RESOLUTION 2020:106 - Introduction of 2020 Budget BE IT RESOLVED that the following statements and revenues and appropriations shall constitute the Municipal Budget for the year 2020, and 1. Appropriations within “CAPS” (a) Municipal Purposes $13,937,287.16 2. Appropriations excluded from “CAPS” (a) Municipal Purposes 1,344,896.90 Total General Appropriations excluded from “CAPS” 1,344,896.90 Reserve for Uncollected Taxes 1,391,809.94 4. Total General Appropriations 16,673,994.00 5. Less: Anticipated Revenues Other than Current Property Tax 6,532,752.86 6. Difference: Amount to be Raised by Taxes for Support of Municipal Budget: (a) Local Tax for Municipal Purposes Including Reserve for Uncollected Taxes 10,141,241.14 BE IT FURTHER RESOLVED that said budget be published in The Courier Post May 15th edition The Governing Body of the Borough of Lindenwold does hereby approve the following budget for the year 2020. Motion was made by President Randolph-Sharpe, second by Councilwoman Sinon that Resolution 2020:106 be adopted as read. Roll call vote was unanimous in the affirmative. Motion carried. CONSENT AGENDA: The items listed below are considered routine by the Borough of Lindenwold and will be enacted by one motion. There will be no formal discussion of these items. If discussion is desired, this item will be removed from the Consent Agenda and will be considered separately. Resolution 2020:107-109 Motion was made by President Randolph-Sharpe, second by Councilman Strippoli that Resolution 2020:107 to Resolution 2020:109 be adopted as read. Roll call vote was unanimous in the affirmative. Motion carried. RESOLUTION 2020:107 Change Order for Laurel Road Pedestrian Project BE IT RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that, based upon the recommendation of Remington & Vernick Engineers, that Change Order #1 to the contract for NJDOT Infrastructure Trust for Laurel Road Pedestrian Improvements, Phase II with Think Pavers Hardscaping, LLC, and 125 Kings Highway, Mt. Royal, New Jersey is hereby approved as follows: Original Contract Amount $135,690.00 New Work/Change Order ($10,922.75) Adjustment Amount Based on Change Order No. 1 $124,767.25 Amount to be paid $10,335.35 The reason for the change is a reduction for “Adjustment of as-built quantities” BE IT FURTHER RESOLVED by the Mayor and Borough Council of the Borough of Lindenwold that payment to Think Pavers Hardscaping, LLC is hereby authorized in the final balance of $10,335.35. RESOLUTION 2020:108 -Application for Safe and Secure COUNCIL CAUCUS MEETING April 22, 2020 Page | 2 WHEREAS, the Borough of Lindenwold wishes to apply for funding for a project under the Safe and Secure Communities Program, and Whereas, the Borough of Lindenwold Borough Council has reviewed the accompanying grant award letter #20- 0422 for $90,000.00 and has accepted responsibility to match the award with “fringe” or “fringe benefits” or the specific fringe or match dollar amount totaling $363,903.00 and has approved said request for the grant period March 14, 2020 through March 13, 2021, and WHEREAS, the Borough of Lindenwold is a Unit of Government that is authorized to accept the award, and WHEREAS, the project is a joint effort between the Department of Law and Public Safety and the Borough of Lindenwold for the purpose described in the application. THEREFORE, BE IT RESOLVED by the Lindenwold Borough Council that: 1. As a matter of public policy the Borough of Lindenwold wishes to participate to fullest extent possible with the Department of Law and Public Safety. 2. The Attorney General will receive funds on behalf of the applicant. 3. The Division of Criminal Justice shall be responsible for the receipt and review of the applications for said funds. 4. The Division of Criminal Justice shall initiate allocations to each applicant as authorized. RESOLUTION 2020:109 –Settlement Agreement with Successful Asset Resolution Authorizing The Borough Of Lindenwold To Enter Into A Settlement Agreement And Mutual Release With Successful Asset Management, LLC And VLBABD, LLC WHEREAS, the Borough of Lindenwold has filed Verified Complaint(s) commencing Forty-Five separate lawsuits in Camden County Superior Court for certain Subject Properties, pertaining to the Arborwood Redevelopment project, and said Subject Properties, were previously owned by Successful Asset Management, LLC, and/or VLBABD, LLC; and WHEREAS, the Verified Complaints have been the subject of litigation between the Borough and Successful Asset Management, LLC, and VLBABD, LLC; and WHEREAS, the Borough of Lindenwold has negotiated a settlement agreement and mutual release with Successful Asset Management, LLC, and VLBABD, LLC, arising out of the multiple actions filed in Camden County Superior Court, concerning the valuation and acquisition of the Subject Properties, subject of the litigation; and WHEREAS, the Borough of Lindenwold and Successful Asset Management, LLC and VLBABD, LLC wish to resolve the Lawsuits and have set forth their respective rights and obligations in a formal agreement. NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Lindenwold, that the Mayor is authorized to accept and sign the Settlement Agreement and Mutual Release negotiated with Successful Asset Management, LLC and VLBABD, LLC, to resolve the litigation between the Parties. Mayor Roach presented updates. There are 95 total cases in Lindenwold. The Food Pantry will be at Lot one of Patco on Saturday. Mayor Roach updated the residents that restaurants are open for takeout. He encouraged them to support these businesses. Mayor Roach opened the meeting to the public. Diane Veteri, resident, questioned about extensions for property taxes. Mayor Roach responded that we are not able to grant extensions for taxes. President Randolph-Sharpe added that it would have to come from the Governor. Resident asked about a list for businesses. Mayor Roach stated that it was on Facebook. He thanked the person who posted this. She asked for an update regarding her complaint. The Borough Solicitor responded that he has not had any updates. There being no one else desiring the floor, the Mayor closed the meeting to the public. Motion was made by President Randolph-Sharpe, second by Councilwoman Sinon that the meeting be adjourned.
