SPECIAL CITY COUNCIL MEETING MINUTES
JUNE 26, 2018
ACTION MINUTES – These minutes are prepared to depict action taken for
agenda items presented to the City Council. For greater detail of this
meeting refer to the electronic media (CD and/or audio) kept as a permanent
record.
CALL TO ORDER: Mayor Villalta called the City Council Meeting to order at the hour of 4:00
P.M.
PLEDGE OF ALLEGIANCE: The pledge of allegiance was led by Police Chief Brizzee.
ROLL CALL – MEMBERS OF THE CITY COUNCIL PRESENT: Council Members Daronica
Johnson-Santos (4:01 PM), Deborah Lewis, Scott Silveira, Mayor Michael Villalta; Absent:
Council Member Tom Faria.
STAFF MEMBERS PRESENT: City Clerk/Human Resources Director Mallonee, City Manager
Terrazas, City Attorney Vaughn, Police Chief Brizzee, Fire Chief Hurley, Public Works
Director/City Engineer Fachin, Community & Economic Development Director Elms, Information
Technology Manager Singh.
CONSIDERATION OF APPROVAL OF AGENDA: Motion by Silveira, seconded by Lewis to
approve the agenda as submitted. The motion carried by the affirmative action of all City
Council Members present, Faria and Johnson-Santos absent.
[Council Member Johnson-Santos arrived at the Council Meeting at 4:01 PM and took her seat
at the dais.
PUBLIC FORUM: MEMBERS OF THE PUBLIC MAY ADDRESS THE CITY COUNCIL
MEMBERS ON ANY ITEM OF PUBLIC INTEREST THAT IS WITHIN THE JURISDICTION OF
THE CITY; INCLUDES AGENDA AND NON-AGENDA ITEMS. NO ACTION WILL BE TAKEN
ON NON-AGENDA ITEMS. SPEAKERS ARE LIMITED TO A FIVE (5) MINUTE
PRESENTATION. DETAILED GUIDELINES ARE POSTED ON THE COUNCIL CHAMBER
INFORMATIONAL TABLE. Mayor Villalta opened the public forum. Stanley Silva, Los Banos,
City of Los Banos retiree, stated that the comments/update on fireworks by Police Chief Brizzee
and Fire Chief Hurley at the last City Council Meeting was great and very beneficial, he came
back today to re-affirm what he stated last week regarding lifetime medical health benefits and
would like to open up some type of dialogue, would like to get some direction and explain what
he isn’t seeing, noting how they had things taken away from them as employees and this is one
thing we have not taken lightly, there are a lot of people who have given up over the years, he
does not feel he is the only one; Mayor Villalta asked Mr. Silva to please give the City Clerk your
phone number and someone will contact you. No one else came forward to speak and the
public forum was closed.
CONSIDERATION OF ADOPTION OF CITY COUNCIL RESOLUTION NO. 5975 –
PROVIDING FOR DETERMINING A TIE-BREAKER METHOD AMONG CANDIDATES AT
THE NOVEMBER 6, 2018 GENERAL MUNICIPAL ELECTION IN ACCORDANCE WITH
GOVERNMENT CODE SECTION 15651. City Clerk/Human Resources Director Mallonee
presented the staff report.
There was Council Member and staff discussion regarding if this was for just this election or
from now on, explanation on how the draw would work, the high cost of calling a special run-off
election, that you need to state that the tie breaker is by lot or the default is a special election,
not wanting to leave it to chance and support for a special run-off election, and if there were any
other options.
Motion by Silveira, seconded by Johnson-Santos to adopt City Council Resolution No. 5975 –
Providing for Determining a Tie-Breaker Method (By Lot) Among Candidates for City of Los
Banos Municipal Election in Accordance with Government Code Section 15651 and that this
would remain in effect until the City Council changes it. The motion carried by the affirmative
action of all City Council Members present, Villalta voting NO and Faria absent.
ADJOURNMENT. The meeting was adjourned at the hour of 4:15 P.M.
