CITY COUNCIL MEETING MINUTES
JUNE 20, 2018
ACTION MINUTES – These minutes are prepared to depict action
taken for agenda items presented to the City Council. For greater
detail of this meeting refer to the electronic media (CD and/or audio)
kept as a permanent record.
CALL TO ORDER: Mayor Villalta called the City Council Meeting to order at the hour
of 7:02 p.m.
PLEDGE OF ALLEGIANCE: Police Chief Brizzee led the pledge of allegiance.
ROLL CALL – MEMBERS OF THE CITY COUNCIL PRESENT: Council Members
Tom Faria, Daronica Johnson-Santos (7:13 PM), Deborah Lewis, Scott Silveira, Mayor
Michael Villalta; Absent: Tom Faria.
STAFF MEMBERS PRESENT: City Manager Terrazas, City Attorney Vaughn, City
Clerk/Human Resources Director Mallonee, Police Chief Brizzee, Fire Chief Hurley,
Finance Director Williams, City Treasurer/Accounting & Budget Supervisor Tomas,
Public Works Director/City Engineer Fachin.
CONSIDERATION OF APPROVAL OF AGENDA: Motion by Faria, seconded by
Lewis to approve the City Council Meeting agenda as submitted. The motion carried by
the affirmative action of all City Council Members present. ABSENT: Johnson-Santos.
PRESENTATION – INTRODUCE LOS BANOS FIRE DEPARTMENT NEW
EMPLOYEES. Fire Chief Hurley spoke regarding the promotions that have occurred
within the Fire Department: Robert Strauch promoted to Assistant Fire Chief, Zach
Sawyer promoted to Fire Captain, Josh Houtekamer promoted to Fire Engineer, and
Juan Ramirez hired as the new Firefighter.
PRESENTATION – UPDATE REGARDING ILLEGAL FIREWORKS – BY FIRE CHIEF
HURLEY & POLICE CHIEF BRIZZEE. Police Chief Brizzee spoke regarding illegal
fireworks and safe and sane fireworks, which included a PowerPoint presentation.
[Council Member Johnson-Santos arrived at the meeting at 7:13 pm and took her seat
at the dais.]
Informational item only. No action taken.
PUBLIC FORUM: MEMBERS OF THE PUBLIC MAY ADDRESS THE CITY COUNCIL
MEMBERS ON ANY ITEM OF PUBLIC INTEREST THAT IS WITHIN THE
JURISDICTION OF THE CITY; INCLUDES AGENDA AND NON-AGENDA ITEMS.
NO ACTION WILL BE TAKEN ON NON-AGENDA ITEMS. SPEAKERS ARE
LIMITED TO A FIVE (5) MINUTE PRESENTATION. DETAILED GUIDELINES ARE
POSTED ON THE COUNCIL CHAMBER INFORMATIONAL TABLE. STAN SILVA,
Los Banos, congratulated Council Member Silveira on his election, spoke to how he
came to work with the City of Los Banos in 1982 and retired in 2012, he spoke to the
lifetime medical benefits that were attached to his career and a reasonable expectation
to expect that, he was surprised to see a cap on health benefits, something he does not
agree with and feels that it is discriminatory; KYLE (Las name undecipherable),
Republic Services, spoke to proper disposal of fireworks, wanted to introduce everyone
to the new recycling coordinator Jennifer Joaquin; JENNIFER JOAQUIN, Republic
Services, spoke to how important recycling is to the City of Los Banos and how they are
doing their best to educate everyone as to what is recyclable and what is not. No one
else came forward to speak and the public forum was closed.
CONSIDERATION OF APPROVAL OF CONSENT AGENDA. Motion by Johnson-
Santos, seconded by Lewis to approve the consent agenda as follows: Check Register
for #211000 – #211178 in the Amount of $557,993.65; Minutes for the June 6, 2018 City
Council Meeting; City Council Resolution No. 5971 – Authorizing the Public Works
Director to Sign Master Agreement and Future Agreements Relating to State and
Federal Transportation Projects. The motion carried by the affirmative action of all
Council Members present.
PUBLIC HEARING – TO RECEIVE PUBLIC COMMENT AND CONSIDERATION OF
THE APPROPRIATION LIMITATION FOR THE 2018-2019 FISCAL YEAR (FY); CITY
COUNCIL RESOLUTION NO. 5972 – SETTING THE TAX RELATED
APPROPRIATION LIMIT IN COMPLIANCE WITH PROPOSITION 4 AND
PROPOSITION 111 FOR THE 2018-2019 FY. Finance Director Williams presented the
staff report, which included a PowerPoint presentation.
Mayor Villalta opened the public hearing. No one came forward to speak and the public
forum was closed.
Motion by Faria, seconded by Lewis to adopt City Council Resolution No. 5972 –
Setting the Tax Related Appropriation Limit in Compliance with Proposition 4 and
Proposition 111 for the 2018-2019 FY. The motion carried by the affirmative action of
all Council Members present, Faria absent.
PUBLIC HEARING – TO RECEIVE PUBLIC COMMENT AND CONSIDERATION OF
THE 2018-2019 FISCAL YEAR (FY) BUDGET; CITY COUNCIL RESOLUTION NO.
5973 – ADOPTING THE 2018-2019 FY BUDGET, INCLUDING EMPLOYEE SALARY
SCHEDULE (DIVISION 4), PERSONNEL BENEFITS (DIVISION 5), EDUCATION
INVENTIVE PAY (DIVISION 5-H) OF LOS BANOS POLICY & PROCEDURES
MANUAL, CAPITAL IMPROVEMENT PLAN AND COMMIT FUNDS FOR PUBLIC
SAFETY FLEET REPLACEMENT. Finance Director Williams presented the staff
report, which included a PowerPoint presentation.
There was Council Member and Staff discussion regarding certain areas of the budget
and situations related to CalPERS and personnel benefits.
Mayor Villalta opened the public hearing. No one came forward to speak and the public
hearing was closed.
Council Members commended Staff for putting together a fiscally sound budget. There
was further discussion regarding the health rates and how City employees are being
affected by these increases. Council Member Silveira asked for an amendment to the
budget to add $12,000 specifically for the continuum of care.
Motion by Silveira, seconded by Johnson-Santos to Amend and Adopt Resolution No.
5973 – Adopting the 2018/2019 FY Budget, Including Employee Salary Schedule
(Division 4), Personnel Benefits (Division 5), Education Inventive Pay (Division 5-H) of
Los Banos Policy & Procedures Manual, Capital Improvement Plan and Commit Funds
for Public Safety Fleet Replacement with the Addition of Subsection 5 to the Resolution
to Appropriate Funds in the Amount of $12,000 to the Continuum of Care Subject to a
Presentation by that Organization and then Reappearing Before the City Council for a
Vote to Release those Funds.
Council Member discussion arose regarding homeless services and other areas of need
for the community and how it is a big concern to know how funds for these things will be
spent.
Motion by Faria, seconded by Villalta to Amend the Previously Stated Motion Made by
Council Member Silveira and Adopt City Council Resolution No. 5973 – Adopting the
2018-2019 FY Budget, Including Employee Salary Schedule (Division 4), Personnel
Benefits (Division 5), Education Inventive Pay (Division 5-H) of Los Banos Policy &
Procedures Manual, Capital Improvement Plan and Commit Funds for Public Safety
Fleet Replacement, with the Addition of Subsection 5 to the Resolution which
appropriates $12,000 for General Homeless Services Subject to Future Discretion of the
Council. The motion carried by the affirmative action of all Council Members present.
PUBLIC HEARING – TO RECEIVE PUBLIC COMMENT AND CONSIDERATION OF
LEVYING PROPERTIES FOR WEED ABATEMENT SERVICES PERFORMED
DURING THE FISCAL YEAR 2017-2018 OR PRIOR FOR AREAS OF LAND
LOCATED IN THE CITY OF LOS BANOS, MERCED COUNTY AS FOLLOWS:
ASSESSOR PARCEL NUMBERS 026-082-022, 027-081-007, 027-086-009, 082-310-
042, 083-262-001, 083-390-026, 424-024-003, 424-066-031, 431-121-034, 431-141-
021. Finance Director Williams presented the staff report.
Mayor Villalta opened the public hearing. No one came forward to speak and the public
hearing was closed.
Motion by Lewis, seconded by Faria to adopt City Council Resolution No. 5974 –
Authorizing the Levy and Collection of Assessments for Weed Abatement within the City
of Los Banos; City Council Resolution No. 5974 – Authorizing the Levy and Collection of
Assessments for Weed Abatement within the City of Los Banos. The motion carried by
the affirmative action of all Council Members present.
CANCELLATION OF THE REGULAR CITY COUNCIL MEETING SCHEDULED FOR
WEDNESDAY, JULY 4, 2018 DUE TO THE 4TH OF JULY HOLIDAY. Motion by Faria,
seconded by Johnson-Santos to cancel the July 4, 2018 City Council Meeting due to the
4th of July Holiday. The motion carried by the affirmative action of all Council Members
present.
ADVISEMENT OF PUBLIC NOTICES (No Report).
CITY MANAGER REPORT. City Manager Terrazas stated that pursuant to
Government Code Section 54953(c)(3) Executive Compensation: the City Council, as
part of Agenda Item 8 B 1), adopted the 2018-2019 Fiscal Year Budget which included
approving a two and a half percent (2.5%) salary increase for
Unrepresented/Miscellaneous Full-time Employees which include the City Manager and
Department Heads. He thanked the Finance Department staff and other City staff in
their preparation of the budget that was adopted this evening. Hours and hours of effort
and pouring over spreadsheets went into this. He thanked the Council for their approval
of the budget.
CITY COUNCIL MEMBER REPORTS.
SCOTT SILVEIRA: Council Member Silveira thanked all of staff and particularly the
Finance staff and the work they do on the budget. The City is healthy not wealthy. There
needs to be future caution because the cost of doing business is increasing more than
the incoming revenues. It is going to continue to be a tough battle and we need to start
making investments into our future to find ways to increase revenues. He loves this
community as he was born and raised here, but something different needs to try to be
done. He spoke to some options he would like to see done for the City. There are eight
more Council meetings left for him as a Council Member. He thanked the Finance
Department and congratulated the new Los Banos Fire Department employees.
Encouraged the community to be aware of their pets and the commotion of the
fireworks during the 4th of July.
TOM FARIA: Council Member Faria spoke to Flag Day and how he noticed all of the
flags up around town. He spoke to Independence Day, the 4th of July and how there
were sacrifices made that should never be forgotten. The Finance Department did a
fantastic job on the budget. It’s nice to see the Boys and Girls Club in effect. He
congratulated the Fire Department employees on their new hires and promotions.
Wished everyone a wonderful 4th of July.
DARONICA JOHNSON-SANTOS: Council Member Johnson-Santos thanked the
Finance Department for all that they do. Congratulations to Scott as she knows he will
do a wonderful job in his new future position. Wished everyone a happy 4th of July.
DEBORAH LEWIS: Mayor Pro Tem Lewis congratulated Fire Chief Hurley on his
newly hired employee. She spoke to how she went and observed the Boys and Girls
Club in action at the community center and also spoke to the staff. The children were
enjoying themselves. This program has funds appropriated in its support for two years.
Thanked Finance Director Williams and her staff for all of their hard work. She wished
everyone a happy 4th of July and reminded everyone to keep in mind what was said
about the safe and sane fireworks and illegal fireworks. Encouraged everyone to get out
and support the local organizations by purchasing safe and sane fireworks at their
booths.
MAYOR MICHAEL VILLALTA: Mayor Villalta spoke to how it is good when people
come to speak at the public forum so that issues can be addressed. He noted that the
retiree that spoke this evening will be contacted by City Manager Terrazas and how the
public’s requests do not fall on deaf ears. Thanked the Police and Fire Departments for
their presentation on fireworks. He thanked the Finance staff as they are the unsung
heroes that are not getting the praise that they get. The City’s budget is recovering but
at a slow pace. The flags that were all over town for Flag Day looked great. He is
pleased to see that the Boys and Girls Club funds are being used exactly how they are
supposed to be. He wished everyone a safe 4th of July.
ADJOURNMENT. Motion by Lewis, seconded by Faria the meeting was adjourned at
8:54 PM to Tuesday, July 10, 2018 at 6:00 PM to Attend a Workshop to Discuss
Potential Local Funding Measure and Review Community Needs and Priorities Being
Held in the Council Chambers, 520 J Street, Los Banos, California.
