Flag Salute Roll Call of Council Members Present: DiDomenico, Hess, Jackson, Sinon, Strippoli, President Randolph-Sharpe, and Mayor Roach Resolution 2021:84 Executive Session BE IT RESOLVED by the Mayor and Council of the Borough of Lindenwold that the Mayor and Council are now going into closed session to discuss Legal Updates, and Personnel-Contract Negotiations Motion was made by President Randolph-Sharpe, second by Councilwoman Sinon that Resolution 2021:84 be adopted as read. Voice vote was unanimous in the affirmative. Motion carried. Motion was made by President Randolph-Sharpe, second by Councilwoman Sinon to go out of executive session. Voice vote was unanimous in the affirmative. Motion carried. Motion was made by Councilman Strippoli, second by President Randolph-Sharpe that the Council Meeting and Executive Session for February 10, 2021 be adopted as presented. Motion was made by Councilwoman Sinon, second by Councilman DiDomenico that the Council Meeting for February 24, 2021 be adopted as presented. Roll call vote was unanimous in the affirmative. Treasurer’s Report $ 4,722.53 First Reading of Ordinance 2021-03 Stormwater by title only Motion was made by President Randolph-Sharpe, second by Councilman Strippoli that Ordinance 2021-03 be adopted on first reading, published according to law, with second reading being held at next regular scheduled meeting. First Reading Ordinance 2021-04 Adding Chapter entitled Smoking and Vaping by title only Motion was made by President Randolph-Sharpe, second by Councilman Strippoli that Ordinance 2021-4 be adopted on first reading, published according to law, with second reading being held at next regular scheduled meeting. Roll call vote was unanimous in the affirmative. Motion carried. Ordinance Amending The Code Of The Borough Of Lindenwold To Establish A Chapter, Entitled “Smoking And Vaping On Public Property” WHEREAS, the Borough of Lindenwold (the “Borough”) is a municipal corporation organized and operating under the laws of the State of New Jersey; and WHEREAS, the laws of the State of New Jersey prohibit the use of tobacco in all public schools, public school grounds, and public buildings, recognizing the dangers of the use of tobacco including second hand smoke; and WHEREAS, New Jersey has recently adopted legislation to legalize the recreational use of cannabis within the State; and WHEREAS, the Governing Body of the Borough has determined that it would be appropriate to establish similar policies and procedures for the use of Borough-owned buildings with respect to the “smoking” and/or “vaping” of cannabis/marijuana or any other substance; and WHEREAS, pursuant to N.J.S.A. 40:48-2, the Governing Body is authorized to enact and amend ordinances as deemed necessary for the preservation of the public health, safety and welfare and as may be necessary to carry into effect the powers and duties conferred and imposed upon the Township by law; and NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough of Lindenwold that the Code of the Borough of Lindenwold is hereby amended, revised and/or supplemented as follows: SECTION 1. The Code of the Borough of Lindenwold is hereby amended, revised, and supplemented to establish a Chapter, entitled “Smoking and Vaping on Public Property”, which shall provide as follows: Smoking and Vaping on Public Property Definitions Whenever used in this Ordinance, the following words shall have the following meanings: A. “Smoking” means the burning of, inhaling from, exhaling the smoke from, or the possession of a lighted cigar, cigarette, cigarillo or pipe or any other matter or substances which contains tobacco, cannabis/marijuana, or any other substance. B. “Electronic Smoking Device” means a device that can be used to deliver nicotine, cannabis/marijuana, or any other substance to the person inhaling the device, including, but not limited to, an electronic cigarette, cigar, cigarillo or pipe. C. “Vaping” means the burning of, inhaling from, exhaling the smoke from an Electronic Smoking Device. COUNCIL BUSINESS MEETING March 10, 2021 Page | 2 Prohibited Activity A. No person shall engage in Smoking or Vaping on any property owned or controlled by the Borough of Lindenwold. B. No person shall engage in Smoking or Vaping in any public park, ballfield, playground, courts, trails, or grounds, including sidewalks immediately adjacent to said property. C. No person shall engage in Smoking or Vaping on or in any public, elementary school or school property, regardless of whether the area is an indoor public place or outdoor public place, including sidewalks immediately adjacent to said property D. No person shall engage in Smoking or Vaping in any public building or facility in the Borough of Lindenwold. Penalties Any person(s) assessed for violations of this chapter shall be in accordance with Chapter I, Section 1-1 of this code book. SECTION 2. Except as set forth in Section 1 above, the balance of the Code of the Borough of Lindenwold shall not be affected by this Ordinance. SECTION 3. All Ordinances contrary to the provisions of this Ordinance are hereby repealed to the extent that they are inconsistent herewith. SECTION 4. If the provisions of any section, subsection, paragraph, subdivision, or clause of this Ordinance shall be judged invalid by a court of competent jurisdiction, such order of judgment shall not affect or invalidate the remainder of any section, subsection, paragraph, subdivision, or clause of this Ordinance. SECTION 5. This Ordinance shall take effect immediately upon posting, publication, and final passage in the manner prescribed by law. CONSENT AGENDA: The items listed below are considered routine by the Borough of Lindenwold and will be enacted by one motion. There will be no formal discussion of these items. If discussion is desired, this item will be removed from the Consent Agenda and will be considered separately. Resolution 2021:85-86 Motion was made by President Randolph-Sharpe, second by Councilman Strippoli that Resolution 2021:85 to Resolution 2021:86 be adopted as read. RESOLUTION 2021:85 Authorizing Application For Program Year 2021 Community Development Block Grant, Borough of Lindenwold, County of Camden, State of New Jersey WHEREAS, the Camden County Improvement Authority provides funding for certain infrastructure improvements or services under Community Development Block Grant Funding; and WHEREAS, the Governing Body has chosen to submit an application for Program Year 2021; and WHEREAS, the Governing Body has agreed to apply for funding for the following project: Repaving of Linden Town (Phase 2) including Elm Avenue, Holland Street, Myrtle Court and Myrtle Avenue NOW, THEREFORE, BE IT RESOLVED, by the Governing Body of the Borough of Lindenwold, County of Camden, State of New Jersey that the Mayor is hereby authorized to execute the Project Description Form for Program Year 2021 along with the Community Development Grant Agreement.11. Open to Council RESOLUTION 2021:86 AUTHORIZING CAMDEN COUNTY MUTUAL AID AND ASSISTANCE AGREEMENT BETWEEN PARTICIPATING UNITS AUTHORIZING MEMBERSHIP IN A MUTUAL AID AND ASSISTANCE AGREEMENT WITH PARTICIPATING UNITS. WHEREAS, mutual aid and assistance agreements between municipalities, counties, law enforcement agencies police, Emergency Medical Service, fire departments, fire companies or EMS organizations and fire departments situated in fire districts operated by a Board of Fire Commissioners, are permitted pursuant to N.J.S.A. 40A: 14 -26 and 40A: 14- 156.1; and WHEREAS, the President in Homeland Security Directive (HSPD) - 5, directed the Secretary of the Department of Homeland Security to develop and administer a National Incident Management System (NIMS), which would provide a consistent nationwide approach to Federal, State, local and tribal governments to work together more effectively and efficiently to prevent, prepare for, respond to and recover from domestic incidents, regardless of cause, size or complexity; and WHEREAS, "The New Jersey Civilian Defense and Disaster Control Act" App.A9 -33 et. seq, provides for the health, safety and welfare of the people of the State of New Jersey during any emergency by centralizing control of all civilian activities having to do with such emergency giving the Governor control over the resources of each and every political subdivision to cope with any condition that shall arise out of such emergency, and WHEREAS, The Director of the Division of Fire Safety in the Department of Community Affairs promulgated rules in accordance with the "Fire Service Resource Emergency Deployment Act," NJ.A.C. 52:14E-11 et. seq., commonly referred to as the "Fire Service Resource Emergency Deployment Regulations" NJ.A.C. 5:75A et. seq, and WHEREAS, it is deemed to be in the best interests of the residents of this municipality and/or fire district to enter into a mutual aid and assistance agreement with the County of Camden and other municipalities including (but not limited to) municipal police, Emergency Medical Service or fire departments, volunteer fire companies or EMS organizations and/or fire districts to provide additional protection against loss, damage or destruction by fire, catastrophe, civil unrest, major emergency or other extraordinary devastation damage or destruction to person and property, in those situations when outside aid and assistance is needed. NOW, THEREFORE, BE IT RESOLVED, by the Borough of Lindenwold of the County of Camden, and State of New Jersey as follows: A. That the Borough of Lindenwold is hereby authorized and directed to enter into the Camden County Mutual Aid and Assistance Agreement Between Participating Units, a copy of which is attached hereto and made part hereof, on the terms and conditions contained herein. COUNCIL BUSINESS MEETING March 10, 2021 Page | 3 B. That the Borough of Lindenwold is hereby authorized and directed to forthwith forward a copy of this Resolution and an executed copy of Schedule A of the agreement to the offices of the Camden County Office of Emergency Management for review and filing by the appropriate Fire, EMS and County Prosecutor or his designee as appropriate. Engineer’s Report was presented by Anthony Chadwell of Remington and Vernick. There are two projects in the design phase, Repaving Linden Town Phase 2 and Lindenwold Sewer Chemicals. He provided an update that three grants have been applied for. Mayor Roach advised the Engineer regarding the status of the school in relation to the Traffic Signal Project that was completed but school has not been in session. Mayor Roach opened the meeting to Council. Councilman DiDomenico will present the police report at the next meeting. Councilwoman Hess had nothing to report. President Randolph-Sharpe extended a welcome to the new school superintendent, Dr. Kristin O’Neil. Councilman Jackson informed the residents regarding the Park and Recreation Board. Members of the Board are representatives of Lindenwold organizations. Councilman Strippoli presented the report for Public Works including 627 tons of trash collected and 86 tons of recycling. For the Sewer Department, there were a total of 93 calls. Councilwoman Sinon reminded the residents to remember to register their cats and dogs by March 31. The application is available on the Borough website. Camden County has discontinued Saturday hours for COVID testing. She also announced the different places to obtain their COVID vaccinations. She provided the CDC guidelines that remain in effect and apply to those who have been vaccinated in order to stop the spread of this disease. Mayor Roach publicly thanked Councilwoman Sinon for all the information that she has provided during this pandemic. He asked to remember the family of Lt. Murphy who recently passed. There are a total of 1,771 cases with 21 deaths. He thanked everyone for following the guidelines. Mayor Roach opened the meeting to the Public. Diane Veteri, resident, asked about the sign at Lake Worth Village. Mayor responded that Lindenwold did not play a role in this redevelopment. Trevor Shaw, resident, questioned about the repair at the library and if pictures were available. Mayor is not aware that photos were taken. He asked when Ordinance 3 and 4 will be available to the public. Mayor responded that ordinances will be available before the second reading. He requested more information and drawings regarding the grant for the dog park. Mayor Roach responded that he would ask the Environmental Commission. Resident continued to ask about the parks with responses from the Mayor. Danielle Brittain, resident, thanked Mayor and Council for following up on the matter regarding South Jersey Gas. She asked about Lindenwold rescheduling the yard sale which had been canceled. Mayor responded that he was waiting on additional guidelines from the Governor. Resident also asked about the town sponsoring a welcome basket for new neighbors. President Randolph-Sharpe responded that there is a delay between the time that the County processes the sale and when the Borough receives the information. She explained that it was something that has been discussed. There being no one else desiring the floor, the Mayor closed the meeting to the public.
