VILLAGE OF LISBON Public Works & Utility Committee Minutes September 20, 2023 PUBLIC WORKS & UTILITY COMMITTEE MINUTES The regular meeting of the Lisbon Public Works & Utility Committee was held on Wednesday, September 20, 2023, at the Lisbon Village Hall, W234 N8676 Woodside Road, Lisbon, WI. Committee Chairman Marc Moonen called the meeting to order at 5:00 p.m. Roll Call: Present: Trustee Marc Moonen (Chair); Trustee Linda Beal (Vice-Chair); Committee members Jane Mueller, Joe Eberle, and Dan Plese; Utility District Accountant Mike Sargent; Village Engineer Don Neitzel; DPW Director Joe DeStefano; Administrator Kathy Nickolaus; and Clerk Elisa Cappozzo Katch to record the minutes. The Committee and members of the public recited the Pledge of Allegiance. Citizen Comment None. Minutes – 8/16/2023 Public Works & Utility Committee Motion by Beal, second by Eberle, to approve the minutes of the August 16, 2023, Public Works & Utility Committee meeting as presented. Motion carried 4:0, with Mueller abstaining. Department Reports A. Dept. of Public Works DPW Director Joe DeStefano gave a brief update on current DPW projects and accomplishments (see attached). No action was taken. B. Utility District Utility Administrator Mike Sargent reported on August flows for the Utility District. Engineer Don Neitzel gave a brief update of current Utility District projects and accomplishments (see attached). No action was taken. Unfinished Business A. Discussion and necessary action re: future water/ sewer service to Circlepark Crest subdivision Administrator Nickolaus advised that LSP has indicated they will pay for all water service infrastructure. Engineer Neitzel drafted a scope of services plan and will update cost estimates based on LSP feedback. Staff was directed to create an Assessment policy, and Engineer Neitzel was directed to get preliminary Geotech numbers, for review & consideration at the next meeting. No formal action taken. B. Discussion and necessary action regarding creation of Sewer Permit & related connection process Preliminary revisions to Sewer Permit and connection process were reviewed. No formal action taken. New Business A. Discussion and necessary action re: request for special needs road sign and village policy re: same Discussion regarding creation of sign policy. It was determined no action would be taken until a sign policy has been adopted by the Village Board. Discussion only regarding preliminary draft updates to Sewer Code Ch. 18.01-18.05(3) Preliminary updates to Chapter 18, sections .01 through .03 were reviewed. No formal action taken. C. Discussion and necessary action regarding 2024 draft budget Staff was directed to bring back a draft policy regarding Unrestricted Funds if not already adopted. No formal action taken. The meeting was adjourned at 8:20p.m. Respectfully submitted, Elisa Cappozzo Katch, WCMC Lisbon Village Clerk Office: (262)246-6100 | Email: villagehall@lisbonwi.gov | Web: www.LisbonWI.gov August 2023 DPW Monthly Report Highway Division • Staff started the second round of roadside mowing. • Staff replaced the double culverts at the far north end of the Plainview Parkway. • Staff performed the restoration work around the new basketball court that was installed at Lisbon Oaks Park. • Staff watered all storm water projects as needed. • Staff performed misc. ditch cleaning in various areas. • Staff continued to maintain and pushup the Compost Site twice a week. • Staff performed repairs and preventive maintenance on HWY and FD trucks and equipment as needed and able. Parks Division • Staff cleaned bathrooms and took care of garbage as needed at all Parks. • Staff mulched at various parks. • Staff have spent a considerable amount of time on weed maintenance. • Staff have been cleaning shelters as needed after rentals were completed. • Staff installed the freshly painted volleyball net posts at Lisbon Oaks Park. The court was moved to accommodate the basketball court. • Staff had the plants installed by Johnson’s Nursery for the Greiten Memorial and staff watered as needed. • Staff performed repairs and preventive maintenance on Parks trucks and equipment as needed. DPW Director • I attended the Public Works and Utility Committee Meeting on August 16th. • I have been spending a little more time with the Parks Division attending to concerns that have been brought to our attention. • I started to work in the shed at the new Compost Site. We installed the exterior lighting, and have eliminated the need for the light tower at the site. • I worked on and submitted a proposed Operating Budget for Hwy and Parks. • I continued my Weed Commissioner duties by checking on complaints and sending letters as needed. • I continued to take care of invoices, r/w permits, capital projects, all clerical tasks needed and helped around the shop or in the field as needed. Regards, Joe DeStefano Jr. DPW Director MEMORANDUM September 20, 2023 To: Village of Lisbon Utility Committee From: Don Neitzel Re: Monthly Report The monthly engineer’s report for the Village of Lisbon Utility Committee is as follows:  August 2023 Flows – Flows remain normal/consistent for the month of August at each of the sites, with average flows for the month of 18 GPM for Jeanine Lift Station, 17 GPM for Plainview, and 18 GPM for Willow Springs.   Richmond School Lift Station – Flows at Richmond School Lift Station were also within range for the month, with an average of 0.9 hours of run time per day per pump and 6 starts per day per pump. Per last months meeting, a letter was drafted and sent to Richmond School on August 30th (see attached). I did receive an email from Ed Blake with the school, on Tuesday (9/12) regarding the letter and what needs to be done. We can discuss this more during the meeting.  Business Park East – All work associated with this project has been completed, including the pavement marking on Town Line Road, and the mailbox replacement on Town Line Road. Need to confirm all punchlist items have been completed and have final pay request submitted for remaining retainage.  Manhole and Sewer Repairs – I spoke with Visu-Sewer and right now they are thinking that this work will be done in the fall. Right now they are looking at early November, but said there is a good chance that they could complete this earlier by fitting it in between a couple of projects. They will keep me posted.  Sewer System Maps (GIS) – Sewer maps have been updated to include the boundary of the approved sewer service area, the drainage basins, parcels that are active accounts, parcels that should be connected but are not, parcels that are connected but haven’t paid, parcels that can’t hook up due to lack of sewer availability, and those parcels with grinder pumps. Updated paper copy of maps will be available at meeting.  Circlecrest Park Site Subdivision –Cost estimate and draft preliminary assessments for extending sewer and water to those parcels within Circlecrest Park Subdivision has been updated (see attached).

Engineer’s recommendation for creation of Sewer Permit and related connection process Engineer Neitzel was directed to incorporate draft process into code form for review by the committee and to take a deeper look at Pewaukee and Sussex procedures. We did this prior to the building being painted. • Staff ditched along Indiangrass Drive to clear out a heavily silted area and regain proper flow. • Staff poured a sidewalk at Fire Station #1. The sidewalk needed to be removed for the holding tank installation. • A mastic wagon was rented for a week and staff went around the Village to correct dips and heavily cracked areas, from a list we created over the last few months. • Staff continued to maintain and pushup the Compost Site twice a week. • Staff performed repairs and preventive maintenance on HWY and FD trucks and equipment as needed. Parks Division • Staff cleaned bathrooms and took care of garbage as needed at all Parks. • Staff maintained and prepared all the baseball fields and soccer field for games. • Staff have been able to skip weekly mowing to bi-weekly due to the dry weather. • Staff have spent a considerable amount of time on weed maintenance. • Staff have been cleaning shelters as needed after rentals were completed. • Staff spread playground chips at LCP, Lisbon Oaks and Jane Stadler Parks. • Staff cleaned down trees from the late July storms. • Staff performed repairs and preventive maintenance on Parks trucks and equipment as needed. DPW Director • I attended the Public Works and Utility Committee Meeting on July 19th. • I have been spending a little more time with the Parks Division attending to concerns that have been brought to our attention. • I continued to work with the contractors for the salt shed, building maintenance and the 2023 road paving. • I have been working to get all the Parks and Hwy 2024 Capital Budget items submitted. • I continued my Weed Commissioner duties by checking on complaints and sending letters as needed. • I continued to take care of invoices, r/w permits, capital projects, all clerical tasks needed and helped around the shop or in the field as needed. We live in the Partridge Hills Subdivision on the East Side of Fox Hollow Drive. We have had more and more drivers going too fast with no cares in the last 6 months down our road and cul-de-sac. Recently there was an Amazon driver that was going at least 50 down our road and we needed to go to action quickly as Gavin was at the end of our driveway. We talked with the driver, and he did not care at all and actually raced off after as well. Normally it is a lot of turnarounds because they missed a turn to Wrendale, but we do truly think signage could at least stick out to drivers to slow down earlier. Especially delivery drivers. Our neighbor down the street also has a grandson that is autistic that does come over frequently and plays in the yard around the road too. So, it could be helpful in more than one scenario. I would suggest putting it on the corner of Wrendale and Fox Hollow since that would give some advance warning and there is signage there already for the street sign. Again, I would truly like you to consider this request. We have been here almost 11 years and we don’t plan to move any time soon. We are working on boundaries and safety, but Gavin is non-verbal and a slow processor, so things don’t come fast paced for learning. Thanks, April Sign Policies Stop Signs It is generally believed that the installation of stop signs at an intersection will result in a decrease in the number of accidents. The installation of stop signs is a very effective traffic control device when used under the right conditions. It is intended to help drivers and pedestrians determine who has the right of way. However, the installation of unwarranted stop signs can actually be a detriment to the safe operation of an intersection. Stop signs are installed in compliance with the Wisconsin Statutes and the Federal Highway Administration Manual on Uniform Traffic Control Devices. Warrants for Stop Signs o An unsignalized intersection in a signalized area. o Intersection of a less important road with a main road where application of the normal right of way rule is unduly hazardous. o Other intersections where a combination of high speed, restricted view and a serious accident record indicates a need for stop control by a stop sign. o Streets entering a through highway or street. Warrants for Multi-way Stop Signs o An accident problem, as indicated by five or more reported accidents of a type susceptible of correction by a multi-way stop installation in a 12-month period. Such accidents include right and left turn collisions as well as right- angle collisions. o Minimum traffic volumes must meet the following standards: o The combined vehicular and pedestrian volume from the minor street or highway must average at least 200 units per hour for the same eight hours, with an average delay to minor street vehicular traffic of at least 30 seconds per vehicle during the maximum hour. o The total vehicular volume entering the intersection from all approaches must average at least 500 vehicles per hour for any eight hours of an average day. o When the 85-percentile approach speed of the major street traffic exceeds 40 miles per hour, the minimum vehicular volume warrant is 70% of the above requirements. o Where traffic signals are warranted and urgently needed, the multi-way stop is an interim measure that can be installed quickly to control traffic while arrangements are being made for the signal installation. All requests for stop sign installation must be made in writing to the Kenosha County Director of Public Works and are subject to approval by the Kenosha County Highway and Parks Committee, the Kenosha County Board and the Kenosha County Executive. Signs in Highway Right of Way Wisconsin Statutes prohibit all signs except official traffic signs from being placed within the right-of-way of any street or highway. Prohibited signs include but are not limited to advertising, realty, political, rummage sale and directional. Any prohibited sign found by the Kenosha County Division of Highways will be removed and disposed of. MUNICIPALITY OF ANCHORAGE Traffic Engineering Department SIGN INSTALLATION POLICY “Special Needs Children” Signs Although not as commonly requested as “Children at Play” signs – or variations on that same message: “Slow Children at Play”, “[running child image] at Play, “Watch for Children”, etc. signs have been asked for by parents concerned about the safety of their children with vision or hearing impairments – or, children diagnosed with autism spectrum disorders. The Federally-adopted Manual on Uniform Traffic Control Devices (MUTCD) states the following about warning signs: “The purpose of a warning sign is to provide advance warning to the road user of unexpected conditions on or adjacent to the roadway that might not be readily apparent.” Section 5.01 “Introduction” Manual on Uniform Traffic Control Devices for Streets and Highways, 2009, Federal Highway Administration Signs that convey the message “Blind Child Area,” “Deaf Child” or “Autistic Child” are not recognized by the State of Alaska or the Federal Highway Administration as official traffic control devices – and are no longer installed on public streets in Anchorage. These signs have been installed in the past in a few locations in the Municipality of Anchorage; however, the signs that are installed in neighborhoods are being left in place until they are no longer serviceable (as is permitted by the MUTCD), or we become aware that the family in question has moved from the neighborhood. At that time, the signs will be removed. Public agencies across the United States have a variety of policies on these types of signs. Some agencies will do so upon request since a compelling point can be made that a motorist – in a residential neighborhood – may not be aware that a special needs child is living in the area – which meets the ‘purpose’ criteria for a warning sign, as noted above. Even those advocacy groups for individuals with these issues have mixed opinions on the use of these signs. Some even object to the notion of defining a child by their disability: “Blind Child” or “Deaf Child” – which is partly forced by the need to convey a readily-understood message that can fit on a standard-sized street sign. In addition, not only there is no quantifiable ‘standard’ of any of these impairments (a child may have very poor vision, but still be able to discern some objects, another may be able to hear some sound frequencies, but not others), but, some impairments are progressive – becoming worse, or better, with time and medical care. Lastly, there is the real issue that the families of these children may move – without notice to the public agency responsible for the installation, maintenance, and – ultimately – removal of the sign. Many of the public agencies that will install these signs require the following from the family: 1) A physician’s statement identifying the extent of the disability 2) Concurrence from the parents of their understanding that the sign will be removed when the child reaches a specified (often, 13 years) age. That may include a sworn statement of the child’s date of birth. 3) Written acknowledgement from the parents of their understanding that the sign provides no guarantee of their child’s safety – and that they remain responsible for monitoring their child’s activities. 4) A commitment to notify the public agency – in a timely manner – of any positive changes in their child’s impairments (for example, cochlear implants, use of hearing aids, etc. for children with hearing impairments). 5) A commitment to notify the public agency – in a timely manner – of any relocation to another place of residence. This requires a commitment of personal information that many parents are unwilling to provide. And, it requires close tracking from the public agency. Municipal Policy on “Special Needs Children” Signs: “Blind Child,” “Deaf Child” or other variations on signage for special needs children are not recognized by the State of Alaska or the Federal Highway Administration as official traffic control devices, and will not be installed on those streets over which the Municipal Traffic Engineer has jurisdiction. There is no evidence that the signs provide any benefit to the safety of children. There is no evidence that the signs result in any behavioral changes by drivers. Reports from the National Cooperative Highway Research Program have indicated the “Non-uniform signs….should not be permitted at any time… and the removal of any non-standard signs should carry a high priority.” In addition, nearly 80 percent of the crashes involving children resulted from an illegal or unsafe act by the child. In reality, no traffic control device could be expected to protect a child. Pediatric trauma physicians have cited the studies, and concur that children – particularly young children – should actively be discouraged from playing near, or on, streets and that adults have the primary responsibility for ensuring the safety of their children in/near their homes. 2 SIGN INSTALLATION POLICY – SPECIAL NEEDS CHILDREN | Municipality of Anchorage Even into their teens, and even without accounting for impairments, children have difficulty judging the approach speeds of oncoming vehicles. Association of Psychological Sciences, based in London, http://pss.sagepub.com/content/22/4/429.full.pdf+html, make a finding that “Our study is the first to demonstrate that the neural mechanisms for detection of looming [on-coming traffic] are not fully developed until adulthood.” Addressing the Safety of Young Children: Unnecessary signs confuse and annoy drivers and foster a disrespect for all signs. Signs used in accordance with the Federal MUTCD can and should be posted for school zones and pedestrian crossings, as well as near established playgrounds and other recreational areas, where a need exists. The Muni has an active Neighborhood Traffic Calming Program, however, to determine if motorists are driving at an inappropriate speed, or if there is a significant amount of non-local traffic using the neighborhood streets. This program can be an effective means of addressing the concerns that parents and families may have. Parents have a vital role in providing for their childrens’ safety – and may, in fact, be the most effective means of addressing safety concerns. They have the ability to teach children that it is not safe to play in/near the street, and to discourage children from doing so without adult supervision. Parents, however, should resist the temptation to purchase these signs from on-line sources, however, and install the signs in or near the public road. Under Alaska State law, it is illegal for anyone other than the Municipal Traffic Engineer to post signs – whether on public or private property – that attempt to regulate or control traffic on an abutting public roadway.
