The regular meeting of the Lisbon Public Works & Utility Committee was held on Wednesday, October 18,
2023, at the Lisbon Village Hall, W234 N8676 Woodside Road, Lisbon, WI.
Committee Chairman Marc Moonen called the meeting to order at 5:00 p.m.
Roll Call: Present: Trustee Marc Moonen (Chair); Trustee Linda Beal (Vice-Chair); Committee members
Jane Mueller and Dan Plese; Utility District Accountant Mike Sargent (via Zoom); Village Engineer Don
Neitzel; DPW Director Joe DeStefano; Administrator Kathy Nickolaus; and Clerk Elisa Cappozzo Katch to
record the minutes. Committee member Joe Eberle was absent and excused.
The Committee and members of the public recited the Pledge of Allegiance.
Citizen Comments:
Anne Rodig, W255N9274 Tomahawk Drive: I think that many people thought when the speed limit on
Hillside was lowered to 35mph that is was temporary due to construction of the roundabout, but apparently
it wasn’t. I feel that 45mph was a reasonable and safe speed limit. This is a rural road with nothing but
cornfields and trees. 45mph is a speed that allows you to make it up the hill on a snowy day. I’ve seen a
lot of people trying to go up slower and they just can’t do it. People tend to drive a speed they feel is
reasonable for the area and the road, whether that’s the posted limit or not. Making it a speed limit that
people feel is reasonable makes the area safer because you don’t have some going 35 and others going
45, which could lead to accidents. I respectfully request that you reconsider that decision and raise it back
to 45mph.
Todd Hesselberg, W256N9285 Tomahawk Drive: We’ve enjoyed the speed limit on Hillside at 45mph the
way it has been. Here we are with another construction project for the roundabout. Those in charge of
construction of the roundabout never recommended or suggested that speed limit should be lowered from
45mph to 35 mph south of Norwauk. They just needed the 35 to approach the roundabout with no other
changes. I’d recommend that the speed remain the same at 45mph because it’s been that way for years
and was working fine.
Lucy Hesselberg, W256N9285 Tomahawk Drive: When they dropped the speed limit down to 35, there
were probably 100 people that all got speeding tickets at the bottom of that hill. You can’t be at the top
of that hill at 35 and still be at 35 at the bottom without standing on your brakes. Not cool with our
Wisconsin winters. If you need more funding, find it some other way. I request that you put the speed
limit back up to 45mph.
Mike Sopko, N66W27095 Tamnamore Drive: I’m here to speak on the amount and pace of traffic through
Ironwood West. A speed study was conducted in February of this year that concluded the average rate of
speed at 32mph within 40 yards of a stop sign. This clearly finds that traffic is going significantly faster
than they should be and putting the residents of this community in danger. With a number of bus stops
here, we’re asking for help either rerouting traffic or slowing down traffic on Batterjohn Drive.
Brad Harris, W272N6707 Batterjohn Drive: I’ve personally witnessed a lot of the same things that Michael
just stated. We see numerous cars every single day that completely ignore and blow through both stop

signs on Batterjohn. Mike’s wife, Danielle, witnessed it two days ago during school pickup. It’s frustrating
seeing these kids endangered by people driving recklessly, and we’re asking for assistance to resolve this.
Chad Richeson, N66W27180 Tamnamore Drive: I’d echo everything that’s been said. I’m on a corner lot
where the bus stop is. My wife has almost been run over with my children twice. We’re respectfully
requesting that we do something about it before we have a disaster with the speeding and disregarding
stop signs.
Danielle Sopko, N66W27095 Tamnamore Drive: We’re further up the street, so we don’t see it every day
except when I walk the kids to the bus. There’s cars that just completely blow past, even when busses
have their stop signs out. It’s really concerning, and I think people are using Batterjohn as a cut-through
instead of using Lake Five. We’d just like some measures put into place to keep our children safe.
Kenneth Rodig, W255N9274 Tomahawk Drive: I want to speak in defense of rasing the speed limit on
Hillside back to 45mph. In over 40 years as a resident, I have yet to witness any kind of accidents on that
stretch of road. I could understand if there were additional subdivisions going in that added more
driveways, but nothing has changed. I don’t see any reason why it had to be changed or what the
reasoning was. 45mph is a reasonable speed for that kind of rural road.
Tom Olson, N66W27209 Tamnamore Drive: We are also a corner lot. Our kids aren’t at the bus stop yet,
but we watch what’s going on at the bus stop because it’s outside our front door. It’s a gathering ground
for all our neighborhood children. I’d respectfully ask that some kind of safety measures be put in place
throughout this neighborhood.
Raymond Radke, W251N9188 Crestwood Drive: 35mph on Hillside Road is not sufficient to make it up the
hill during winter. I don’t know what sparked the lower speed limit, and it should be brought back up to
45mph because it was already safe enough.
Mary Koch, W256N9236 Tomahawk Drive: When the speed limit on Hillside was 45mph it was okay. With
a smaller car, you really have to gun it to get up that hill at 35mph. I’m going to drive safely no matter
the speed limit, but 45mph is reasonable and it should be reinstated.
Henry Koch, W256N9236 Tomahawk Drive: Like many others have said tonight, Hillside Road is safe to
travel at 45mph. I’ve tried that hill at 35mph, and you’re constantly braking down. I haven’t seen accidents,
and I don’t see any reason for changing it. I’d respectfully ask again that you reconsider and set it back
to 45mph.
Erik Mayer, W273N6719 Ardeevin Court: I live a bit further down in Ironwood West than some of the other
folks that have spoken, but I can attest to the same kind of reckless driving. My home office overlooks the
street and stop sign, so I sit there all day long and watch people run through. There have recently been
additional patrols, but by the time they are able to identify someone that car is already out of the
neighborhood. I’d just like a solution to be found to divert traffic or slow traffic down on Batterjohn.
Janis Sgarlata, W256N9256 Tomahawk Drive: I’m a relatively new resident to the area, but I’ve lived in
rural areas before. I don’t understand why Hillside went from 45mph to 35mph. I fully support all of the
comments from the people who have spoken before me tonight on requesting the speed limit be raised
back to 45mph.

Motion by Mueller, second by Beal, to approve the minutes of the September 20, 2023 Public Works &
Utility Committee meeting as presented. Motion carried.
Department Reports
A. Dept. of Public Works
DPW Director Joe DeStefano gave a brief update on current DPW projects and accomplishments (see
attached). No action was taken.
B. Utility District
Utility Administrator Mike Sargent reported on August and September flows for the Utility District.
New Business
A. Request for traffic controls within Barnwood Conservancy subdivision
Motion by Mueller, second by Beal, to table the matter. The motion was voted on, and carried
unanimously.
B. Request for traffic controls within Ironwood West subdivision
Motion by Moonen to install three 3-way stop signs at uncontrolled intersections along Batterjohn
Drive, direct staff to contact school district and/or bus company to reevaluate bus stop locations, DPW
to evaluate options for speed bump options, and direct staff to explore the possibility of a road split
via cul-de-sac or other type of permanent traffic control. The motion was seconded by Mueller, was
voted on, and carried unanimously.
C. Request for reduction of speed limit on Lake Five and Center Oak Roads
No action was taken.
D. Request to return speed limit on Hillside Road to 45mph
Motion by Plese to recommend Village Board raise speed limit on Hillside Road back to 45mph from
the Rod & Gun Club to 1020 feet south of County Line Road. The motion was seconded by Beal, was
voted on, and carried unanimously.

Engineer Don Neitzel gave a brief update of current Utility District projects and accomplishments (see

Unfinished Business
A. Discussion and necessary action re: future water/sewer service to Circlecrest Park subdivision
Motion by Moonen to forward the tentative timeline as revised to Village Board for approval. The
motion was seconded by Beal, was voted on, and carried unanimously.
B. Discussion only re: preliminary draft updates to Sewer Code Ch. 18.05 – 18.08
Preliminary updates to Chapter 18, sections 18.05 through 18.08 were reviewed. No action taken.
New Business (cont’d.)
E. Request for approval of RESOLUTION 2023-07 re: Utility Fund Balance
Motion by Mueller to recommend Village Board approval of Resolution 2023-07 subject to attorney
review. The motion was seconded by Moonen, was voted on, and carried unanimously.

Staff was directed to prepare a request for direction to the Village Board regarding a village-wide

Report
Highway Division
• Staff completed the second round of roadside mowing.
• Staff prepped and hosted the Electronic and Appliance Recycling Event with the Tire Round
Up on Sept 16th.
• Staff installed reflective delineators at the quiet zone RR crossing on North Lisbon Road.
• Staff replaced culverts on Howard Lane and Beacon Hills Drive.
• Staff completed the interior build-out of the Compost Shed.
• Staff continued to maintain and pushup the Compost Site twice a week.
• Staff replaced the radiator, radiator hoses, and electrical harness on Ambulance #2652.
• Staff performed repairs and preventive maintenance on HWY and FD trucks and equipment
as needed and able.
Parks Division
• Staff cleaned bathrooms and took care of garbage as needed at all Parks.
• Staff sprayed for weeds at all Parks and Village owned lands.
• Staff continued mowing operations.
• Staff have been cleaning shelters as needed after rentals were completed.
• Staff prepped for the Lisbon Oaks Basketball Court Grand Opening.
• Staff had the hydrant for the ice rink replaced.
• Staff planted a memorial tree and plaque.
• Staff performed repairs and preventive maintenance on Parks trucks and equipment as
needed.
DPW Director
• I attended the WCPWA Meeting/Trade Show on Sept. 13th.
• I attended the Public Works and Utility Committee Meeting on September 20th.
• I met with the Salt Shed contractor to create a punch list and met with Recycling Depot
to prep for the recycling event on September 16th.
• I completed the interior build-out of the Compost Shed with the help of staff .
• I continued to work on the proposed Operating Budget for Hwy, Parks, Compost and
Storm Water for 2024.
• I continued my Weed Commissioner duties by checking on complaints and sending
letters as needed.
• I continued to take care of invoices, r/w permits, capital projects, all clerical tasks
needed and helped around the shop or in the field as needed.

Highway Division
• Staff started the second round of roadside mowing.
• Staff replaced the double culverts at the far north end of the Plainview Parkway.
• Staff performed the restoration work around the new basketball court that was installed at
Lisbon Oaks Park.
• Staff watered all storm water projects as needed.
• Staff performed misc. ditch cleaning in various areas.
• Staff continued to maintain and pushup the Compost Site twice a week.
• Staff performed repairs and preventive maintenance on HWY and FD trucks and equipment
as needed and able.
Parks Division
• Staff cleaned bathrooms and took care of garbage as needed at all Parks.
• Staff mulched at various parks.
• Staff have spent a considerable amount of time on weed maintenance.
• Staff have been cleaning shelters as needed after rentals were completed.
• Staff installed the freshly painted volleyball net posts at Lisbon Oaks Park. The court was
moved to accommodate the basketball court.
• Staff had the plants installed by Johnson’s Nursery for the Greiten Memorial and staff
watered as needed.
• Staff performed repairs and preventive maintenance on Parks trucks and equipment as
needed.
DPW Director
• I attended the Public Works and Utility Committee Meeting on August 16th.
• I have been spending a little more time with the Parks Division attending to concerns
that have been brought to our attention.
• I started to work in the shed at the new Compost Site. We installed the exterior lighting,
and have eliminated the need for the light tower at the site.
• I worked on and submitted a proposed Operating Budget for Hwy and Parks.
• I continued my Weed Commissioner duties by checking on complaints and sending
letters as needed.
• I continued to take care of invoices, r/w permits, capital projects, all clerical tasks
needed and helped around the shop or in the field as needed.

To: Village of Lisbon Utility Committee

Re: Monthly Report
The monthly engineer’s report for the Village of Lisbon Utility Committee is as follows:
August 2023 Flows – Flows remain normal/consistent for the month of
August at each of the sites, with average flows for the month of 18 GPM for
Jeanine Lift Station, 17 GPM for Plainview, and 18 GPM for Willow Springs.
Richmond School Lift Station – Flows at Richmond School Lift Station
were also within range for the month, with an average of 0.9 hours of run time
per day per pump and 6 starts per day per pump. Per last months meeting, a
letter was drafted and sent to Richmond School on August 30th (see attached).
I did receive an email from Ed Blake with the school, on Tuesday (9/12)
regarding the letter and what needs to be done. We can discuss this more
during the meeting.
Business Park East – All work associated with this project has been
completed, including the pavement marking on Town Line Road, and the
mailbox replacement on Town Line Road. Need to confirm all punchlist
items have been completed and have final pay request submitted for
remaining retainage.
Manhole and Sewer Repairs – I spoke with Visu-Sewer and right now they
are thinking that this work will be done in the fall. Right now they are
looking at early November, but said there is a good chance that they could
complete this earlier by fitting it in between a couple of projects. They will
keep me posted.
Sewer System Maps (GIS) – Sewer maps have been updated to include the
boundary of the approved sewer service area, the drainage basins, parcels that
are active accounts, parcels that should be connected but are not, parcels that
are connected but haven’t paid, parcels that can’t hook up due to lack of sewer
availability, and those parcels with grinder pumps. Updated paper copy of
maps will be available at meeting.
Circlecrest Park Site Subdivision –Cost estimate and draft
preliminary assessments for extending sewer and water to those parcels
within Circlecrest Park Subdivision has been updated (see attached).

Re: Monthly Report
The monthly engineer’s report for the Village of Lisbon Utility Committee is as follows:
• September 2023 Flows – Flows remain normal/consistent for the month of
September at each of the sites, with average flows for the month of 18 GPM
for Jeanine Lift Station, 17 GPM for Plainview, and 20 GPM for Willow
Springs.
• Richmond School Lift Station – Flows at Richmond School Lift Station
were up from the month of August, with an average of 1.5 hours of run time
per day per pump and 12 starts per day per pump. The average run time is in
line with what was recorded during the month of September in 2022, however
the average number of starts are up by about 50%. Will discuss during
meeting.
Richmond School had a plumber on-site on Friday (10/6) to investigate some
sewer odors they were noticing from time to time in the building. The
plumber was also supposed to televise the sewer system, but forgot that
camera. This work will be rescheduled, along with inspection/mapping of the
roof drain system as well.
• Business Park East – All work associated with this project has been
completed, including the pavement marking on Town Line Road, and the
mailbox replacement on Town Line Road. Need to confirm all punchlist
items have been completed and have final pay request submitted for
remaining retainage.
• Manhole and Sewer Repairs – I left a message with the project manager
from Visu-Sewer, looking to confirm a date for the work to be completed in
November. I hope to have an update for the meeting next week.
• Sewer System Maps (GIS) –Sewer maps were updated following last
meeting, to include all know grinder pump locations based upon the list
provided by Joe DeStefano. While comparing this list against the list that was
in the Utility Committee meeting packets for September, we noted two
addresses that were not on Joe’s list and they were highlighted in green on
the list in the packets. Those addresses are as follows:
W220 N7432 Cherry Hill Road is a single-family home that sits on the
same parcel as W220 N7438 Cherry Hill Road which is a duplex. Joe
found that back in the early 2000’s the sewer for the single-family
home was separated from the duplex, which was all served by a grinder
station. The single family is now on its own gravity lateral.
W220 N8023 Townline Road. According to County GIS records, this
address does not exist.
• Circlecrest Park Site Subdivision – A preliminary schedule for public
information meetings, soil borings, and initial fieldwork for design of
project was discussed with Village Administrator.

Request for Proposals for Geotechnical Exploration Services for the Village
of Lisbon, Wisconsin
Proposals are being accepted for geotechnical exploration services in the Village of
Lisbon, Wisconsin. Said proposals shall be received at the office of Kunkel Engineering
Group (Village Engineers) at 107 Parallel Street, Beaver Dam, WI 53916, by October 31st,
2023 at 2:00pm. All inquiries can be sent to Don Neitzel at
Dneitzel@kunkelengineering.com. PDF copies of proposals sent by email will also be
accepted.
PROJECT DESCRIPTION
The proposed project is planning to consist of the construction of new sanitary sewer,
water mains and road reconstruction within the Circle Crest subdivision and a small
portion of Silver Spring Drive. There is to be approximately 4,400 linear feet of new
sanitary sewer and 4,400 linear feet of new water main. The new sanitary and water
mains will extend down Lynwood drive approximately 1,600 linear feet, from Silver
Spring drive to the lift station at the end of Lynwood Drive. The Sanitary and water
will also extend along Avon Drive, approximately 550 linear feet northeast of the
intersection of Avon Drive and Lynwood Drive. It will also extend approximately 600
south and west of the intersection of Avon Drive and Lynwood Drive. The last section
of sanitary and water mains will start at Templeton Middle School, extending northwest
along Silver Springs Drive for approximately 1,600 liner feet.
SCOPE OF WORK:
The Geotechnical engineering scope of services will include the following items:
• Field exploration consisting of drilling and sampling at 12 boring locations
(marked on the accompanying map). The drilling depth will to 25 feet or until
refusal. The borings on Silver Spring Drive will occur within the right-of-way.
The borings on Lynwood Drive and Avon Drive will occur in the middle of the
street.
• Preforming engineering analysis and provide boring logs and recommendations
in written report format.
• Limited laboratory testing of the subsurface materials.

TARGET DATES:
Kunkel Engineering is looking for the boring work to occur around November 20th to
November 30th, weather permitting. Once the work is completed, we expect it to take
some time to be able to analyze and produce a written report. We were hoping that
boring logs could be provided by around December 8th and a written report by the end
of December.

Good morning and thanks for your time on Monday.
After our discussion, I wanted to make this request on behalf of the Barnwood Conservancy
Homeowners’ Association for your review.
We would like to have painted crosswalks installed at the locations where the internal walking
paths cross Wrens Way and connect to each side of the road.
We would like one of the following options to occur:
A. For the Village of Lisbon to install them with its professional staff.
B. For the Village of Lisbon to install then with its professional staff, inform our HOA
Board of the cost to install and request payment in advance from the HOA.
C. For the Village of Lisbon to allow the Barnwood Conservancy HOA to install the
crosswalks with its own labor and at its own cost.
I would hope you might be able to come to a decision after consulting your Village committee
in the coming days. We meet as an HOA at 9:30 a.m. Sunday, Oct. 22. I would like to share
any progress we make at that time.

Hello - thank you for your time and attention on the issue of children and families being in danger on
Batterjohn Drive between MD and VV. The issue being, Batterjohn Drive is being used as a cut through.
There are currently 8 homes and 2 school bus stops on Batterjohn Drive along with 26 homes that use
Batterjohn Drive to access their homes.
From Feb 1st to Feb 19th of 2023 a Lisbon Speed Study was conducted on Batterjohn Drive and the
results clearly define a need for help. In 19 days there were 4639 cars that passed through (245 cars/day)
at an average rate of speed of 32 MPH. For every car that was traveling the speed limit, another car was
going 39 mph. The speed study was conducted roughly 40 yards from a stop sign and school bus pickup.
Cars traveling at that rate of speed, that distance to a stop sign do not have the ability to slow down and
stop in time.
The Ironwood West Community is asking for help to keep residents safe by reducing and slowing down
traffic. We are open to all ideas, but have a few ideas to try and address this public safety issue:
• 1 or 2 Temporary Speed bumps
• “Residential Traffic Only” or “No Thru Street” Signs
• Crosswalks at the bus stops with “State Law Stop for Pedestrian Within Crosswalk” sign in street.

Maybe you are already aware. There was a fatal accident on Lake Five road at the entrance to twin pines
farm. It was a van with three contractors who were working on a house in the subdivision. So tragic. I
don’t want to take advantage of this awful tragedy but for the safety of the twin pines residents, children
and guests and all other drivers on Lake Five Road and Center Oak Drive, I humbly request that the Village
of Lisbon consider lowering the speed limits to 35 mph north of Plainview for both roads. Lake Five Road
is 35mph south of Plainview. It would be safer to have the speed limit consistent across Lake Five Road at
least where there are residential areas. Center Oak has the same issues. We have speeding, massive
amounts of motorcycles and semi trucks on the road. They rev up their engines as the make the turn. It’s
noise pollution and a safety issue for the residents turning out of the subdivision. My friend had a near
accident at Center Oak and Plainview. The driver going west on Plainview did not stop. People expect a
four way stop sign there. Also it’s a hazard area as the corn field blocks visibility.
I hope something can be done. I don’t want to see another loss of life. This is so devastating for the family
of the deceased and the injured passengers.

Subject: Speed limit/traffic on Center Oak
I left a voicemail for Kathy but thought I would document my concerns via email as it is much easier than
trying to include all of this in a voicemail.
We recently moved to the latest addition of Twin Pines subdivision. We are located on Hunter Court. The
back of our house faces Center Oak. I have questions/concerns regarding the traffic on Center Oak.
My observations:
1. The speed limit is currently 45mph. However, it appears that most of the cars drive at 55 mph to
60 mph on this road.
2. There is a significant amount of traffic on this road. Not sure if this is related to Highway 83 being
closed for construction or if this is normal. We bought the Aspen model house and had been out
several times at the house before we placed an offer but unfortunately did not see the high
volume of traffic when visiting the house.
3. There are numerous large/noisy dump truck type trucks traveling the road all day long. Also other
large commercial trucks.
4. Several of the drivers gun up the speed while traveling south on Center Oak after they pass
through the curve. Many of these cars have loud mufflers.
5. It doesn't appear that drivers reduce speed to 35 mph while driving north and approaching the
curve on Center Oak.
6. There is only a two way stop sign at Center Oak and Plainview. I personally experienced an
accident at that corner. I have been told by residents that people expect a 4-way stop sign since
there is one at Plainview and Lake Five Road.
7. The speed limit on Lake Five Road is 35 mph. It appears the traffic load on Center Oak vs Lake
Five Road is very similar or higher than Lake Five Road.
8. There are new homes on Center Oak with children, dogs, etc. School buses pick up kids on Center
Oak. Not sure, but I heard that the farm on the corner of Plainview and Center Oak is sold. I
expect that there will be more residential development in this area.
My requests/suggestions:
1. Short term, can we get speed patrol in place?
2. Can there be a traffic study conducted?
3. Can a four-way stop sign be installed at the corner of Center Oak and Plainview?
4. How do I submit a request to have the speed limit lowered? I believe this is a good solution and
will definitely help to ensure the safety of the children and residents. I could also help to reduce
the noise pollution from the traffic.
5. Is there any way to divert traffic to a less residential road for traffic that would normally use
Highway 83?
6. Are there truck weight limits on Center Oak? If not, is this something that could be
considered? As mentioned, there is quite a lot of truck traffic, many of which are extremely large
and noisy trucks.
7. Could the village add additional buffering by planting trees/shrubs for the areas in which there
are residences located?
As new residents, we've had a very positive experience with the Village of Lisbon. I am impressed with
the services, the welcome packet we received and your very informative and well organized website. We
are happy to be in the country setting and look forward to a quiet, peaceful experience. I hope that there
is something that can be one to help alleviate the concerns I highlighted. Thank you for your

RESOLUTION 2023-07
A RESOLUTION TO ESTABLISH A POLICY FOR MANAGING A FUND BALANCE IN THE
LISBON UTILITY FUND IN THE VILLAGE OF LISBON
WHEREAS, following the incorporation of the Village of Lisbon a Utility District was created to replace
the Town Sanitary District. The Village Board of the Village of Lisbon determined there was a need to
establish a policy on managing a fund balance in the Lisbon Utility Fund; and
NOW THEREFORE, the Village Board of the Village of Lisbon does hereby create and establish the
following policy and procedures for the payment, deferment, and interest on special assessment of
streets, roads, water, sewer, and related improvements within the Village.
Policy for Managing a Fund Balance
In The Lisbon Utility Fund
Purpose
The objective of this policy is to preserve the Lisbon Utility Fund credit worthiness, provide
working capital to meet the Utility cash flow needs during the year and a comfortable margin to
address emergencies.
Basic Policy
1. As of December 31st of each year, maintain an unassigned balance in the Utility Fund of
at least twenty-five percent (25%), but not more than forty percent (40%) of the ensuing
year’s budgeted expenditures.
2. As part of the annual audit any unrestricted funds over the 40% will become restricted
for equipment replacement. In the subsequent year after the completion of the audit, or
if such transfer is not appropriate due to the existing equipment replacement needs, in
the Village Boards’ discretion, such excess shall be applied to the ensuing budgetary
expenses and the utility rate shall be reduced accordingly.
3. Withdrawal of any amount of unassigned Utility fund balance in excess of the targeted
minimum balance mentioned above, may be made by 2/3 vote of the Village Board. Any
such action must also provide for a plan to restore the unassigned minimum balance
within a three-year period.
4. Withdrawal of any amount of unassigned utility fund balance for purposes that are not
contemplated in the then-current budget shall require a 2/3 vote of the Village Board in
accordance with Wisconsin Statutes Section 65.90.

A RESOLUTION TO ESTABLISH A POLICY FOR THE SPECIAL ASSESSMENT, PAYMENT,
DEFERMENT, AND INTEREST IN THE VILLAGE OF LISBON
WHEREAS, following the incorporation of the Village of Lisbon a Utility District was created to replace the
Town Sanitary District. The Village Board of the Village of Lisbon determined there was a need to establish a
policy on the payment, deferment, and interest on the special assessment of streets, roads, water, sewer,
and related improvements; and
NOW THEREFORE, the Village Board of the Village of Lisbon does hereby create and establish the following
policy and procedures for the payment, deferment, and interest on special assessment of streets, roads,
water, sewer, and related improvements within the Village.
1. ASSESSMENTS DUE
The Village of Lisbon determines when assessments are due for each project by a resolution levying the
assessments. The intent of this policy is to make this consistent for all future assessments.
1) Assessments are due at the following events:
a) Time of Sale of Property
i) Transfer of property to an immediate family member (daughter, son, husband, wife, sister,
brother, mother, father), Trust of the current owner, Estate of the current owner, or
refinancing does not constitute a sale of the property.
b) Prior to signature of CSM, Plat, or other land division approval
c) Prior to signature of re-zoning approval
d) Time of connection to water/sewer
e) By October 31st of the year of the final resolution of the road assessment.1
2. DEFERRED ASSESSMENTS
The Village of Lisbon defers assessments against large undeveloped parcels or lots with a potential of
future development per the Assessment Policies. The deferments are units that do not currently exist but
will likely at some point in the future. This policy will clarify the deferments related to interest,
determination of final assessment, when payment is due, and when they become active.
1) Do not accrue interest.
2) Final Assessments will be determined at the:
a) Time of Connection to water/sewer.
b) Time of presentation of a preliminary or final CSM, preliminary of final Plat, or other land division
approval.
c) If the use of the property, without a land division, has changed resulting in more units
(water/sewer) being utilized.
3) If property is sold as is (no land division or change in use), only the main assessment is due. The
deferred assessment remains a deferred assessment against the property until 1 or 2 above occur.
4) When deferred assessments become active, the assessment rate is the original rate per the Engineer’s
Report (ie. No interest or inflation added).
3. ASSESSMENT PAYMENT
1) Sewer
a) Payments due by October 31st 1 of the year of the final assessment resolution or they will be added
to the annual tax bill in 10 annual payments.

If October 31st is a Saturday, Sunday or other non-working day, the due date will be the Monday after October 31 st.
b) May defer payment 5 years with annual compounding interest (annual interest becomes part of
principal if not paid by October 31st 1)
c) Payments may be made over 10 years with annual simple interest on the unpaid balance.
d) May be paid in full at any time without penalty.
2) Water
a) Payments due by October 31st 1 of the year of the final assessment resolution or they will be added
to the annual tax bill in 10 annual payments.
b) May defer payments 5 years with annual compounding interest (annual interest becomes part of
principal if not paid by October 31st 1)
c) Payments may be made over 10 years with annual simple interest on the unpaid balance.
d) May be paid in full at any time without penalty.
3) Road
a) Payments due by October 31st 1 of the year of the final assessment resolution or they will be added

b) Payments may be made over 10 years with annual simple interest on unpaid balance.
c) May be paid in full at any time without penalty.
4) Early Payments
a) The Village will only accept payment of the assessment once the Final Resolution of the
Assessment has been passed. The assessment remains with the property. If a property wants to
pay before the final resolution, they should be told to pursue opening an escrow account between
the two private parties, a separate savings account, or other means so payment can be made at
the time of the final resolution.
4. INTEREST
1) 1% over the rate borrowed at for the project, if applicable, or the most recent borrowing for the
Village.
2) Annual Simple Interest (interest calculated once per year based upon the outstanding balance as of
November 1st 2 at the set interest rate). No daily or monthly compound interest or the proration of the
interest rate is allowed once the assessment is in the payment process.
3) Annual Compounding Interest (interest calculated once per year on the outstanding balance as of
November 1st 2 at the set interest rate which is then added to the principal of the outstanding balance
for the following year unless paid by October 31st 1) will be used only for sewer/ water assessments
in the 5-year deferral period. No daily or monthly compounding interest or the proration of the interest
rate is allowed if paid before October 31st 1 of any given year.
5. THIS POLICY UNRELATED TO OTHER ASSESSMENT POLICY
This policy is intended to be the policy for public street, sanitary sewer extension, water main extensions,
and street related improvements as enumerated herein and in no way is to be construed as a substitute
or abrogation for other improvement policies not addressed in this policy.
6. ASSESSMENT POLICY NOT EXCLUSIVE
The Village Board recognizes that unique situations may arise that may not be contemplated under this
policy. In such circumstances, the Village Board is authorized by law to levy special assessments for
streets, sanitary sewer, water main, and related improvements upon any reasonable basis.
7. SEVERABILITY
The several sections of this Resolution shall be declared to be severable. If any section shall be declared
invalid by decision of a court of competent jurisdiction, such decision shall not affect the validity of the
other provisions of this Resolution.
