SPECIAL CITY COUNCIL MEETING MINUTES
AUGUST 25, 2022
ACTION MINUTES – These minutes are prepared to depict action
taken for agenda items presented to the City Council. For greater
detail of this meeting refer to the electronic media (CD and/or audio)
kept as a permanent record.
SPECIAL NOTE: This meeting was held by teleconference due to the
in accordance with Assembly Bill 361.
CALL TO ORDER: Mayor Faria called the City Council Meeting to order at the hour of
2:03 p.m.
PLEDGE OF ALLEGIANCE: The pledge of allegiance was led by Police Chief Brizzee.
ROLL CALL – MEMBERS OF THE CITY COUNCIL PRESENT: Council Members Brett
Jones, Kenneth Lambert, Deborah Lewis, Refugio LLamas, Mayor Tom Faria; Absent:
None.
STAFF MEMBERS PRESENT: City Attorney Vaughn, City Clerk/Human Resources
Director Mallonee, Police Chief Brizzee, Interim City Manager Wellman.
CONSIDERATION OF APPROVAL OF AGENDA: Mayor Faria stated that he was absent from
the last City Council Meeting because he was tending his sister as her husband was on
the presidios of life and death but is doing much better and thanked all for their positive
thoughts and prayers.
Motion by Lewis, seconded by LLamas to approve the agenda as submitted. The motion
carried by the following roll call vote: AYES: Lewis, LLamas, Faria; NOES: Jones,
Lambert; ABSENT: None.
PUBLIC FORUM: MEMBERS OF THE PUBLIC MAY ADDRESS THE CITY COUNCIL
MEMBERS ON ANY ITEM OF PUBLIC INTEREST THAT IS WITHIN THE
JURISDICTION OF THE CITY; INCLUDES AGENDA AND NON-AGENDA ITEMS. NO
ACTION WILL BE TAKEN ON NON-AGENDA ITEMS. Mayor Faria opened the public
forum and asked those present on the Zoom meeting if they would like to speak for which
no one came forward. Mayor Faria asked if there were any written comments received
and City Clerk Mallonee stated that she received the following comments to be read into
the record: KIMBERLEE SUBIA FLORES wrote regarding how she has been watching
and following along with the homeless situation and how they are a part of OUR
community and the encampment is their HOME, encouraged Council Members to visit
the encampment and speak to the residents before you drive them out like cattle, how we
should have the same concern for the homeless that we do for the animal shelter, and
hopes they can find a plausible solution for the neediest among us. No one else came
forward to speak and the public forum was closed.
CONDUCT INTERVIEWS FOR THE SELECTION OF AN EXECUTIVE SEARCH FIRM
TO ASSIST THE CITY COUNCIL IN THE RECRUITMENT OF A NEW CITY MANAGER;
CITY COUNCIL RESOLUTION NO. 6542 – AUTHORIZING THE INTERIM CITY
MANAGER TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT FOR CITY
MANAGER RECRUITMENT SERVICES. Council Member Jones stated that he is not in
favor of either of the firms, in a few months we will have a new Mayor and possible a new
Council Member and if we are being ethical is what is in the best interests of the residents,
waiting until after we swear in the new members is not an unreasonable request, the
Interim City Manager can carry us well into January, and his feelings of how things will be
played out if a new City Manager is chosen before a new Council is seated, he feels this
item needs to be postponed.
Motion by Faria, seconded by Lewis to select Koff & Associates as the City Manager
Recruitment Firm. The motion carried by the following roll call vote: AYES: Lewis,
LLamas, Faria; NOES: Jones, Lambert; ABSENT: None.
Council Member Lewis stated that they have a duty to the residents of Los Banos to do
our job as long as we sit here, for a Council Member to read a statement and accuse the
rest of us of not doing our job and being reckless is wrong, and she spoke to her feelings
on how things will play out and supports moving forward with the process.
Motion by Lewis, seconded by LLamas to adopt City Council Resolution No. 6542 –
Authorizing the Interim City Manager to Execute a Professional Services Agreement for
City Manager Recruitment Services. The motion carried by the following roll call vote:
AYES: Lewis, LLamas, Faria; NOES: Jones, Lambert; ABSENT: None.
ADJOURNMENT. Motion by Lewis, seconded by LLamas to adjourn the meeting at 2:19
p.m. The motion carried by the following roll call vote: AYES: Lewis, LLamas, Faria;
NOES: Jones, Lambert; ABSENT: None.

to cityclerk@losbanos.org or drop them off at City Hall, 520 J Street.
If you are a Zoom video Conference participant: To comment by Zoom video
conference, click the "Raise Your Hand" button to request to speak when Public
Comment is being taken on an eligible agenda item. You will then be unmuted during
your turn and allowed to make public comments. After the allotted time, you will then be
re-muted.

Recommendation: Receive the staff report and select the preferred recruitment firm.
