Chairman Thompson referred to Ordinance No. C-5232, asked for all the people in the audience
who planned to give testimony, to stand, and they were sworn in by Elbert DuBose.
APPROVAL OF MINUTES FROM NOVEMBER 17, 2014
It was moved by Board Member Fitzpatrick and seconded by Vice-Chairwoman Arnold to
approve the minutes as submitted. The motion carried 4-0. Board Member Del Gaudio was not
present at the November meeting.

Administrative Citation Appeal Case
Chairman Thompson called for the owner or representative to appear before the
Board and Phillip Duncan, 4125 East 6th Street, Long Beach, CA 90814,
Owner appeared.
It was moved by Vice Chairwoman Arnold and seconded by Board Member
Witten to adopt the the findings as follows: The witnesses presented by the City
were, in fact, credible. PROPERTY OWNER, as the property owner of record, is
the responsible party for the cited violations. The cited violations did exist on the
date the citation was issued. The Appellant violated section(s) 8.76.010 (B) of
the Long Beach Municipal Code, because on May 20, 2014, the conditions of
the subject property were such that the paint covering on the building was not
being maintained in such a manner so as not to become deteriorated to a
condition that would permit decay, discoloration, excessive checking, cracking,
warping which would render the building unsightly or in a state of disrepair on
the property. (Note: This property is located in a historical district and
requires a Certificate of Approval from the Historic Preservation Officer for
the approval of paint color and materials.) Based upon the foregoing, the
appeal is denied. The motion carried 4-1. Board Member Del Gaudio opposed.
Board Member Fitzpatrick requested the City dismiss the 7th Administrative
Citation dated 11/21/14 and waive the $500 fee associated with this Citation.
The Board agreed to waive the $500 fee and also waive the $130 Lien
Preparation fee.

Board Member Del Gaudio mentioned he has a class he teaches that conflicts with the regularly
scheduled BEAC meeting. Angela Reynolds held a discussion on changing the time the BEAC
meets. It was decided to change the time to 9 a.m. on Monday instead of 1 p.m. She also
mentioned that there would be a training on Disabled Access Issues at a future meeting when the
new board member had completed her paperwork.
SET DATE FOR NEXT HEARING: FEBRUARY 9, 2015
MOTION FOR ADJOURNMENT
It was moved by Vice-Chairwoman Arnold and seconded by Board Member Witten that the
hearing be adjourned at 2:35 p.m. The motion carried unanimously.
