LODI CITY COUNCIL SHIRTSLEEVE SESSION CARNEGIE FORUM, 305 WEST PINE STREET TUESDAY, JANUARY 11, 2022 A. Call to Order / Roll Call An Informal Informational Meeting ("Shirtsleeve" Session) of the Lodi City Council was held Tuesday, January 11, 2022, commencing at 7:05 a.m. Mayor Chandler attended the meeting via Zoom and had to leave the meeting at 8:00 a.m. Present: Council Member Khan, Council Member Kuehne, Council Member Nakanishi, Mayor Pro Tempore Hothi, and Mayor Chandler Absent: None Also Present: City Manager Schwabauer, City Attorney Magdich, and City Clerk Cusmir B. Topics B-1 Receive Presentation and Provide Direction Regarding Sphere of Influence and Municipal Servces Review Updates (CD) Community Development Director John Della Monica and Planner Paul Junker provided a PowerPoint presentation regarding the Sphere of Influence (SOI) and Municipal Services Review (MSR) updates. Specific topics of discussion included current SOI update process, SOI study areas, General Plan development phases, key terms, status of SOI and MSR, community meetings, West Study Area, South Study Area, East Study Area, Glick property, Highway 12 property, SOI/MSR update process, and what happens after the SOI/MSR update. Council Member Kuehne noted that this is an opportunity to create a buffer between the cities of Stockton and Lodi. Council Member Nakanishi stated that establishing the sphere of influence is long overdue and it is obvious to him that the Council should move forward. Council Member Khan spoke about the importance of managing Lodi's growth and the benefit to property owners that will have access to the City's utilities such as electric service. Mayor Chandler spoke about the work done on establishing an agricultural reserve. Council Member Kuehne elaborated on the MSR and providing services for annexed areas. Mayor Pro Tempore Hothi opened public comment. Pat Patrick, President and CEO of the Lodi Chamber of Commerce, provided public comment regarding the notices for the community meetings and suggested that Industrial be moved to Phase 1. Mr. Patrick also recommended a stop light be installed at Guild Avenue and Victor Road. Council Member Kuehne stated that he supports moving Industrial to Phase 1 and explained that the State owns the property at Guild and Victor and because CalTrans does not have a plan to install a traffic signal, the City is planning to install the signal. Council Member Kuehne also spoke about reviewing the City's development ordinances. 1 Sean Ray, a resident in the proposed SOI, provided public comment regarding the potential for property tax increases and sidewalk construction if his property is annexed into the City of Lodi. John (last name inaudible), a property owner in the proposed SOI, provided public comment stating that he is interested in his property, on Highway 12, being included in the SOI. Jay Finkelstein, a resident in the proposed SOI, provided public comment voicing his concern about well and septic maintenance and the cost of hooking up to City utilities. Ron (last name inaudible), a resident in the proposed SOI, provided public comment voicing his concern regarding requirements for hooking up to City utilities if and when the surrounding properties are developed. He also asked about solar benefits offered by the City. Community Development Director Della Monica spoke about noticing for community meetings and the delays that were experienced due to problems with mail delivery. Greg Finkelstein, a resident in the proposed SOI, spoke about the different animal species that may be impacted by an annexation. Mayor Pro Tempore Hothi closed the public comments. City Manager Schwabauer spoke about how the City may address the issues with solar customers and net metering. Council Member Nakanishi stated that he supports "grandfathering" solar customers into the City. Council Member Khan agreed. Planner Junker stated that staff may bring back discussion regarding the Highway 12 property at a later date as that would increase the SOI. C. AGENDA ITEM B-01 CITY OF LODI COUNCIL COMMUNICATION TM AGENDA TITLE: Receive Presentation and Provide Direction Regarding the Sphere of Influence and Municipal Services Review Updates MEETING DATE: January 11, 2022 PREPARED BY: Community Development Director RECOMMENDED ACTION: Receive presentation and provide direction regarding the Sphere of Influence and Municipal Services Review updates. BACKGROUND INFORMATION: Staff is requesting general input from the City Council regarding proposed boundaries for the City of Lodi Sphere of Influence (SOI) update. Staff is seeking general concurrence from the City Council for proposed SOI boundaries. Such concurrence will allow staff to continue the process of updating the City’s SOI and Municipal Services Review (MSR). The City Council is not taking formal action. The direction received from the Council will inform the SOI and MSR updates. Under the Cortese-Knox-Hertzberg Act, the Local Agency Formation Commission (LAFCo) of each county is required to update the SOIs and MSRs of their local agencies on a regular basis – five years is the specified period for regular updates. SOI and MSR updates are prepared by the individual cities and special districts of a county and submitted to LAFCo for review and approval. The City of Lodi SOI and MSR were last updated in 2007, with the result that the City is out of compliance with the requirement to have a recently updated SOI and MSR. The San Joaquin LAFCo has informed the City that no annexations will be considered until the SOI and MSR have been updated and adopted by LAFCo. Staff is requesting the City Council consider three key areas in the SOI update. The West Study Area and the South Study Area are both entirely inside the current SOI and staff is seeking concurrence that boundaries of these areas will not be modified. The third is, the East Study Area, includes lands identified for urban uses in the General Plan that are not currently in the SOI. Staff is asking for City Council concurrence that the 851-acre East Study Area should be proposed for inclusion in the SOI and that these lands would be designated for employment-generating uses (Commercial, Business Park and Industrial). A series of virtual community meetings were held to allow residents to provide input on the SOI update. Due to issues of delayed mail deliveries staff conducted two virtual meetings each for the West Study Area and the South Study Area. Community input was a mix of concern and support. Some residents expressed concern over being required to connect to City services while other residents expressed interest in connecting to such services. Concerns over conversion of farmland to urban uses were expressed by residents in or near each of the Study Areas. Support was expressed from owners in Study Areas that anticipate developing land in coming years. This site has not been discussed with community members and, if the Council is supportive, staff will conduct outreach to adjacent property owners and then report back to the City Council for direction. Sphere of Influence/Municipal Services Review Update Process Updating the SOI and MSR involves three basic steps: 1. The City will prepare a proposed SOI boundary for consideration by LAFCo. The City Council must determine what areas it would like to propose for LAFCo consideration. 2. The MSR will evaluate the City’s ability to provide public services to any areas in the SOI while still maintaining services to lands already in the City. 3. The LAFCo will review both the SOI and MSR and either approve or deny Inclusion of land in an SOI and evaluating how services would be provided is a planning exercise. It is anticipated that land would only be annexed to the City upon the request of property owners. Inclusion of land in the SOI does not obligate landowners to take any action and does not change how land is regulated – land in an SOI is regulated by the County (until annexation takes place). SOI/MSR Update Next Steps/Schedule With Council direction, staff will prepare an updated MSR that evaluates and describes how public services would be provided in the City and the SOI and would proceed with preparing an application to LAFCo to amend the SOI. An Environmental Impact Report (EIR) will be prepared to analyze cumulative impacts (air quality, vehicle miles traveled, greenhouse gas, climate change, etc. of development in the City and the SOI. Future project would still be subject to CEQA review that would consider the environmental impacts that would result from the individual project. It is anticipated updating the MSR and preparing the EIR (including Draft EIR, public review and final EIR) will require approximately ten months to prepare and that the MSR and SOI updates would be submitted to LAFCo for consideration in Fall of 2022. REQUESTED CITY COUNCIL INPUT: Staff is requesting Council concurrence on the key points noted below. With Council direction on these items staff will prepare and finalize the MSR and will initiate the CEQA environmental review that will support the SOI and MSR updates. West Study Area Staff Recommendation: SOI Boundary: Maintain the current SOI with no changes. MSR Assumptions: Include proposed change of a portion of the current Commercial designation on West Vine to High Density Residential and include proposed change of current Office designation along Kettleman Lane to Mixed Use Corridor. South Study Area Staff Recommendation: SOI Boundary: Maintain the current SOI with no changes. MSR Assumptions: Apply current General Plan designations in MSR analysis. East Area Study Area Staff Recommendation: SOI Boundary: Propose expansion of SOI to include the East Study Area. MSR Assumptions: Apply current General Plan designations in MSR analysis.
