist of seven (7) voting
members. All seven (7) members shall reside within in the City. The terms for the
initial commissioners shall be two (2) 1-year terms, two (2) 2-year terms and three (3)
3-year terms. The initial members and their terms shall be decided by the Mayor and
confirmed by the City Council. Subsequent terms shall be for a three (3) year period.
Terms shall expire on December 31st.
b. Adjunct Members: Adjunct Members may be brought in to serve as additions to the
required (7) members. The adjunct members may reside within the City and shall be
appointed in the same manner as set above. Adjunct members may participate in
meetings, workshops, hearings, and workgroups but they are not permitted to
participate in voting. Adjunct members may become full time voting members if a
vacancy occurs on the Planning Commission and they are appointed to the position;
provided such members reside within the City at the time of appointment.
Ordinance No. 75 shall also be amended in Section 2, Paragraph 3, as necessary, to
reflect the membership changes and requirements contained herein and to be consistent
therewith.
All other provisions contained in Ordinance No. 75 and Ordinance No. 175 shall remain
in full force and effect.
Section 2. Severability. If any section, sentence, clause or phrase of this Ordinance shall be
held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or

unconstitutionality shall not affect the validity or constitutionality of any other section, sentence,
clause or phrase of this Ordinance. In the event there is a conflict between the provisions of this
Ordinance, Ordinance No. 75, establishing the Planning Commission, and Ordinance No. 175,
Ordinance 75 shall prevail.
Section 3. Effective Date. This Ordinance shall be in full force and effect five (5) days after
publication of this Ordinance or a summary thereof in the official newspaper of the City as
provided by law.
