The meeting was called to order at 4:56 p.m. by Commission Vice-President Donna Choi with Commissioners Alarcon and Leung present. Commissioners Arellano and Stein were absent. Also present were, Blake Lamb, Senior City Planner, Oscar Medellin, Deputy City Attorney, and Harold Arrivillaga, Commission Executive Assistant. ________________________________ ITEM NO. 1 DIRECTOR’S REPORT Blake Lamb, Senior City Planner, announced that on February 23, 2017, the City Planning Commission (CPC) will consider a Conditional Use Permit application for Occidental College. ___________________________________ ITEM NO. 2 COMMISSION BUSINESS A. Advance Calendar: No changes. B. Commission Requests: None. C. Approval of the Minutes – January 11, 2017 The approval of these minutes was tabled to a future meeting. ___________________________________ ITEM NO. 3 NEIGHBORHOOD COUNCIL There were no presentations by any Neighborhood Council representatives. ___________________________________ ITEM NO. 4 ZA-2016-1745-CUB-1A Council District: 14 – Huizar CEQA: ENV-2016-1746-MND Last Day to Act: 03-20-17 Plan Area: Northeast Los Angeles PROJECT SITE: 5317 East York Boulevard IN ATTENDANCE: Aleta James, Associate Zoning Administrator, representing the Planning Department; Veronica Becerra, applicant’s representative. MOTION: Commissioner Alarcon put forth the actions below in conjunction with the approval of the following project with modifications as stated on the record by the Commission: The sale and dispensing of a full line of alcoholic beverages for on-site consumption in conjunction with a proposed bar, and the off-site consumption in conjunction with a proposed market within two tenant spaces of a restaurant/retail building located in the [Q]C2-1XL Zone. 1. Find, pursuant to CEQA Guidelines Section 15074(b), after consideration of the whole of the administrative record, including the Mitigated Negative Declaration, No. ENV- 2016- 1746-MND (Mitigated Negative Declaration), and all comments received, with the imposition of mitigation measures, there is no substantial evidence that the project will have a significant effect on the environment; find the Mitigated Negative Declaration reflects the independent judgment and analysis of the City; find the mitigation measures have been made enforceable conditions on the project; and adopt the Mitigated Negative Declaration and the Mitigation Monitoring Program prepared for the Mitigated Negative Declaration; 2. Grant the appeal in part and deny the appeal in part; 3. Sustain in part, the Zoning Administrator’s determination to approve a Conditional Use Permit for the project; 4. Adopt the Conditions of Approval as modified by the Commission; and 5. Adopt the Findings as amended by the Commission. In all instances, however, equal time is allowed for presentation of pros and cons of matters to be acted upon. All requests to address the Commission on public hearing items must be submitted prior to the Commission’s consideration of the item. EVERY PERSON WISHING TO ADDRESS THE COMMISSION MUST COMPLETE A SPEAKER’S REQUEST FORM AND SUBMIT IT TO THE COMMISSION STAFF. Day of hearing submissions (10 copies must be provided) are limited to 2 pages plus accompanying photographs and posters. PUBLIC COMMENT PERIOD The Area Planning Commission shall provide an opportunity in open meetings for the public to address on items of interest to the public that are within the subject matter jurisdiction of the Area Planning Commission. (This requirement is in addition to any other hearing required or imposed by law.) Persons making requests are encouraged to do so in writing and should submit 10 copies to the Area Planning Commission for its consideration. Persons wishing to speak must submit a speaker’s request form prior to the commencement of the public comment period. Individual testimony within the public comment period shall be limited to five (5) minutes per person and up to ten (10) minutes per subject at the discretion of the Commission President.
