BOARD OF TRUSTEES VILLAGE BOARD MEETING Tuesday, January 24,2023 at 8:00 PM Village Hall Board Room 118 W. Cook Avenue Libertyville, IL 60048 MINUTES Mayor Johnson called to order a meeting of the Board of Trustees at 8:00 p.m. Those present were: Mayor Donna Johnson, Trustees Scott Adams, Matthew Hickey, Matthew Krummick, and James ConneH. Absent Trustees Peter Garrity and Dan Love. Items Not on the Agenda | Presentation of items not on the Agenda wili be limited to three (3) minutes Mayor Johnson recognized and thanked the following employees for their years of service with the Village: • Deputy Police Chief Chad Roszkowiak-25 years • Patrol Officer Dave Kochenash- 10 years • Facilities Manager Dan Juarez- 5 years • Patrol Officer Jason Howard- 5 years Mayor Johnson called for a motion to approve Michael Pakosta as the new Libertyville Fire Chief. Trustee Adams moved to approve the appointment, and Trustee Hickey seconded. The motion carried on roll call vote as follows; Voting Yea: Village Trustee Adams, Village Trustee Hickey, Village Trustee Krummick, Village Trustee Connell. The motion was approved by a 4-0 vote. Mayor Johnson read a proclamation into the record recognizing the month of February as Black History Month. Mayor Johnson asked if there was any public comment. Members of the Libertyville Sunrise Rotary Club announced an upcoming event which will be held on March 11, 2023. The event includes a Second City Comedy Show at the Libertyville High School and after party at Mickey Finns Brewery. All proceeds will benefit local charities. 3. ARC Report A motion was made by Village Trustee Adams to approve the omnibus vote agenda, Seconded by Village Trustee Hickey. Voting Yea: Village Trustee Adams, Village Trustee Hickey, Village Trustee Krummick, Village Trustee ConneU. The item was approved by a 4-0 vote. REGULAR AGENDA 4. a. Report of the Plan Commission, (PC 23-01), Text Amendment to Section 16-8.5 (a)- 119 Homewood Avenue The property owner of 119 Homewood Avenue requested a Text Amendment to the Zoning Code to allow the Village Board to issue variations in regard to the width of shed dormers. The Zoning Code regulates dormers on single family dwellings to not exceed eight (8) feet in width. Members of the Plan Commission reviewed the intention of the Code which was to regulate dormers that create more space in an attic. The Plan Commission concurred with the request to list the width of shed dormers as an authorized variation. A motion to recommend Village Board of Trustees approval passed with a vote of 6 - 0. Mayor Johnson asked if there were any public comments, and there were none. A motion was made by Village Trustee Adams to approve the Report of the Plan Commission, Seconded by Village Trustee Mickey. Voting Yea: Village Trustee Adams, Village Trustee Hickey, Village Trustee Krummick, Village Trustee Connell. The item was approved by a 4-0 vote. b. Report of the Zoning Board of Appeals, (ZBA 23-01), Variation for Width of Shed Dormer- 119 Homewood Avenue At the meeting of January 9, 2023, the Zoning Board of appeals heard a request from Sharon Kocken for a variation to allow for an increase in the width of a dormer from eight (8) feet to approximately 20.5 feet for construction of a second story addition. VILLAGE OF LIBERTYVILLE Board of Trustees Village Board [VIeeting [VIinutes January 24, 2023 Members of the Zoning Board of Appeals concurred with the request as the proposal is designed to integrate into the architecture of the house. The dormer is located on the second floor and will meet all setbacks for the lot. A motion to recommend Village Board of Trustees approval passed with a vote of 6 - 0. Mayor Johnson asked if there were any public comments, and there were none. A motion was made by Village Trustee Hickey to approve the Report of the Zoning Board of Appeals, Seconded by Village Trustee Adams. Voting Yea: Village Trustee Adams, Village Trustee Hickey, Village Trustee Krummick, Village Trustee Connell. The item was approved by a 4-0 vote. 5. RESOLUTION NO. 23-R-10: A Resolution to Approve a Contract Renewal with Tallgrass Restoration, LLC for the Butler Lake, Paradise & Riverside Park Ponds Shoreline Plant Annual Maintenance The Village renewed a contract for the first of a possible 2-year renewal period for the Butler Lake, Paradise & Riverside Park Ponds shoreline plant annual maintenance with Tallgrass Restoration on March 8, 2022 with the passage of Resolution 22-R-34. The initial (first-year) low bidder, Cardinal State, LLC was determined not to be the lowest bidder over the three years of submitted pricing. The contracted work included numerous site visits for weed control, native seed installation, cattail treatments and prescribed bums. Public Works staff recommended renewing the contract for the second of two possible additional years with Tallgrass Restoration, LLC based upon their responsiveness and successful work completed to date and agreement to renew in the amount of $20,489.00. This was a decrease over the prior year of $4,200 due to less cattail treatment needed in Year 2 of the contract. The proposed work would occur in Fiscal Year (FY) 2023/24. Staff recommended approval of the resolution to approve the contract renewal with Tallgrass Restoration, LLC in the amount of $20,489.00 for the Lake and Ponds Shoreline Plant Annual Maintenance and authorize execution of the contract renewal by the Village Administrator, subject to the appropriation of the necessary funds in the FY 2023/24 Draft Annual Budget. Mayor Johnson asked if there were any public comments, and there were none. Trustee Adams stated that he supports the contract and is happy to see restoration occurring in that location. Trustee Hickey thanked Director Kendzjor for his work on the contract. Trustee Krummick asked for clarification regarding the herbicide use that is outlined in the contract. Director Kendzior explained that a combination of herbicide treatments and prescribed burns is used to get rid of the invasive species. Trustee Krummick asked who determines the limitations of the prescribed burns. Director Kendzior noted that the Parks staff and the contractor work together to identify the limitations based off the comprehensive maintenance plan. Petitions and Communications Mayor Johnson announced the following: • The Parks and Recreation Advisory Commission will NOT meet at 8:30 a.m. on Thursday, January 26, 2023. • The Board of Fire and Police Commissioners will meet at 4:00 p.m. on Thursday, January 26, 2023 at the Libertyville Police Department, 200 E. Cook. • The Board of Fire and Police Commissioners will meet at 4:00 p.m. on Friday, January 27, 2023 at the Libertyville Police Department, 200 E. Cook. • The Board of Fire and Police Commissioners will meet at 8:00 a.m. on Saturday, January 28, 2023 at the Libertyville Police Department, 200 E. Cook. • The Police Pension Fund Board will meet at 1:00 p.m. on Monday, January 30, 2023 at the Libertyville Police Department, 200 E. Cook. • The Board of Fire and Police Commissioners will meet at 5:00 p.m. on Monday, January 30, 2023 at the Fire Department, 1551 N. Village Administrator Update Administrator Amidei reminded the Board that a Committee of the Whole meeting will be held on February 7th at 7:00 p.m. She officially welcomed Chief Pakosta as a newly appointed Department Head. Administrator Amidei further reported that the remaining budgeted capital projects for the fiscal year will be bid soon and that the water main project for Bartlett Terrace and Winchester Road will begin in a few weeks. She also provided a general reminder that there are currently a lot of contractors working in the Village and that notices regarding the work are located on the website and social media. Board Comments The Board members expressed their congratulations to Chief Pakosta on his appointment to the position of Fire Chief. Trustee Hickey noted that he is happy to see all the new businesses in town. 8. Executive Session Trustee Adams moved to enter executive session per [5 ILCS 120/2(c)(11) and (c) (5) ] at 8:50 p.m. and Trustee Hickey seconded. The motion carried on a roll call vote as follows: Voting Yea: Village Trustee Adams, Village Trustee Hickey, Village Trustee Krummick, Village Trustee Connell. The motion was approved by a 4-0 vote. Trustee Adams moved to leave executive session and return to the regular board meeting at 9:28 p.m., Trustee Connell seconded, and the motion was approved by a roll call vote. Voting Yea: Village Trustee Adams, Village Trustee Hickey, Village Trustee Krummick, Village Trustee Connell. The motion was approved by a 4-0 vote. With no further business to come before Village Board, Trustee Connell moved to adjourn the meeting at 9:29 p.m., and Trustee Adams seconded.
