WORKSHOP DISCUSSION MATERIAL AGENDA ITEM NO.: 10 BUSINESS OF THE CITY COUNCIL, LIBERTY LAKE, WASHINGTON SUBJECT: FOR THE AGENDA OF: October 1, 2019 Workshop re HB 1406 – Shared Revenue for Affordable Housing DEPT. Key, Director EXPENDITURE REQUIRED: No BUDGETED: No SUMMARY STATEMENT In the 2019 Legislative Session, the state approved a local revenue sharing program to provide up to 0.0146% local sales and use tax credited against the state sales tax for affordable housing programs, with funds split between the County and local jurisdictions wishing to participate. In order to take advantage of the program, Cities need to pass a resolution by January of 2020 to “opt in”. Should the City of Liberty Lake opt in, based on an average of $400 million in sales, the City’s revenue share is estimated at approximately $29,000 per year. These funds can be pooled with those of larger municipalities or public benefit non-profit organizations within our region to provide affordable housing, subsidized housing, or supportive housing services through interlocal or joint powers agreements, cooperative action agreements, or contracts to perform governmental activities, as provided for in RCW 39.34. Washington State Department of Commerce is undertaking the rulemaking process, and draft rules are anticipated to be available for comment later in October, with final rules adopted by December of this year. RECOMMENDED ACTION 1. Opportunity for City Council to discuss the proposed timeline and process for implementing HB 1406, which creates shared revenue source for affordable housing, as well as potential opportunities for City of Liberty Lake to participate regionally. WHEREAS, in the 2019 Regular Session, the Washington State Legislature approved, and the Governor signed, Substitute House Bill 1406 (Chapter 338, Laws of 2019) (“SHB 1406”); and WHEREAS, SHB 1406 authorizes the governing body of a city or county to impose a local sales and use tax for the acquisition, construction or rehabilitation of affordable housing or facilities providing supportive housing, [and] for the operations and maintenance costs of affordable or supportive housing, [FOR COUNTIES of 400,000 or less, or CITIES of 100,000 or less: or, if eligible, for providing rental assistance to tenants]; and WHEREAS, the tax will be credited against state sales taxes collected within the [City/County] and, therefore, will not result in higher sales and use taxes within the [City/County] and will represent an additional source of funding to address housing needs in the [City/County]; and WHEREAS, the tax must be used to assist persons whose income is at or below sixty percent of the [City/County] median income; and WHEREAS, the [City/County] has [describe housing need] and has determined that imposing the sales and use tax to address this need will benefit its citizens; and WHEREAS, in order for a city or county to impose the tax, within six months of the effective date of SHB 1406, or January 28, 2020, the governing body must adopt a resolution of intent to authorize the maximum capacity of the tax, and within twelve months of the effective date of SHB 1406, or July 28, 2020, must adopt legislation to authorize the maximum capacity of the tax; and WHEREAS, this [ordinance/resolution] constitutes the resolution of intent required by SHB 1406; and WHEREAS, the [City Council/County Board of Commissioners] now desires to declare its intent to impose a local sales and use tax as authorized by SHB 1406 as set forth herein; -1- 10155 99999 ib221c42js NOW, THEREFORE, BE IT [RESOLVED][ORDAINED] BY THE [CITY COUNCIL/COUNTY BOARD OF COMMISSIONERS] OF THE [CITY OF ______________/ ______ COUNTY] AS FOLLOWS: Section 1. HEAD APPROVAL: City Administrator Easement Deed, Exhibit A & B EXPENDITURE REQUIRED: Yes BUDGETED: General Fund – Budget Amendment Pending with WSDOT Agreement SUMMARY STATEMENT The Henry Road overpass project was funded by the Washington State legislators in the 2019-2021 fiscal biennium. The construction of this project requires an easement over Spokane County Right of Way located on the south side of Interstate 90. The easement is approximately 9,432 square feet. This easement and the property acquired from Centennial Properties is required for WSDOT to certify the Right of Way for the project. The easement is attached and is summarized as follows: 1. Liberty Lake will pay Spokane County $18,000 for consideration of the easement. This payment is refundable, and the easement will be vacated if the project does not proceed by 12/31/2025. 2. Spokane County will own the bridge structure in the easement area. 3. Liberty Lake will operate, maintain and provide for required bridge inspections. 4. Liberty Lake will design the Henry Road overpass project to protect the existing sewer line owned by Spokane County. 5. Liberty Lake will provide access in the easement for Spokane County to construct mass transit improvements or other uses. 6. Refer to attachment for specific details. RECOMMENDED ACTION 1.
