Treasurer’s Report $95,850.72 CONSENT AGENDA: The items listed below are considered routine by the Borough of Lindenwold and will be enacted by one motion. There will be no formal discussion of these items. If discussion is desired, this item will be removed from the Consent Agenda and will be considered separately. RESOLUTIONS 2019:220-230 Motion was made by President Randolph-Sharpe, second by Councilwoman Sinon that Resolution 2019:220 to Resolution 2019:230 be adopted as read. Roll call vote was in the affirmative with Councilwoman Hess abstaining from Resolution 2019:226. Motion carried. RESOLUTION 2019:220 Animal Shelter Services WHEREAS, the Borough of Lindenwold has an agreement with Camden County for providing animal shelter services, and WHEREAS, the official name is Homeward Bound Pet Adoption Center, Inc., and WHEREAS, the Borough of Lindenwold wishes to maintain this agreement for the benefit of its residents, and WHEREAS, the agreement must be signed by December 31, 2019 for services to start on January 1, 2020. THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold renew the agreement for animal holding with Homeward Bound Pet Adoption Center, 125 County House Road, Blackwood, NJ 08012 for the basic amount of $4,250.00 per month with additional services outlined in the contract. RESOLUTION 2019:222 Authorizing The Transfer Of Certain Properties Acquired By The Borough Through In Rem Foreclosures Of Tax Lien Titles To Aw Urban Renewal, LLC. WHEREAS, on August 9, 2017, the Borough of Lindenwold, adopted Ordinance 2017-15, adopting a Redevelopment Plan for the areas of land within the Borough of Lindenwold, as more particularly described as Block 243, Lots 7.01, 7.02, and 7.04, and all Qualifiers thereon on the official tax Map of the Borough of Lindenwold, and designated such properties as an “Area in Need of Redevelopment” and designated said properties as a “Condemnation Redevelopment Area” , pursuant to N.J.S.A. 40A:12A-6; and WHEREAS, on August 8, 2018, the Borough of Lindenwold executed a Redevelopment Agreement with AW Urban Renewal, LLC, for the purposes of implementing the Redevelopment Plan, as adopted by the Borough pursuant to Ordinance 2017-15; and WHEREAS, the Redevelopment Agreement authorizes the Borough to acquire properties through In Rem Tax Foreclosure proceedings, as part of the Redevelopment Plan, and deed such properties so acquired to the Redeveloper, AW Urban Renewal, LLC; and WHEREAS, on January 23, 2019, the Borough of Lindenwold passed Resolution 2019:74, authorizing In Rem Tax Foreclosures on certain lands and properties, as listed and identified below; NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Lindenwold, in the County of Camden and the State of New Jersey that the Borough of Lindenwold hereby authorizes the following properties set forth below, acquired, or in the process of being acquired through In Rem Foreclosures of Tax Lien Titles, to be deeded and transferred to AW Urban Renewal, LLC, as part of the Redevelopment Plan for the areas of land within the Borough of Lindenwold, as more particularly described as Block 243, Lots 7.01, 7.02, and 7.04, and as authorized pursuant to the Redevelopment Agreement executed by the Borough of Lindenwold on August 8, 2018, and Ordinance 2017-15, to Redevelop said properties. THEREFORE, BE IT RESOLVED by the Mayor and the Borough Council of the Borough of Lindenwold that pursuant to N.J.S.A. 40A:11-13.2 that all the bids are rejected. RESOLUTION 2019:224 Chapter 159 for NJ Transportation WHEREAS, N.J.S. 40A:4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget, and WHEREAS, said Director may also approve the insertion of an item of appropriation for equal amount, and WHEREAS, the Borough of Lindenwold will receive $449,814 from the New Jersey Department of Transportation and wishes to amend its 2019 Budget to include this amount as a revenue NOW, THEREFORE, BE IT RESOLVED that the Mayor and Borough Council of the Borough of Lindenwold hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2019 in the sum of $449,814 which is now available as a revenue from the State of New Jersey, and BE IT FURTHER RESOLVED that a like sum of $449,814 and the same is hereby appropriated under the caption of: New Jersey Transportation Trust Fund - Traffic Signal Upgrades BE IT FURTHER RESOLVED that this resolution will be sent to the Director of Local Government Services for certification. BUSINESS MEETING December 11, 2019 Page | 4 RESOLUTION 2019:225 Approve Liquor Licenses BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that the following liquor licenses are hereby approved for the year 2019- 2020: LICENSEE NUMBER Topica LLC(inactive) 0422-33-009-005 RESOLUTION 2019:226 Approve Raffle License for Lindenwold Moose Lodge BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that Raffle License #RA657 be approved for Lindenwold Moose Lodge #548 for pull tab raffles during the year 2020 at 2425 S. NOW, THEREFORE, BE IT RESOLVED that the Mayor and Borough Council of the Borough of Lindenwold hereby requests the Director of the Division of Local Government Services to approve the insertion of an item of revenue in the budget of the year 2019 in the sum of $12,649 which is now available as a revenue from the City of Camden, and BE IT FURTHER RESOLVED that a like sum of $12,649 and the same is hereby appropriated under the caption of: Local Law Enforcement Grant—Justice Assistance Grant (JAG) BE IT FURTHER RESOLVED that this resolution will be sent to the Director of Local Government Services for certification. RESOLUTION 2019:228 Budget Transfers BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that the following transfers be made to the 2019 Budget in accordance with N.J.S 40A:4-58: From To General Fund Tax Collector S&W 11,100.00 Parks & Playground OE 3,500.00 Compliance S&W 4,500.00 Sanitation & Recycling S&W 1,500.00 Water OE 1,600.00 Total 11,100.00 11,100.00 RESOLUTION 2019:229 Borough Vehicle WHEREAS, the Borough of Lindenwold passed Resolution 2019:88 to participate in the Cooperative Purchasing Program with National Intergovernmental Purchasing Alliance Co. and administered by Sourcewell for the purchase of goods, products and services; and WHEREAS, under this program, the Borough of Lindenwold wishes to acquire a 2020 Ford F-150 with a not to exceed amount of $44,744.40 and with the equity lease agreement paid over a period of five years in the annual amount of $8,948.88. THEREFORE BE IT RESOLVED that the Mayor and Lindenwold Borough Council hereby authorizes the acquiring of the vehicle as stated above. RESOLUTION 2019:230 Authorizing Disposal of Surplus Property BUSINESS MEETING December 11, 2019 Page | 5 WHEREAS, the Borough of Lindenwold is the owner of certain surplus property which is no longer needed for public use; and WHEREAS, the Mayor and Council are desirous of selling said surplus property in an as is condition without express or implied warranties. NOW THEREFORE, be it RESOLVED by the Borough of Lindenwold, as follows: The sale of the surplus property shall be conducted through GovDeals pursuant to Resolution 2019:88 to participate in the Cooperative Purchasing Program with National Intergovernmental Purchasing Alliance Co. and administered by Sourcewell for the purchase of goods, products and services. The terms and conditions of the agreement entered into with GovDeals is available online at govdeals.com and also available from the Borough of Lindenwold. The sale will be conducted online and the address of the auction site is govdeals.com. The sale is being conducted pursuant to Local Finance Notice 2008-9. RESOLUTION 2019:231 WHEREAS, the State of New Jersey passed legislation that part time employees are now eligible to receive Earned Sick Leave; and WHEREAS, for every 30 hours worked, an employee shall accrue one hour of earned sick leave to use in any benefit year, or carry forward from one benefit year to the next, not more than 40 hours of earned sick leave; and WHEAREAS, the Earned Sick Leave act allows the employer to pay unused earned sick leave in the final month of the employer’s benefit year; and WHEREAS, the Borough of Lindenwold wishes to comply with the new regulations addressing Earned Sick Leave; and NOW, THEREFORE, BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold to hereby adopt the legislation for Earned Sick Leave to be administered under payroll. Motion was made by President Randolph-Sharpe, second by Councilman DiDomenico that Resolution 2019:231 be adopted as read. Roll call vote was unanimous in the affirmative. Motion carried. Department Reports Councilman DiDomenico presented the Lindenwold Police Department Report for November including 1,772 total calls for service. No report for the Fire Department. BUSINESS MEETING December 11, 2019 Page | 6 Councilwoman Hess started with what a wonderful parade including Santa and the fire trucks. She announced the upcoming events to be held at the Library. Project Elf is collecting toys or donations for the residents of Lindenwold and can be dropped off during regular Library hours. Councilwoman Hess read a letter from Acenda awarding the dedication of the Lindenwold Library Supervisor with the 2019 Dedicated Visionary Award. President Randolph-Sharpe thanked everyone for their participation with the Lindenwold Parade. She congratulated Councilwoman Hess for the great job for the float. She announced that the school will be coming up on the winter break but they will be holding several winter concerts at the respected schools. She also commended the school band for their participation in the parade. Business Administrator highlighted Resolution 2019:224 for the Grant to update the traffic signal at the intersection of Egg Harbor and Gibbsboro Road. The Mayor commended the Engineer for this achievement. Councilman Jackson also stated that the holiday parade was excellent including the float. He presented the Code Enforcement Report for November including 232 violations found. On January 1 he invited everyone to come to Atlantic City for the polar bear plunge. Councilman Strippoli presented the November monthly report for Public Works including 651 tons of trash and 54 tons of recycling. There were no accidents but one injury. Next, he presented the Sewer Report including 74 service calls. Councilwoman Sinon announced that Camden County has a snow removal program for seniors when snow accumulates more than 4”. Camden County will also be holding their Caregivers Program starting in January. She also reminded everyone that it is not too late to get their flu shot. Engineer’s Report was presented by Anthony Chadwell from Remington and Vernick including the recent award as well as amending the scope for the repaving of Linden Town. No matters for discussion. Mayor Roach opened the meeting to the public. Diane Veteri, resident, questioned the resolution for the hiring of a special attorney. The Borough Solicitor stated that this was something that she brought to the Borough’s attention and asked if she wished to cancel that investigation. She feels that the individual should pay this cost and not the tax payer. Danielle Brittin, resident, discussed with Council the program by Heart and Soul for the community. Mayor Roach asked for more information regarding this program. She also wanted to thank everyone for the great parade as well as the road improvements on Berlin Road. Karen Jennett, resident, informed Council of the storm drains that need to be cleared by the bridge which prevents the water from draining. Mayor responded that he will look into this. Ramel Coles, Arborwood owner, stated that he has been treated unfairly by the township due to redevelopment. He complained that the redevelopment attorney does not return phone calls. He has been trying to get help. Borough Solicitor has spoken to Mr. Coles and has provided information for him including the increase to the offer. He has recommended that he contact the attorneys who are handling this matter for the mortgage company. There being no one else desiring the floor, the Mayor closed the meeting to the public.
