SPECIAL CITY COUNCIL MEETING MINUTES
AUGUST 17, 2022
ACTION MINUTES – These minutes are prepared to depict action
taken for agenda items presented to the City Council. For greater
detail of this meeting refer to the electronic media (CD and/or audio)
kept as a permanent record.
SPECIAL NOTE: This meeting was held by teleconference due to the
in accordance with Assembly Bill 361.
CALL TO ORDER: Mayor Pro Tem Lambert called the City Council Meeting to order at
the hour of 3:15 p.m.
PLEDGE OF ALLEGIANCE: The pledge of allegiance was led by Police Chief Brizzee.
ROLL CALL – MEMBERS OF THE CITY COUNCIL PRESENT: Council Members Brett
Jones, Kenneth Lambert, Deborah Lewis, Refugio LLamas; Absent: Mayor Tom Faria.
STAFF MEMBERS PRESENT: City Attorney Vaughn, City Clerk/Human Resources
Director Mallonee, Police Chief Brizzee, Community & Economic Development Director
Elms.
CONSIDERATION OF APPROVAL OF AGENDA: Motion by Lewis, seconded by Lambert
to approve the agenda as submitted. The motion carried by the affirmative action of all
Council Members present, Faria absent.
PUBLIC FORUM: MEMBERS OF THE PUBLIC MAY ADDRESS THE CITY COUNCIL
MEMBERS ON ANY ITEM OF PUBLIC INTEREST THAT IS WITHIN THE
JURISDICTION OF THE CITY; INCLUDES AGENDA AND NON-AGENDA ITEMS. NO
ACTION WILL BE TAKEN ON NON-AGENDA ITEMS. Mayor Pro Tem Lambert opened
the public forum and asked those present on the Zoom meeting if they would like to speak:
KATHY BALLARD inquired as to if they have questions during the interviews can they
ask or can she just watch for which City Clerk/Human Resources Director explained the
process will just include prepared questions from the City Council to each recruitment firm
and there is no opportunity for the public to ask questions; ANN McCAULEY, Los Banos,
reading from a prepared letter that is on file with the City Clerk, stated that because the
City Council will be changing with the upcoming election that the present City Council
should choose the next City Manager and hold off on that until the new City Council is
seated. Mayor Pro Tem Lambert asked if there were any written comments received and
City Clerk Mallonee stated that she received no comments to be read into the record. No
one else came forward to speak and the public forum was closed.
CONDUCT INTERVIEWS FOR THE SELECTION OF AN EXECUTIVE SEARCH FIRM
TO ASSIST THE CITY COUNCIL IN THE RECRUITMENT OF A NEW CITY MANAGER;
CITY COUNCIL RESOLUTION NO. 6534 – AUTHORIZING THE INTERIM CITY
MANAGER TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT FOR CITY
MANAGER RECRUITMENT SERVICES. City Clerk/Human Resources Director
presented the staff report, explaining the interview process, and then introduced each
firm: Koff & Associates, ProRecruiters, and Sectaris who in turn introduced themselves,
followed by pre-determined questions from each City Council Member.
Council Members Jones stated that he needs more time to decide and he is not ready to
vote on this item. Mayor Pro Tem Lambert suggested that if we could schedule a Closed
Session August 25, 2022 so that Mayor Faria could be in on this vote. City Attorney
Vaughn stated that it is the pleasure of the City Council to move forward or not, this is not
something that can be done in Closed Session, you can call a Special Meeting to discuss
this, because it is on video it would give Mayor Faria the opportunity to watch the
interviews. Council Member Lewis states that she feels not going forward right now is a
stall tactic and would like move this forward but not 2-3 weeks. Council Member Jones
stated that we should not be taking this recruitment lightly and he needs more time to
decide and would like to have five (5) votes on this.
Motion by Llamas, seconded by Lewis to proceed as indicated on the agenda. The motion
failed by the following roll call vote: AYES: Lewis, LLamas; NOES: Jones, Lambert;
ABSENT: Faria.
Motion by Jones, seconded by Lambert to bring this item back at another meeting to make
a vote on the recruitment firm when all five (5) members of the City Council are available
and Greg Wellman can help schedule that meeting. The motion carried by the affirmative
action of all Council Members present. The motion carried by the following roll call vote:
AYES: Jones, Lambert, Lewis, LLamas; NOES: None; ABSENT: Faria.
ADJOURNMENT. The meeting was adjourned at 4:51 p.m.
